HomeMy WebLinkAbout20123636.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO DECEMBER 19, 2012 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, December 19, 2012, at the hour of 9:00 a.m. ID ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Sean P. Conway, Chair Commissioner William F. Garcia, Pro-Tem Commissioner Barbara Kirkmeyer Commissioner David E. Long Commissioner Douglas Rademacher Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Esther Gesick Director of Finance and Administration, Monica Mika e MINUTES: Commissioner Long moved to approve the minutes of the Board of County Commissioners meeting of December 17, 2012, as printed. Commissioner Kirkmeyer seconded the motion, and it carried unanimously. la AMENDMENTS TO AGENDA: Commissioner Rademacher moved to add Commissioner Coordinator Reports. Commissioner Kirkmeyer seconded the motion, which carried unanimously. ▪ PUBLIC INPUT: No public input was given. e COMMISSIONER COORDINATOR REPORTS: Commissioner Garcia reported that he met with Bruce Barker, County Attorney, Jennifer Finch, Public Information Officer, Monica Mika, Director of Finance and Administration, and Jennifer Fuller, Office Administrator, to discuss goals for 2013 during his Chairmanship of the Board. Commissioner Kirkmeyer spoke about the Office of Information Technology (OIT) and the Consolidated Communications Network of Colorado (CCNC) regarding contention over the ownership, authority and use (a request has been made for fees to be paid by the County) of the Zone 3 Controller. She requested the support of the Board and the County Attorney to address this issue. Chair Conway extended an open invitation to the Farewell Party for Commissioner Long on Friday, December 21, 2012. Commissioner Long stated it has been an honor and a privilege to serve as a Weld County Commissioner; he thanked all who he has worked with for making it such a rewarding experience. a Chair Conway reported participating in the Annual Migrant Christmas Party at Northridge High School, commended Adolf Diaz, for his incredible job putting that together and recognized Jennifer Finch, Steve Moreno, Dave Bressler (Santa), Ken Buck and 8 other Weld County staff for attending. He encouraged participation in next year's event. Chair Conway commended Minutes, December 19, 2012 2012-3636 Page 1 BC0016 Commissioner Kirkmeyer for taking the lead on the opening of the Compressed Natural Gas (CNG) station in Fort Lupton, and noted there will be a ribbon cutting tomorrow on a fourth station near Kersey. Commissioner Kirkmeyer recognized all of the Board, staff and other entities involved for the success of the overall project. Lastly, Chair Conway, as a member of the Chamber Board, reported some good news regarding a survey presented at the Chamber of Commerce Annual Retreat, wherein Weld County was highly rated by Chamber members as a "business friendly" environment. He also attended the Upstate Board Meeting with Commissioner Garcia and spoke to the positive outcomes of the Leadership Council's goals for creating new jobs. El Chair Conway declared his desire to put on the record an urgent need to begin a dialogue with the Greeley Tribune regarding their coverage and editorials regarding the Board of Commissioners and Weld County. He referenced and quoted with dismay several articles and editorials published by the Greeley Tribune attacking Weld County and the Board's position regarding Air Quality monitoring, Amendment 64, and potentially lowering the tax burden on Weld County residents. He cited a trend of serious inaccuracies and lack of comprehensive understanding of the topics referenced in these articles and of the prevailing philosophies of Weld County taxpayers. IE Commissioner Rademacher stated he concurred with all of the statements and sentiments expressed by Chair Conway. Commissioner Garcia stated his belief that one of the major detriments to economic development in Greeley and throughout Weld County is a persistent trend of "down-talking" our community, especially in the Greeley Tribune, which is a primary source of information for outsiders looking into the community. He stated that he and other Board members have attended hundreds of meetings throughout the year and witnessed positive accomplishments, great opportunities and community pride. a Commissioner Long stated this is a great County, and a collection of municipal communities with a sense of cohesiveness and mutual support, and potentially the only one in the U.S. with no debt, which benefits by virtue of policies supported by the voters, and added that smaller government works for the good of the entire public of all ages and economic backgrounds of this County, which is positively recognized throughout the State and nation-wide. He also said that Weld County, and local media, should brag more about the County's many successes. a Commissioner Kirkmeyer agreed with the previous statements and stated it appears that part of the problem is evidently a lack of understanding of policies and procedures (especially the role of the Planning Commission) and a general lack of research. She provided clarification on the facts in rebuttal to the comments written in the article regarding being fiscally conservative (as required by the County Charter). a Chair Conway noted his belief the First Amendment but added that, even though the comments referenced were expressed on the editorial page, the media has a public responsibility to editorialize accurately. He expressed frustration with the editorial department's frequent publication of poorly researched articles, which also lacked an understanding of the County's history and stated there needs to be accountability by the Board in terms of accepting criticism, as well as the newspaper in terms of accuracy and general negativity. IR CONSENT AGENDA: Commissioner Rademacher moved to approve the Consent Agenda as printed. Commissioner Garcia seconded the motion, and it carried unanimously. BIDS: IR 1) APPROVE BID #B1200152, TAX NOTICES AND ENVELOPES - TREASURER'S OFFICE: Barbara Connolly, Controller, reviewed staff's recommendation. John Lefebvre, Treasurer, confirmed the County has not worked with this vendor in the past; however, they have interviewed them and based on a review of references, his staff believes they will be timely and up to the task. Commissioner Rademacher moved to approve the bid. Commissioner Kirkmeyer seconded the motion, and it carried unanimously. Minutes, December 19, 2012 2012-3636 Page 2 BC0016 OLD BUSINESS: E 1) CONSIDER BYLAWS FOR WELD COUNTY DRUG TASK FORCE ASSET SEIZURE/FORFEITURE OVERSIGHT COMMITTEE AND AUTHORIZE CHAIR TO SIGN (CON'T FROM 11/14/2012): Bob Choate, Assistant County Attorney, was present. Mr. Barker clarified that the matter should be continued until a work session can take place. The Board deemed it advisable to take no action and to have the bylaws brought back before the Board when ready to be addressed. Commissioner Kirkmeyer made a motion to refer them back to the County Attorney's Office. Commissioner Rademacher seconded, and the motion carried unanimously. NEW BUSINESS: 1) CONSIDER APPOINTMENT OF PRIVACY OFFICERS UNDER HEALTH INSURANCE PORTABILITY AND ACCOUNTABILITY ACT (HIPAA) AND SECTION 3-15 OF THE WELD COUNTY CODE: Mr. Choate, explained the need for individual privacy officers within each of the covered departments, reviewed the appointees for the record, and clarified that the resolution revokes all prior appointments. Commissioner Garcia moved to approve the Resolution. Commissioner Rademacher seconded the motion. Mr. Choate answered questions from the board. There being no further discussion, the motion carried unanimously. El 2) CONSIDER CANCELLATION OF 2012 OUTSTANDING ACCOUNTS RECEIVABLE FOR WELD COUNTY PARAMEDIC SERVICE: Ms. Connolly explained these were accounts sent to collection and also stated there will be further efforts made to try and collect on them. Commissioner Conway noted this is the last time these outstanding paramedic accounts will have to be addressed by the County. Commissioner Kirkmeyer moved to approve said cancellation. Commissioner Rademacher seconded the motion, which carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
