RE: APPROVE PARTIAL VACATION OF USE BY SPECIAL REVIEW PERMIT#1591 -C &M
RODRIGUEZ SERVICES, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated June 20, 2007, the Board did approve the request of Gib
Smith, for a Site Specific Development Plan and Use by Special Review Permit#1591 for a Use
Permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial or
Industrial Zone Districts (outdoor storage for trucks, trailers, recreational vehicles, boats, and
equipment) in the A (Agricultural) Zone District, on the following described real estate, to-wit:
Part of the E1/2 of the NE1/4 of Section 7,
Township 2 North, Range 66 West of the 6th P.M.,
Weld County, Colorado
WHEREAS, the Board has received a request from the current property owner, C & M
Rodriguez Services, Inc., P.O. Box 677, Fort Lupton, Colorado 80621, to vacate a portion of said
Use by Special Review Permit#1591, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendations of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and, having
been fully informed, deems it advisable to approve said partial vacation, conditional upon the
following:
1. Pursuant to Section 23-2-200.G.5 of the Weld County Code, the applicant
shall submit a revised plat, titled "Partial Vacation of Use by Special Review
Permit#1591", conforming to Section 23-2-260.D of the Weld County Code.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit#1591 be, and hereby is, partially vacated,
with the abovementioned condition, with said plat to be titled and recorded as Partial Vacation of
Use by Special Review Permit#1591.

FROM: Chris Gathman SUBJECT: Minor Amendment (Partial Vacation) of USR-1591
Request: Partial Vacation of USR-1591 on Lot B of Recorded Exemption RE-4105.
Background: USR-1591 (Outdoor Storage for trucks, trailers, recreational vehicles, boats and
equipment) was approved by the Board of County Commissioners on June 20, 2007. At the time
USR-1591 was approved and recorded it covered both Lot A and Lot B of Recorded Exemption
4105. USR12-0019 -A Site Specific Development Plan and Use by Special Review Permit for
Mineral Resource Development Facilities including an Oil and Gas Support and Service Facility
(office & shop building and outside parking, storage and staging area for vehicles and
equipment) was approved by the Board of County Commissioners on Lot B of RE-4105 on July
18, 2012. The applicant has completed the conditions of approval for USR12-0019 and the
USR12-0019 plat is in the process of getting signatures.
The applicant is requesting a partial vacation of USR-1591 so that it will not overlap Lot B of RE-
4105.
Recommendation: Staff recommends the partial vacation of USR-1591 with the following
revisions to the plat:
• The plat title shall be modified to state: "Partial Vacation of Use by Special Review 1591"
• The legal description before the partial vacation and the legal description after the partial
vacation shall be indicated.
• The Planning Commission Certificate shall be removed.

of Recorded Exemption-4015, part of the East % of the Northeast % of Section 7,
Township 2 North, Range 66 West of the 6th Meridian, County of Weld, State of
Colorado. C&M Rodriguez Services is the owner of the above stated parcel and has
applied for a Use by Special Review permit.
