HomeMy WebLinkAbout20120747.tiff RESOLUTION RE: ACTION OF BOARD AT INITIAL HEARING CONCERNING RESCINDING USE BY SPECIAL REVIEW PERMIT#1719 - MARY ANN PLONKA WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,on May 5, 2010, the Board approved the application of Mary Ann Plonka, 16230 State Highway 52, Fort Lupton, Colorado 80621, for a Site Specific Development Plan and Use by Special Review Permit#1719 for a Use Permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial and Industrial Zone Districts (RV, boat, and construction equipment storage) along with one (1) Mobile Home used as living quarters for caretakers or security personnel responsible for maintaining or guarding the property(a modular/mobile home to be used as an office and as a residence for employees) in the A (Agricultural) Zone District, on the following described real estate, being more particularly described as follows: Lot B of Recorded Exemption #3193; located in part of the SW1/4 of Section 2, Township 1 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, the Department of Planning Services notified the applicant of outstanding Conditions of Approval and items to be completed prior to recording the plat, by letters dated August 4, September 26, and November 4, 2011, and WHEREAS, on the 19th day of December, 2011, an Initial Hearing was held before the Board to consider granting additional time to meet all of the conditions/requirements of approval and record the plat, or set a Final Determination Hearing to Rescind approval of Use by Special Review Permit#1719 and Deny the application, and WHEREAS, at said hearing, a representative for Mary Ann Plonka (deceased) was not present;therefore,the Board deemed it advisable to grant Planning Services staff additional time in their attempt to reach a representative for Ms. Plonka and determine the intention of her heirs, and continued the matter to January 23, 2012, at 9:00 a.m., and WHEREAS,on January 23, 2012, a representative for Mary Ann Plonka(deceased)was not present;therefore,the Board deemed it advisable to continue the matter to March 19,2012,to allow Planning Services staff additional time to work with the applicant's daughter to meet all of the conditions/requirements of approval and record the plat. Remaining Outstanding Conditions of Approval: There are three outstanding conditions of approval as outlined in the USR-1719 Board of County Commissioners Resolution: 1.B. Improvements agreement for on-site improvements (landscaping, fencing, access and drainage improvements...). 3.F Submit a landscape and screening plan for review and approval by the Department of Planning Services. The applicant shall attempt to comply with the fencing requirements of the Fort Lupton Code. ,o/a-0"747 P4°2o5 2. Submittal of the USR-1719 plat for recording Staff Recommendation: This land use case has mitigating circumstances. The applicant, Mary Ann Plonka, passed away in Spring of 2011. Staff has had conversations with Linette Mount, Mary Ann Plonka's daughter. In our latest conversation on March 16, 2012, she indicated that she is now the representative for this application and will be providing documentation to that effect. She has contacted the surveyor re: changes to the plat and will be contacting him again. Ms. Mount had a meeting with Todd Hodges of Fort Lupton re: proposed fencing for the site. The final draft of the improvements agreement can proceed upon submittal of the documentation from Ms. Mount that she is the representative for this application. Ms. Plonka passed away last year and Ms. Mount has indicated that she wishes to proceed with finalizing this USR. She indicated she would be providing the paperwork indicating she is taking over from Ms. Plonka. Attached is the last correspondence re:the improvements agreement—it looks like the last item was what information needs to show up on Section 9 of the improvements agreement. This case is scheduled to go before the BOCC on January 23rd for the Board to consider whether to grant the applicant additional time to finalize the USR or proceed with scheduling a hearing to consider rescission (vacation)of the USR approval. Ms. Mount has indicating she would requesting additional time to finalize conditions of approval and record the plat. I will forward the information from Ms. Mount when I receive it so that the improvements agreement can be finalized. She graduated from Manual High School in Denver and attended the University of Louisville for a couple years and then the University of San Francisco, where she graduated. Mary Ann enjoyed spending time with her grandkids and teaching all children. She also had a great love for animals. I have some revisions: 1) Planting information (sizes: either height or caliper) of trees and the types of trees to be planted need to be indicated. 2) The types of planting in the 50-foot buffer area need to be indicated. 3) The type of fencing to be installed shall be indicated. One item that should be noted: CDOT was requiring 75-feet from the centerline of State Highway 52. Therefore, the 50-foot buffer area will need to be shifted back 25-feet to the south. This will require one row of parking to be removed (as discussed at the County Commissioners Hearing). There are some remaining changes that I have marked up for the surveyor. (I will send or have them pick it up after I hear from Public Works on the drainage) . Public Works has been sent a copy of the plat to verify the drainage calculations. I am waiting to hear back from them on this. I should hear back from Heidi this week. Finally, I am going to discuss one item with Lauren Light with Environmental Health re: a note on the plat. She is out of the office this week so I will check with her early next week. In reviewing the file, I see the following conditions remaining that need to be completed prior to recording the plat: 1) The Improvements Agreement (to cover access, parking and drainage improvements on your site) . Public Works is drafting this agreement and it should be sent to you this week. After you receive the improvements agreement and get a chance to take a look at it. The Board of Health, on March 25, 2008, approved an engineer design for the addition of 5 patrons a day to the septic system which included the addition of 462 square feet to the existing septic system.
