SUBJECT: USR12-0032, Virtus Banowetz
A Use by Special Review permit for an event center for groups up to 100 people.
The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process.
COMMENTS:
CR 50 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60-
foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the
Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way.
CR 49 is an arterial road, which requires a 140-foot right-of-way at full build out. There is presently a 60-
foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the
Weld County Zoning (23-1-90),the required setback is measured from the future right-of-way.
The applicant will utilize the two existing accesses to the property. Additional accesses will not be
• granted. Please show and label the accesses on the Plat with the Approved Access Permit Number(will
be provided).
The western access does not meet the required spacing from the intersection which is required for safety.
The business cannot utilize the western access. The applicant has indicated that this access will only be
used for the residence on site and not for the event center. The event center will utilize the eastern
access. Please provide a gate or chain or some other means to prevent guests to the event center from
turning into the first access. If a gate or chain is used please place it far enough back from the roadway
that a vehicle can pull completely off of the County roadway before stopping to open it.
The applicant spoke with Public Works about the stormwater drainage onsite. A water quality area will be
provided Northwest of the Event Center parking areas. Please show and label the water quality area on
the Plat.
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency(FEMA).
REQUIREMENTS:
1. Show and label the accesses on the Plat with the Approved Access Permit Number (will be
provided).
2. Provide a gate or chain or some other means to prevent guests to the event center from turning
into the first access. If a gate or chain is used please place it far enough back from the roadway
that a vehicle can pull completely off of the County roadway before stopping to open it.
3. Show and label the Water Quality Area on the Plat.

• 4. Add the following notes to the plat:
a. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist
on the property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds. All
vegetation, other than grasses, needs to be maintained at a maximum height of 12
inches until the area is completely developed.
b. There shall be no parking or staging of vehicles on the County Roadway.
c. The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent
property damage of the type generally attributed to run-off rate and velocity increases,
diversions, concentration and/or unplanned ponding of storm run-off.
d. Weld County is not responsible for the maintenance of onsite drainage related features.

DATE: JUNE 15,2012
Environmental Health Services has reviewed this proposal to amend USR-1374 for a
bed and breakfast facility and an event center. There is an existing 40' x 120' shop
building that will be converted into an event center for weddings, graduations, family
reunions, anniversary parties, etc. The building will be available to rent 7 days a week,
and gatherings will be kept to around 100 people. Based on future growth of the
business, the applicant will have up to 5 employees. According to the application, no
food will be prepared onsite for the events. Food will be provided by licensed caterers.
Central Weld County Water District provides water service. The applicant submitted
documentation from the District, dated May 1, 2012, indicating that additional water can
be made available to the property.
There is an existing 2 bedroom home on the property that will be remodeled to add a
bedroom and kitchen for a bed and breakfast or rental home. This existing home and
the primary residence (4 bedrooms) are served by a septic system (Permit No. SP-
0000419). According to the septic permit, the system was permitted for a 3 bedroom
residence and was oversized when installed. However, the existing septic system is not
adequate for the combined number of bedrooms for the 2 existing homes on the
property (total of 6 bedrooms). In addition, there will be men's and women's restrooms
provided in the event center. Based on the application, it appears that the applicant is
intending to utilize the existing septic system for the event center also. The septic
system will require to be upgraded for the addition of the bedroom for the bed and
breakfast or rental unit, and for the event center. A septic repair permit will be required
to upgrade the existing septic system and will require an engineer design.
The applicant submitted a dust abatement plan. Parking areas will be covered in asphalt
and gravel to control dust. The dust abatement plan shall be revised to include dust
control measures for the access drives.

• The waste handling plan indicates that a dumpster will be provided and serviced by
Royal Disposal.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a revised dust abatement plan to include dust control
measures for access drives, to the Environmental Health Services, Weld County
Department of Public Health & Environment.
2. The existing individual sewage disposal system (Permit No. SP-0000419) will
require to be upgraded for the addition of a bedroom for the bed and breakfast or
rental unit, and for the proposed event center. The upgraded septic system is
required to be designed by a Colorado Registered Professional Engineer
according to the Weld County Individual Sewage Disposal Regulations.
3. In the event the septic system requires a design capacity of over 2,000 gallons of
sewage per day the applicants shall provide evidence that all requirements of the
Water Quality Control Division (WQCD) of the Colorado Department of Public
Health and Environment (specifically Policies WQSA-6 and WQSA-8 ) have been
• satisfied. Evidence of compliance shall be provided to the Weld County
Department of Public Health and Environment. Alternately, the applicant can
provide evidence from the WQCD that they are not subject to these
requirements.
4. The applicant shall submit evidence of an Underground Injection Control (UIC)
Class V Injection Well permit from the Environmental Protection Agency (EPA)
for any large-capacity septic system (a septic system with the capacity to serve
20 or more persons per day). Alternately, the applicant can provide evidence
from the EPA that they are not subject to the EPA Class V requirements.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed
for final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a
solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,
• C.R.S., as amended.

• 3. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, fugitive particulate emissions, blowing debris, and other
potential nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
6. This facility shall adhere to the maximum permissible noise levels allowed in
the Residential Zone as delineated in Section 14-9-30 of the Weld County
Code.
7. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of the facility, at all times.
8. Any septic system located on the property must comply with all provisions of
the Weld County Code, pertaining to Individual Sewage Disposal Systems.
• 9. The facility shall utilize the existing public water supply (Central Weld County
Water District).
10.If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
11.The applicant shall comply with Colorado Retail Food Establishment Rules and
Regulations governing the regulation of food service establishments.
12.The operation shall comply with all applicable rules and regulations of State
and Federal agencies and the Weld County Code.

We have been working with Mr. Banowetz regarding his site specific development plan and amended use (USR12-0032)
We had concerns regarding additional storm flow drainage into our canal. Mr. Banowetz informed us that he will not be
changing the grading of the land or adding any pavement or anything else that would add additional drainage into our
canal. We would like to request that at anytime Mr. Banoweta changes any grading or adding pavement or ect, we be
contacted to look at any changes.
Mr. Banowetz plans on using our ROW to access a 12x24 house on the property. We have no objections to this as long
as Mr. Banowetz agrees and signs our access agreement. Currently Mr. Banowetz has agreed to do so.
FRICO has no further outstanding comments.
