No _. -- Mary Ann Feuersttin, Recorder ORDINANCE NO. 30 IN THE MATTER OF CREATING THE WELD COUNTY MUNICIPAL AIRPORT ° AUTHORITY. c,. WHEREAS, the "Public Airport Authority Law" authorizes the creation of airport authorities, corporate and politic, by cities and counties; and WHEREAS , the City of Greeley and the County of Weld have created, established and currently are operating an airport known as the Weld County Municipal Airport; and 0 o WHEREAS, the Board of County Commissioners has determined C] that it is in the best interests of Weld County to form an airport authority. NOW, THEREFORE, BE IT ORDAINED by the Board of County Com- missioners of Weld County, Colorado: Section 1. There be and hereby is created, pursuant to the provisions of the Public Airport Authority Law, Section 41-3-101 , et seq. , CRS 1973 , an airport authority. Section 2. The airport authority hereby created shall be known as the Weld County Municipal. Airport Authority. Section 3. Said Weld County Municipal Airport Authority shall be a body corporate and politic constituting a political subdiv- ision of the State of Colorado , and shall have all power and authority granted to it under the Colorado Public Airport Authority Act. Section 4. The City of Greeley and the County of Weld have contributed assets to the Authority as set forth in Exhibit A of this Ordinance which is incorporated herein by reference as if set forth fully herein. The City has contributed 74% of the real property assets and the County 26% . The City has contributed 47% of the other assets and the County 53% . Upon dissolution of the Airport Authority, by agreement of the County and City or for any other reason, its liabilities and obligations to creditors shall be paid, and the assets shown on Exhibit A or the proceeds of their sale, shall then be distri- buted to the City and County in proportion to their capital con- tributions. A 950854 03*- 17611.5'7 - a After the formation of the Airport Authority a list of con- tributions shall be maintained showing what real property assets and other assets have been contributed by the City and the County. Upon dissolution these assets shall be distributed to the City and the County in proportion to their contributions. Property acquired by the use of Federal funds shall be returned to the United States Government if so required and if such is not re- quired, it shall be divided 50% to the City and 50% to the County. If a dissolution or termination of the Airport Authority shall occur and the City and the County are in dispute as to any matter, the settlement of any such dispute will be arbitrated in accordance with the then prevailing rules of the American Arbit- ration Association. Section 5. After formation of the Weld County Municipal Air- port Authority, it is the intent of the County of Weld to contri- bute funds or money to the Airport pursuant to the Airport Master Plan for capital investment, but not to contribute toward the normal operations and maintenance of airport facilities . Section 6 . All powers , privileges and duties vested in or imposed upon said airport authority pursuant to the provisions of the Colorado Public Airport Authority Law shall be exercised and performed by and through a Board of Commissioners representing the City of Greeley and the County of Weld. Three (3) Commissioners shall be appointed by the City, one (1) but not more than one to be a City Councilman, and three (3) Commissioners shall be appointed by the County, one (1) but not more than one to be a County Com- missioner. A seventh Commissioner shall be appointed jointly by the City and the County, the initial appointment to be made by a method agreeable to both the City and the County. After the initial appointment, when a vacancy occurs in this position, the Airport Board of Commissioners, no later than one month after notice of the vacancy, shall recommend a candidate for the vacancy to the City and the Board of County Commissioners . The City Council and the Board of County Commissioners must act upon the recommendation within one month of receipt and shall appoint the -2- 459 1761157 9- 3 recommended candidate except for good cause. Should the City Council or the Board of County Commissioners reject the candidate recommended, the Airport Board of Commissioners shall recommend another candidate within one month. Vacancies in the other six (6) Commissioner positions shall be filled in the same manner as the original appointments and by the same governmental entity (City or County) , which made the original appointment. July 19, 1978 I hereby certify that pursuant to a notice dated July 5, 1978 duly published July 6, 1978 in the Johnstown Breeze, a public hearing was held to receive public input on the proposed Weld County Municipal Airport Authority. Mr. Gordon Johnson, President of the present Airport Board made a presentation. Testimony and evidence was received from the audience. Assistant County Attorney, Russell Anson, read Weld County' s proposed Ordinance #30 which would authorize and establish the Airport Authority. Final reading of the ordinance is scheduled for July 24, 1978 during the Commissioners regular Board meeting. City Councilman Warren Terry informed the Commissioners that the City passed its ordinance approving the Authority earlier this month. After all testimony was received the meeting was adjourned. All five Commissioners were present for the hearing.
