BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
OCTOBER 29, 2012
The Board of County Commissioners of Weld County, Colorado, met in regular session in full
conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County
Administration Building, Greeley, Colorado, October 29, 2012, at the hour of 9:00 a.m.
lel ROLL CALL: The meeting was called to order by the Chair and on roll call the following
members were present, constituting a quorum of the members thereof:
Commissioner Sean P. Conway, Chair
Commissioner William F. Garcia, Pro-Tem
Commissioner Barbara Kirkmeyer
Commissioner David E. Long
Commissioner Douglas Rademacher
Also present:
County Attorney, Bruce T. Barker
Acting Clerk to the Board, Debbie Heffel/Esther Gesick
Director of Finance and Administration, Monica Mika
El MINUTES: Commissioner Long moved to approve the minutes of the Board of County
Commissioners meeting of October 24, 2012, as printed. Commissioner Rademacher seconded the
motion, and it carried unanimously.
El AMENDMENTS TO AGENDA: Commissioner Kirkmeyer moved to amend the agenda to add
Code Ordinance #2012-7 as item #4 under Planning, read Code Ordinance #2012-7 by tape, and direct
staff to correct the Consent agenda. Commissioner Rademacher seconded the motion, which carried
unanimously.
READ ORDINANCE BY TAPE: Commissioner Kirkmeyer moved to read Code Ordinances
#2012-7 and #2012-11 by tape. Commissioner Garcia seconded the motion, which carried
unanimously.
e PUBLIC INPUT: No public input was given.
CONSENT AGENDA: Commissioner Kirkmeyer moved to approve the amended Consent
Agenda. Commissioner Rademacher seconded the motion, and it carried unanimously.

BIDS:
e 1) APPROVE BID #B1200139, PEST CONTROL FOR VARIOUS WELD COUNTY BUILDINGS -
DEPARTMENT OF BUILDINGS AND GROUNDS: Monica Mika, Director of Finance and
Administration, provided a brief summary of staff's recommendation. Commissioner Rademacher
moved to approve said bid, as recommended by staff. The motion was seconded by Commissioner
Long, and it carried unanimously.
El 2) PRESENT BID #B1200129, CR 49 AND CR 44 INTERSECTION DESIGN - DEPARTMENT
OF PUBLIC WORKS: Ms. Mika provided a brief summary of said bid, which will be brought back on
November 14, 2012.
e 3) PRESENT BID #B1200131, INMATE MEDICAL SERVICES FOR THE JAIL - SHERIFF'S
OFFICE: Ms. Mika provided a brief summary of said bid, which will be back brought on November 14,
2012.
4) PRESENT BID #B1200135, 3/4 TON 4X4 CREW CAB PICKUP WITH UTILITY BOX-(BI-FUEL
COMPRESSED NATURAL GAS-CNG) TURNKEY - DEPARTMENT OF PUBLIC
WORKS/MAINTENANCE SUPPORT DIVISION: Ms. Mika provided a brief summary of said bid, which
will be brought on November 14, 2012.
e 5) PRESENT BID #61200136, 3/4 TON 4X4 EXTENDED CAB PICKUP-(BI-FUEL
COMPRESSED NATURAL GAS-CNG)-TURNKEY - DEPARTMENT OF PUBLIC WORKS/GRADER
DIVISION: Ms. Mika provided a brief summary of said bid, which will be brought on November 14,
2012.
El 6) PRESENT BID #B1200137, 1/2 TON 4X4 EXTENDED CAB PICKUP-(BI-FUEL
COMPRESSED NATURAL GAS-CNG)-TURNKEY - DEPARTMENT OF PUBLIC WORKS/TRUCKING
DIVISION: Ms. Mika provided a brief summary of said bid, which will be brought on November 14,
2012.
e 7) PRESENT BID #B1200138, LIQUEFIED NATURAL GAS (LNG) TANDEM TRUCK TRACTOR -
DEPARTMENT OF PUBLIC WORKS/PAVEMENT MANAGEMENT DIVISION: Ms. Mika provided a
brief summary of said bid, which will be brought on November 14, 2012.
NEW BUSINESS:
e 1) CONSIDER INTERGOVERNMENTAL AGREEMENT FOR JOINT SCHOOL RESOURCE
OFFICER PROGRAM AND AUTHORIZE CHAIR TO SIGN — TOWN OF MEAD: Deputy Alan Caldwell,
Sheriff's Office, provided a brief summary of said agreement and Barb Connolly, Controller, answered
the Board's questions regarding the payment process. Commissioner Rademacher moved to approve
said intergovernmental agreement and authorize the Chair to sign. The motion was seconded by
Commissioner Garcia, and it carried unanimously.
el 2) CONSIDER REQUEST TO WAIVE BID PROCEDURE CONCERNING SMALL TRACT OIL
AND GAS LEASE, ACCEPT OFFER TO LEASE MINERAL ACRE, AND AUTHORIZE CHAIR TO SIGN
- LONE TREE ENERGY AND ASSOCIATES, LLC: Bruce Barker, County Attorney, provided a brief
summary of said small tract lease. Commissioner Rademacher moved to approve said small tract
lease and authorize the Chair to sign. The motion was seconded by Commissioner Garcia, and it
carried unanimously.

