SUBJECT: USR11-0025, Doug Jergens
The Weld County Public Works Department reviewed the submitted application for critical items, including but
not limited to Site Plan, Traffic Study, Preliminary Drainage Report, Geotechnical Soils Report, and Flood
Hazard Development Permit. A detailed review of these items was not completed at this step in process.
Comments made during this stage of the review process will not be all inclusive; as revised materials are
submitted other concerns or issues may arise. All issues of concern and critical issues during further review
must be resolved with the Public Works Department.
COMMENTS:.
CR 70 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot
right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning (23-1-90), the required setback is measured from the future right-of-way line. Our most recent
average daily traffic count (ADT) for CR 70 reflects 66 vehicles per day taken in 2007.
REQUIREMENTS:
Traffic Study:

udy was not required at this time.
Stormwater Drainage:
The applicant has supplied a water quality capture feature. This has been reviewed and approved by the
Public Works Drainage Engineer.
Flood Hazard Development Standards:
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA). Lone Tree Creek Flows through the proposed mining operation, but it has not
been mapped at this location.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum
height of 12 inches until the area is completely developed.
Show the approved access on the plat and label it with the approved access permit number (AP#). This will be
provided when a revised application form is received.
Off-street parking spaces including the access drive shall be surfaced with gravel, asphalt, concrete or the
equivalent and shall be graded to prevent drainage problems.

Environmental Health Services has reviewed this proposal for a veterinary clinic. There
is an existing barn on the property which will be refurbished to contain the veterinary
clinic. There will be 2 employees plus the 2 owners utilizing the facility.
A restroom will be constructed in the clinic and a new septic system will be installed. As
this is a commercial facility the septic system must be designed by an engineer and
approved by the Board of Health. Floor drains in the treatment and surgery areas can
drain to the septic system in accordance with both State and County regulations.
• Water will be supplied by North Weld County Water District. The District has indicated
there is sufficient capacity to serve the proposed clinic.
There is an existing home on the property that is served by an individual sewage
disposal system (Permit No. SP-0701028) and a tap from North Weld County Water
District.
A waste handling plan was submitted and indicates that Waste Management will be
utilized for trash disposal. The plan should specify how chemical and drug disposal will
be handled. Weld County rendering will remove animal carcasses if necessary.
The dust abatement plan states that water will be used to control dust as needed.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirement be met prior to allowing the plat to be
recorded:
1. The applicant shall submit an updated waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:

• The waste handler and facility where the chemicals and drugs will be
disposed of (including the facility name, address, and phone number).
We recommend that the following requirement be incorporated into the permit as a
condition that must be met prior to the issuance of the Certificate of Occupancy:
1. An individual sewage disposal system is required for the proposed facility and
shall be installed according to the Weld County Individual Sewage Disposal
Regulations. The septic system is required to be designed by a Colorado
Registered Professional Engineer according to the Weld County Individual
Sewage Disposal Regulations.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. Animal and feed wastes, bedding, debris and other organic wastes shall be
disposed of so that vermin infestation, flies, odors, disease hazards, and
nuisances are minimized.
2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater

contamination.
3. No permanent disposal of wastes shall be permitted at this site. This is not meant
to include those wastes specifically excluded from the definition of a solid waste in
the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as
amended.
4. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
5. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.
6. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
7. This facility shall adhere to the maximum permissible noise levels allowed in the
Non-Specified Zone as delineated in Section 14-9-30 of the Weld County Code.

• 8. Adequate drinking, hand washing and toilet facilities shall be provided for
personnel and patrons of the facility at all times.
9. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
10.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes (North Weld County Water District).
11.AIl potentially hazardous chemicals must be handled in a safe manner in
accordance with product labeling and in a manner that minimizes the release of
hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All
chemicals must be stored secure, on an impervious surface, and in accordance
with manufacturer's recommendations.
12.The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

A building permit will be required for any new construction, alteration, or addition to any building on
the property. It is recommended that a code analysis be done on the project by a design professional
with experience in this area.
A building permit application must be completed and two complete sets of plans including engineered
foundation plans bearing the wet stamp of a Colorado registered architect or engineer must be
submitted for review. A geotechnical engineering report performed by a registered State of Colorado
engineer shall be required. Building permits are required for buildings, structures and change of use for
buildings which required permits before the beginning of construction or the proposed change of use.
The structures proposed to have changes uses will require commercial building permit for change of
use. A code analysis, floor plan a complete set of plans for any alteration and probably a structural
analysis by a professional engineer will be required.The existing pole barns have been built as Ag
