Re: Town of Ault Proposed Cunningham Annexations
Dear Brad:
As you are aware, the Town of Ault is contemplating annexation of certain property in
Weld County per the above referenced application. The purpose of this letter is to formally
request waiver of the requirement under section 31-12-108.5 that an impact report be prepared.
We believe that the Town has already supplied all of the information required to be
included in the impact report as set forth in the statute. The reason no report was prepared was
that the non-roadway acreage included in the proposed annexation is substantially less than the
ten acre threshold.
As you are aware, the hearing on the proposed annexation is scheduled for tomorrow
evening, so we respectfully request a prompt response to this proposal. Thank you for your
attention to this matter. If the county wishes, a report could be prepared and filed, but we would
all need to extend the pending action dates.

I just met with the Board of County Commissioners and they are not willing to waive the
requirement for an annexation impact report. The Board is requesting that an annexation report
be prepared pursuant to§ 31-12-108.5, C.R.S. Please let me know how Ault will be proceeding.
