RE: APPROVAL OF RECORDED EXEMPTION NO. 350 - WARREN EHRLICH.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held on
the 20th day of November, 1978 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of a certain parcel of land, as shown on the
plat known as Recorded Exemption No. 350, being the property of
Warren Ehrlich, described as the Southeast Quarter (SEa) Section
32 , Township 7 North, Range 67 West of the 6th P.M. , Weld County,
Colorado, being more particularly described as follows :
Considering the south line of the said SEa of the
said Section 32 as bearing N 90°00'00" W and with
all bearings contained herein relative thereto:
Commencing at the SE corner of the said Section 32;
thence, along the said south line, N 90°00'00" W,
110.50 feet to the True Point of Beginning.
Thence, continuing N 90°00'00" W, 2527.44 feet to
the SW corner of the said SEa; thence, along the
west line of the said SEa, N 00°13'55° E, 2737.37
feet to the NW corner of the said SEa; thence, along
the north line of the said SEa, S 89°37'47" E,
2569.14 feet to the westerly right-of-way of High-
way 257; thence, along the said westerly right-of-way
S 00°16'05" W, 123.92 feet; thence, continuing
S 89°43'55" E, 10.00 feet; thence, continuing
S 00°16'05" W, 2516.61 feet; thence, continuing
S 45°00'30" W, 71.00 feet; thence, continuing
S 00°18'00" W, 30.00 feet to the True Point of
Beginning. Said parcel of land contains 161.43
acres including County Road right-of-way on the
south side and is subject to any other right-of-way
or easements nay on record or existing.

"subdivision" and "subdivided land, " pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definition of "subdivision" and "subdivided land" pursuant to its

authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended,
and Section 2-lA(3) of the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove described
parcel of land owned by Warren Ehrlich, be and hereby is, exempt
from the definition of the terms "subdivision" and "subdivided
land" pursuant to its authority under Section 30-28-101 (10) (d) ,
CRS 1973, as amended.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 20th day of
November, A.D. , 1978.

RE : Recorded Exemption #350
Dear Commissioners:
The attached application , plat and related items are in reference to
a request for a recorded exemption from Warren Ehrlich. The parcel
of land under consideration is described as the SE* Section 32, T7N,
R67W of the 6th P. M. , Weld County, Colorado. The property contains
approximately 160 acres of Class II , III and IV irrigated soils. The
request is to split the property into parcels of 5. 00 acres and 156.44
acres. This property is located approximately 2-1/2 miles north of
the Town of Windsor on the west side of Colorado Highway 257.
As indicated in a letter submitted by the Ehrlichs dated October 25,
1978, they wish to build a new residence on the 5. 00 acre parcel sepa-
rating it from their commercial cattle feeding and farming operation.
Upon construction of the new home they plan to move another employee
into the existing house, increasing the efficiency of and the security
for the commercial cattle operation.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends the re-
quest be approved for the following reasons :
1. The request conforms with the Intent Clause of the recorded
exemption procedure (Section 9-2 of the Weld County Subdivision
Regulations) , the Intent Clause of the Agricultural Zone District
(Section 3. 3 A. of the Weld County Zoning Resolution) , and the
Weld County Comprehensive Plan in that the uses will be compati-
ble with surrounding agricultural uses. The request will allow
agriculture and related uses to be the predominant land uses.
This request is encouraging agricultural uses as the highest and
best use of the land.

2. The Town of Windsor Planning Commission has recommended approval
of this request .
3. The Colorado Division of Highways has set forth no objections to
this request .
4. The request complies with the provisions of Section 9-4 A. of the
Weld County Subdivision Regulations.

Gentlemen :
This application is to allow us to seperate the 5 acres
where we intend to build our new home from our commercial
cattle feeding and farming operation. We are now feeding an
average of about 4 , 000 cattle in our lot and all crops
raised are utilized as feed . With an operation of this
size we are applying for the recorded exemption so we may
seperate our residence from the business and operational
financing .
Another equally important reason for the application is
the need for housing for feed lot personnel to allow them
to be on the premises on a 24-hour a day basis . In addition
to our present residence we have one other house on the
property occupied by an employee . Upon construction of our
new home we will move another employee into our existing house ,
increasing effeciency and security .
We are requesting the 5 acres in order to allow us to keep
personal horses and children ' s livestock seperate from the
commercial operation .

COMMENTS :
The proposed Lot A currently has no improvements located on it. It
appears to have been used in the past for growing alfalfa. Proposed
Lot B currently contains all the existing improvements which includes
residences, outbuildings, and a commercial cattle feed lot. There is
currently no existing access to proposed Lot A. Accesses do exist to
proposed Lot B. The property is presently surrounded by predominantly
agricultural uses.
