HomeMy WebLinkAbout780454.tiff RESOLUTION RE: APPROVAL OF CONDITIONAL USE PERMIT NO. 36: 78 : 5 FOR A CHAPEL FOR THE BERTHOUD BRANCH OF THE CHURCH OF JESUS CHRIST OF LATTER DAY SAINTS ON A TRACT OF LAND LOCATED IN PART OF THE NORTHEAST QUARTER OF THE NORTHEAST QUARTER OF SECTION 19, TOWNSHIP 4 NORTH, RANGE 68 WEST OF THE 6TH P.M. , WELD COUNTY, COLORADO. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a public hearing on the 11th day of October, 1978 at the hour of 9 : 00 o' clock a.m. for the purpose of hearing the application of Robert D. Gruman for the granting of a Conditional Use Permit for a chapel for the Berthoud Branch of the Church of Jesus Christ of Latter Day Saints on the following described real estate, to-wit: Commencing at the Northeast corner of Section 19, 7bnwship 4 North, Range 68 West of the Sixth Principal Meridian; thence South along the East line of said Section 208.50 feet, more or less; thence West 208.50 feet, irore or less; thence North to the North line of said Section; thence Fast along said North line to the Point of Begin- ning, Weld County, Colorado, EXCEPT that part deeded to the State Department of Highways in Dccd recorded in Book 1611 at Page 550. WHEREAS, the petitioner was present, and WHEREAS, evidence was presented in support of the grant of the Conditional Use Permit for a chapel for the Berthoud Branch of the Church of Jesus Christ of Latter Day Saints, and WHEREAS, Section 3. 3.D. of the Weld County Zoning Resolution authorizes such a use in an Agricultural District on the grant of a Conditional Use Permit by the Board of County Commissioners, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, heard all the testimony and statements of those present, has studied the request of the petitioner and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed and satisfied that the request for a Conditional Use Permit for a Ntc xC '„ 780454 �rLI1gc chapel for the Berthoud Branch of the Church of Jesus Christ of Latter Day Saints on the hereinabove described real estate, com- plies with all of the conditions as set out in Section 3 . 3.D. (2) of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the application of Robert D. Gruman for a Conditional Use Permit for a chapel for the Berthoud Branch of the Church of Jesus Christ of Latter Day Saints on the hereinabove described tract of land be, and hereby is, granted, subject to the development standards contained in the Conditional Use Permit. BE IT FURTHER RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the reasons for approval contained in the Planning Commission Recommendations dated October 3, 1978 be, and hereby are, incorporated as the findings of fact of the Board of County Commissioners in this matter. The permitted uses on the hereon described property shall be the church and all other uses permitted by righ in Section 3 . 3B of the Weld County Zoning Resolution. 2 . The Conditional Use Permit area shall be maintained in such a manner so as to prevent soil erosion , fugitive dust , and the growth of noxious weeds . 3. All parking shall be provided on-site . 4. All facilities shall comply with all County and State Health Standards and Regulations pertaining to air quality , water quality, noise emission , and sanitary disposal systems . 5. All accesses shall have the approval of the Weld County Engineering Department . All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department . 6. No permanent structures shall be permitted in the 22 foot right-of-way reservation or dedication along the south side of Colorado Highway 56. 7. Trees shall not be planted in the northeast corner of the Conditional Use Permit area as to impair sight vision . S. The Conditional Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of another Conditional Use Permit before such changes shall be permitted. Mr. Rech . again briefly explained that the request is , for the addition of six more tanks and a gel water pit for the benefit of the members of the Planning Commission . There being no questions or comments at this time, Chuck Cunliffe read the staff 's comments . The Planning staff was unable toy-each a recommendation regarding this application . Some discussion fo lowed regarding sealing of the gel water. Mr.. Hiatt expressed concern with the feasibility of property line. monitoring wells being placed there now for water quality and results froth the tests . John Hall of the Weld County Health Department responded by stating that tests have been conducted on local domestic wells in the area and have' fairly good data on them. . These tests were taken at the request of the County Commissioners . These wells win, most likely be monitored on a six month to a year basis for current data. M . Kiefer questioned what would he the effect of adjacent' property on the - surface, Mr. Rech responded that all that exists there now is weeds and sage brush. Discussion followed regarding the possible damage Which could be caused by the gel water pits . Adolph Anderson, adjacent property owner, said he was concerned with the proposal not being bonded in case something did happen. Berg stated that this proposal is part of a number of stations that are being installed that are associated with constructing a 15 megawatt power plant near Wheatland, Wyoming. RECOMMENDATION October 3, 1978 "The Planning Commission and Board of County Commissioners shall consider the following in making their determination in approving or denying a Conditional Use Permit : Compatibility with the surrounding area, harmony with the character of the neighborhood and existing agricultural uses , need for the proposed use, its effect upon the immediate area, its effect on future development of the area and the health, safety and welfare of the inhabitants of the area and the County. " This determination is based upon the following: A. The proposed Development Standards for the Conditional Use Permit will provide for the adequate protection of the health, safety and welfare of the inhabitants of the area and the county. B. The Weld County Health Department has no objections to this request provided the applicant complies with the stipulation as outlined in the Health Department ' s letter dated August 29, 1978. C. The Berthoud Planning Commission has set forth no objections to this request. At the time this request was reviewed by the Berthoud Planning Commission , a quorum was not present , however, nothing additional has been received by our office. The three members present each indicated that the proposal is a good and proper use of the property in their opinion. D. The applicant has submitted a petition form with four signatures representing at least two of the six surrounding property owners who are in favor of this request . The Planning Commission recommendation for approval is conditional upon the following: 1. The Conditional Use Permit plan being amended to : a. As of now it has 2 outhouses with no holes under them which are very smelly. We feel the parking space is very inadequate also as we read in The Berthoud Bulletin they have 140 members. One acre of ground with road frontage on 2 sides and a large building does not leave much space to park. They have left a 207s square piece of ground.
