Weld County was the recipient of the 2009 Congressional Select Award: 2009-D 1-BX-0263 has an
unobligated balance of$500,000.
FORMAL REQUEST: Therefore,in light of the announcement of a start and completion date for the
crime lab, the Weld County Commissioners and Sheriff's Office (and the other 5 participating
agencies who will be participants in the lab) are requesting a no cost extension of 12 months on the
2009-D1-BX-0263 Congressional Select Award. The new projected end date would be 9/30/2014.
On September 21, 2009 the Weld County Sheriffs Office was notified that they had become the
receipt of a Congressional Select Award for $500,000. The funds had been requested to assist the
Regional Lab in"Operation and Maintenance Costs"during the first 2 years of operation while the
participating agencies established their budgets to adjust for the additional costs relative to a central
facility. The creation of a central laboratory in which all of the examiner and analysts in the region
would operate out of was tantamount to the spending down of those dollars. At the request of NIJ,
adjustments and clarifications were made to the grant (November 10, 2010) and the funds were
released to the county in December of 2010.
One of the stated purposes of the grant was to assist victims of crimes, and this crime lab has and
will continue to perform those functions. However,the incorporation of all of the staff in a central
facility will allow for greater efficiencies and better service to the participating agencies.As evidence
of the labs service to the area,in 2011 the regional crime lab was the recipient of the August Vollmer
Excellence in Forensic Science Award from the IACP for laboratory collaboration with local law
enforcement. Additionally, Congress has made quality forensic lab services a priority and having a
central facility will provide a more effective means of assuring that quality through improved
communications, audits and onsite inspections by managers.
Due to economic conditions in the past few years,which in part resulted in the loss of a$2,000,000
grant the county reevaluated the situation and sought other funds to build the lab. That process has
taken several years to locate a source for the additional funds. Within the past few months the Weld

County Commissioners were able to secure additional funds to allow the construction of the facility
to begin. On May 21, 2012, the Weld County Commissioners held a press conference where they
announced a time line for the process of bringing a crime lab facility to completion by the fall
(September) of 2014. The 2009 Congressional Select Award (2009-D1-BX-0263) has a budget
period of 10/01/2009 to 09/30/2012. This award was designed to assist in the Operation and
Maintenance costs of the facility for a two year period following the completion of the regional lab
facility.

2. The recipient acknowledges that failure to submit an acceptable Equal Employment Opportunity Plan(if recipient is

SPECIAL CONDITIONS
7. No portion of these federal grant funds shall be used towards any part of the annual cash compensation of any
employee of the grantee whose total annual cash compensation exceeds 110%of the maximum salary payable to a
member of the Federal government's Senior Executive Service at an agency with a Certified SES Performance
Appraisal System for that year.
This prohibition may be waived on an individual basis at the discretion of the Assistant Attorney General for OJP.
8. The recipient may not obligate,expend or draw down funds until the Office of the Chief Financial Officer(OCFO)has
approved the budget and budget narrative and a Grant Adjustment Notice(GAN)has been issued to remove this special
condition.
9. The recipient agrees not to obligate,expend,or draw down any funds until the program office has verified that the
recipient has submitted all necessary documentation required to comply with the Department of Justice Procedures for
Implementing the National Environmental Policy Act found at 28 CFR Part 61 and a Grant Adjustment Notice has been

Subject: Environmental Assessment for Weld County
The Edward Byrne Memorial Discretionary Grants Program helps local communities improve the
capacity of local justice systems and provides for national support efforts.
Recipients of federal grant funding must comply with all applicable environmental laws and regulations,
including National Environmental Policy Act,hereafter referred to as NEPA.Under federal law,and
implementing Department of Justice regulations,28 C.F.R.Part 61,an Environmental Assessment,and
possibly an Environmental Impact Statement,is required for the implementation of a grant-funded
program that could have significant adverse impact on the environment,including programs that involve
any of the following:
(1)Construction or similar activities;
(2)Any renovation or remodeling of a property located in an environmentally or historically sensitive
area,including property(a)listed on or eligible for listing on the National Register of Historic Places,or
(b)located within a 100-year flood plain,a wetland,or habitat for an endangered species;
(3)A renovation that will change the basic prior use of a facility or significantly change its size;
(4)Research and technology whose anticipated and future application could be expected to have an effect
on the environment;or
(5)Use of chemicals.
The program that is the subject of the current award includes one or more of the above NEPA triggers,

The Congressionally Selected Awards Program,authorized by the Omnibus Appropriations Act,2009(Pub.L.III-8), helps improve the functioning ofthc
criminal justice system,prevent or combat juvenile delinquency,and/or assist victims of crime(other than compensation).Funds should be used for the projects
selected by Congress,in the amounts specified in the joint explanatory statement incorporated by reference into Pub.L.I1 I-8,and generally consistent with one or
more of the following statutory purposes:improving the functioning of the criminal justice system,preventing or combating juvenile delinquency,or assisting
victims of crime(other than compensation).Each of these purposes is framed using language drawn,respectively,from the former Byrne discretionary statute,the
Juvenile Justice and Delinquency Prevention Act,the Victims of Crime Act,and the Violence Against Women Act. This project is authorized and funded through a
line item in the FY 09 Congressional Budget and by the joint explanatory statement that is incorporated by reference into the FY09 Omnibus Appropriations Act.
The Northem Colorado Regional Forensic Laboratory will use the FY09 Congressionally Selected Awards funding to improve all areas of forensic services

provided in northern Colorado and the creation of a full service regional forensic laboratory.This is a collaborative effort between the Colorado Bureau of I
Investigations,Adams County Sheriff's Office,Latimer County Sheriff's Office,Weld County Sheriff's Office,Loveland Police Department,Greeley Police
Department,and Fort Collins Police Services. The goal of the group is to combine efforts toward improving all areas of forensic services provided in norlhem
Colorado and the creation ofa full service regional forensic laboratory. This new facility would allow for a regional lab focused on both standard and more complex
procedures,such as DNA testing. In an effort to implement the project goals and objectives of pre-project approval/pre-construction,an Owner's Representative
will be hired,as will a Project Consulting Architect,to refine the Facilities Program and to develop the schematic desigm/design development. Deliverables from
this project exercise include: 1)preliminary space plan,2)concept sketches/renderings of the facility(2 drawings),and 3)preliminary LEED/high performance
build study. This will allow for a responsible business case and facility overview to not only further define the proposed project,but establish a baseline and
program for the proposed future development. This will also enable the current operation to have a programmatic foundation to meet its goals and objectives.

murder rotation as a second chair. Work with the White Collar Crime Task Force including

Supervising Deputy District Attorney- Duties include supervising 3 other attorneys,2 victim

Managing this project will involve personnel responsible for the oversight of the Project Design
and Operational Costs of the Northern Colorado Regional Forensic Laboratory. The following
key personnel are needed to insure that management and staffing will be clearly connected to the
Project Design as well as the pursuant Operational Costs once the facility is built:
• The awardee of this FY 09 Congressionally Selected Award,John Cooke,Sheriff of
Weld County.
• The voting members of the Board of Directors for the Northern Regional Lab Group
consisting of designates of the involved agencies. These members are Bureau Chief Kim
Fliethman(Weld County Sheriff Office),Undersheriff Ern Hudson(Larimer County
Sheriff's Office),Captain Rob McDaniel(Loveland Police Department),DDA Matthew
Pring(Weld County District Attorney's Office),ADA Clifford Riedel(Larimer County
