WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners has determined at a public hearing held on the 15th day of November, 1978 in the Chambers of the Board of County Commissioners of Weld County, Colorado, that a certain tract of land is owned by Albert Solis, which land is more particularly described as follows : That portion of the Southeast Quarter of Section 17, Township 5 North, Range 64 West of the 6th Principal Meridian, County of Weld, State of Colorado being rrore particularly described as follows: Beginning at the Southeast corner of said Section 17; thence along the East line of the Southeast Quarter of said Section 17 North 00°12'22" West 1911.01 feet to the TRUE POINT OF BEGINNING; thence continuing along said East line North 00°12'22" West 280.00 feet; thence departing from said East line North 89°57'57" West 250.00 feet; thence South 00°12'22" East 280.00 feet; thence South 89°57'57" East 250.00 feet more or less to the TRUE POINT OF BEGINNING. The above described parcel is subject to all rights- of-way and easements of record. Said parcel contains a gross acreage of 1.61 Acres more or less. WHEREAS, the owner of said tract of land desires to obtain a variance from the minimum lot size requirement so that said applicant may make application to the Board of County Commissioners for a recorded exemption, as set forth in Section 9-4 .A. (6) of the Subdivision Regulations , and WHEREAS, the Board of County Commissioners of Weld County, Colorado, feels that the applicant has shown good cause for granting a lot size variance under Section 9-4.A. (6) of the Weld County Subdivision Regulations. The property on which these requests have been made is described as Pt . SE4 Section 17, T5N, R64W of the 6th P.M. , Weld County, Colorado. This property is located approximately 3/8 of a mile north of the Town of Kersey on the west side of State Highway 37. The pro- perty contains approximately 1.60 acres of Class II irrigated soil. The request is to split the property into parcels of 0. 57 acres and 1. 03 acres . Mr. Solis wishes to sell this property before moving from the area. Both parcels have an existing residence located on them. Based upon the information submitted and the adopted policies in the County, the Department of Planning Services Staff recommends the request be approved for the following reasons : 1. The request conforms with Section 9-2 of the Weld County Subdivision Regulations (Intent Clause of the recorded exemption procedure) , Section 3.3 A. of the Weld County Zoning Resolution (Intent Clause of the Agricultural Zone District) , and the Weld County Comprehensive Plan in that each parcel does have an existing set of improvements . The use will be compatible with surrounding agricultural uses. The request will allow agricultural and related uses to be the predomi- nant land use. There will be no reduction in the amount of land currently being used for agricultural production. 2.
