Conway, Chair Commissioner William F. Garcia, Pro-Tern Commissioner Barbara Kirkmeyer Commissioner David E. Long Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Brad Yatabe Planning Department representative, Tom Parko Public Works representative, Heidi Hansen Health Department representative, Lauren Light The following business was transacted: e I hereby certify that pursuant to a notice dated September 28, 2012, and duly published October 3, 2012, in the Fort Lupton Press, a public hearing was conducted to consider the request of O&M Harms, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR12-0042, for an Oil and Gas Support and Service (water depot) in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. El Tom Parko, Department of Planning Services, presented a brief summary of the proposal, stated approval of this permit will address a zoning violation for operating without the appropriate permits, and he reviewed the surrounding land uses and referral responses. He entered the favorable recommendation of the Planning Commission into the record as written and displayed an aerial map and photographs of the site and surrounding area. El Heidi Hansen, Department of Public Works, provided a brief overview of the transportation plans and access requirements, and stated a water quality depression will not be required. She addressed questions from the Board and confirmed the site accesses a County maintained road. Fl Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions. She requested Development Standard #11 be modified to add the standard language concerning the records associated with the maintenance of the portable toilets, which is consistent with the revisions made for the previous case (USR12-0044). He stated the water consumption for the proposed use is reduced during the summer while they are utilizing the water for irrigation. No public testimony was offered concerning this matter. In response to Chair Conway, Mr. Harms agreed with the proposed revision to Development Standard #11 to be consistent with the previous case. He indicated they will not need portable toilets in the summer when the site is not providing water for oil and gas operations. He also reviewed plans to bring in gravel to elevate the area in front of the tanks for better drainage of the site. Ms. Hansen clarified the Improvements Agreement will only require tracking control, if necessary. Commissioner Long indicated Development Standard #17 is specific to the tracking control and should be deleted, and the applicant agreed. In response to Mr. Harms, Ms. Light clarified submittal of a written plan indicating they intend to remove the site trash to their residence for proper removal will satisfy the Waste Handling Plan requirement. The Board also directed staff to remove the language from criteria paragraph #2.F regarding the use of a pivot sprinkler. e Commissioner Long moved to approve the request of O&M Harms, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR12-0044, for an Oil and Gas Support and Service (water depot) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. His motion included deleting "coupled with a center pivot for irrigation"from criteria paragraph #2.F, amending Development Standard #11 to state, "Adequate hand washing and toilet facilities shall be provided for employees and patrons of the facility. Portable toilets are allowed in accordance with Environmental Health Policy when employees or contractors are on the site for less than two (2) consecutive hours a day. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced and shall contain hand sanitizers.", deleting Development Standard #17, and renumbering the subsequent items. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously.
