The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: CR 55 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60- foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. Expected traffic is minimal with a maximum of 20-100 vehicles per day with over 1,000 for special events. The applicant will utilize only the existing accesses to the property. No additional accesses will be granted. Please show the approved accesses on the plat and label with the Approved Access Permit Number (will be provided). Access improvements are required and shall include 45' radiuses to accommodate turning trucks with trailers and tracking control to prevent the tracking of mud onto the gravel roadway. An improvements and road maintenance agreement is required for this site. Public Works will provide a draft of the agreement after the Board of County Commissioners hearing for this project. An example Improvements Agreement is available on the County Planning website under Application Assistance. Dust Control will be required along the specified haul route. Water quality depressions for the parking areas have been provided and are acceptable to Public Works. This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency Management Agency (FEMA). REQUIREMENTS: 1. Show the approved accesses on the plat and label with the Approved Access Permit Number (will be provided). 2. Access improvements are required and shall include 45' radiuses to accommodate turning trucks with trailers and tracking control to prevent the tracking of mud onto the gravel roadway. 3. An improvements and road maintenance agreement is required for this site. Public Works will provide a draft of the agreement after the Board of County Commissioners hearing for this project. 4. Add the following notes to the plat: a. There shall be no parking or staging of vehicles on County roads. b. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. d. According to the application the facility will operate March through May and September through November. There will be an estimated 20 to 100 riders per day and up to 1000 during special events. There will be 2 full time employees and more personnel will be hired for special events. The patrons and employees must have access to potable water, restroom and hand washing facilities. The application states that portable toilets will be provided. The following section is from Environmental Health Services, Weld County Department of Public Health & Environment, Septic Policies. 2.2.K Use of portable toilets and bottled water (revised 5/8/12) Purpose: To define when portable toilets and commercially bottled water are allowed. Policy: Bottled water from a commercial source is allowed in the following circumstances: 1 . Temporary or seasonal uses that are utilized 6 months or less per year (for example recreational facilities, firework stands, farmers markets ) 2. Gravel mines 3. 10 or less customers or visitors per day and/or one of the following: 4. 2 or less full time (40 hour week) employees located on site 5. 4 or less part time (20 hour week) employees located on site 6. employees or contractors that are on site for less than 2 consecutive hours a day Policy: Portable toilets are allowed in the following circumstances: 1 . Temporary or seasonal uses that are utilized 6 months or less per year (for example recreational facilities, firework stands, farmers markets ) 2. Gravel mines 3. 10 or less customers or visitors per day and/or one of the following: 4. 2 or less full time (40 hour week) employees located on site 5. 4 or less part time (20 hour week) employees located on site 6. employees or contractors that are on site for less than 2 consecutive hours a day Note: Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. As indicated above, it is the policy of this department that portable toilets are allowed for temporary or seasonal uses that are utilized 6 months or less per year. As the facility will be operated for 6 months, in accordance with Environmental Health Services policy the use of portable toilets is allowed. There is an existing 4 bedroom home that is served by an individual sewage disposal system (Permit No. SP-0300165). The waste handling plan indicates there will be several 50 gallon drums throughout the site which will be maintained by the owners and emptied into a dumpster. Gray Brothers will service the dumpster on a weekly basis. Fuel will not be stored on the facility. The application states that the tracks, entry and exit driveways will be watered however; no information was provided regarding the parking areas. A revised dust abatement plan is required to address the parking areas. Noise will be restricted to the level allowed in the non-specified zone district. A noise plan is required which can include, berming, adding hay bales and limiting hours of operation. If there will be food vendors, a food license through our consumer protection division may be required. 2 We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1 . The applicant shall submit a dust abatement plan, detailing on site dust control measures, for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. 2. The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application from the Air Pollution Control Division, Colorado Department of Health and Environment, if applicable. Alternately, the applicant can provide evidence from the APCD that they are not subject to these requirements. 3. The applicant shall submit a noise plan for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 3 6. This facility shall adhere to the maximum permissible noise levels allowed in the Non-specified Zone as delineated in Section 14-9-30 of the Weld County Code. 7. In the event washing of vehicles will occur on site the applicant shall ensure that any vehicle washing areas shall capture all effluent and prevent discharges from the washing of vehicles in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 8. Adequate drinking, hand washing and toilet facilities shall be provided for personnel and patrons of the facility at all times. As this is a temporary or seasonal use that is utilized 6 months or less per year portable toilets and bottled water are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. 9. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 10. RV units shall have self-contained sewage disposal and shall dispose of sewage at an approved off-site facility. 11 .The applicant shall comply with Colorado Retail Food Establishment Rules and Regulations governing the regulation of food service establishments. 12.The applicant shall obtain a Colorado Discharge Permit System or CDPS permit from the Colorado Department of Public Health and Environment (CDPH&E), Water Quality Control Division, as applicable. 13.The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. 4 MEMORANDUM WI`Dc COLORADO To: Diana Aungst, Planner December 17, 2012 From: Bethany Salzman, Zoning Compliance Officer Subject: USR12-0059 Referral Upon review of my case files and computer, an active Zoning Violation (ZCV12-00141)was noted. This violation was initiated due to the operation of a recreational park (specifically motocross) without first completing the necessary Weld County Zoning Permits. This case has not been presented to the Weld County Court Magistrate through the Violation Hearing process. Since this application was submitted prior to an actual court date being scheduled, no investigation fee is required. Due to records release laws, staff no longer tracks complainant information, but please be aware it is staff's policy to no longer accept staff initiated complaints. This application if approved by the Board of County Commissioners and once a plat is recorded will correct the violation. If this application is denied, all motocross events, advertisements and operations shall be removed from the property within 30 (thirty) days of denial or the violation will proceed in court accordingly. Fire Department notification will be required and a letter from the fire department with any comments will need to be sent to the Weld County Building Department. Also,that if they have a private ambulance service taking care of medical stand-by's,they only treat the injured at the site,the said service will not be granted the ability to transport patients,they must contact the local authority "Southeast Weld Fire Protection District"through the use of the emergency phone number(911).