3) FIRST READING OF CODE ORDINANCE #2012-11, IN THE MATTER OF REPEALING AND
RE-ENACTING, WITH AMENDMENTS, CHAPTER 3 HUMAN RESOURCES, OF THE WELD
COUNTY CODE: Patti Russell, Director of Human Resources, provided a brief summary of the
proposed Code revisions. No public testimony was offered concerning this matter. Commissioner
Kirkmeyer moved to approve Code Ordinance #2012-11 on first reading. The motion was seconded by
Commissioner Long, and it carried unanimously.
PLANNING:
IR 1) CONSIDER IMPROVEMENTS AGREEMENT, FOR USE BY SPECIAL REVIEW PERMIT,
USR11-0026, AND AUTHORIZE CHAIR TO SIGN - NOBLE ENERGY, INC.: Rich Hastings,
Department of Public Works, provided a brief summary of said agreement. Commissioner Kirkmeyer
moved to approve said improvements agreement and authorize the Chair to sign, with instruction to
delete any reference to "waiver of collateral" within the resolution and agreement. The motion was
seconded by Commissioner Rademacher, and it carried unanimously.
El 2) CONSIDER IMPROVEMENTS AGREEMENT ACCORDING TO POLICY REGARDING
COLLATERAL FOR IMPROVEMENTS, AUTHORIZE CHAIR TO SIGN, AND ACCEPT COLLATERAL
FOR USE BY SPECIAL REVIEW PERMIT #1795- FM CONSTRUCTION, INC.: Mr. Hastings provided
a brief summary of said agreement. Commissioner Rademacher moved to approve said agreement
and authorize the Chair to sign. The motion was seconded by Commissioner Kirkmeyer, and it carried
unanimously.
CI 3) CONSIDER IMPROVEMENTS AGREEMENT ACCORDING TO POLICY REGARDING
COLLATERAL FOR IMPROVEMENTS, AUTHORIZE CHAIR TO SIGN, AND ACCEPT COLLATERAL
FOR USE BY SPECIAL REVIEW PERMIT, USR12-0019 - C AND M RODRIGUEZ SERVICES, INC.:
Mr. Hastings provided a brief summary of said agreement. Commissioner Garcia moved to approve
said agreement and authorize the Chair to sign. The motion was seconded by Commissioner
Kirkmeyer, and it carried unanimously.

e 4) FIRST READING OF CODE ORDINANCE #2012-7, IN THE MATTER OF REPEALING AND
RE-ENACTING, WITH AMENDMENTS, CHAPTER 29 BUILDING REGULATIONS OF THE WELD
COUNTY CODE: Wendell Heyen, Building Official, reviewed the proposed Code revisions and
answered questions from the Board. No public testimony was provided. Commissioner Garcia moved
to approve Code Ordinance #2012-7 on first reading. The motion was seconded by Commissioner
Rademacher, and it carried unanimously.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
Consent Agenda. Code Ordinances #2012-7 and #2012-11 were approved on first reading.

Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Acting Clerk to the Board.
There being no further business, this meeting was adjourned at 9:40 a.m.
