HomeMy WebLinkAbout760346.tiff ./"\ RESOLUTION WHEREAS, a need has been recognized for defense access roads to serve the Warren Air Force Base Minuteman Missile Sites in Weld County, Colorado, and WHEREAS, Weld County is willing to cooperate in the interests of National Defense by performing the extraordinary maintenance and snow removal work specified under conditions that will result in neither a profit nor a loss to Weld County, and WHEREAS, an adequate and satisfactory agreement has been made providing for continuing maintenance and snow removal on the hereinabove mentioned access roads, and WHEREAS, the Board of County Commissioners believes it to be in the best interests of the county to enter into said agreement, marked Exhibit A, attached hereto and made a part hereof by reference, and WHEREAS, the Board of County Commissioners, furthermore, believes it to be in the best interests of the county to approve the list of Weld County personnel authorized to receive requests for extraordinary maintenance and snow removal, marked Exhibit B, attached hereto and made a part hereof by reference. NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners, Weld County, Colorado, hereby approves the agreement, marked Exhibit A, and authorizes execution on same; that the list of authorized personnel, marked Exhibit B, is hereby approved. As used herein, unless the context indicates otherwise; a. The term "Defense Access Roads" means those public lic highways shown on the attached map that are located in Wu . These designated roads as shown on the attached map are described as follows: 2 Access road numbers 1 through 10, 12 through 23, and 27 and 28, located between R56W to R6OW and T7N to T12N at the Nebraska State line. b. The terms and conditions describing this work are as follows: (1) Extraordinary maintenance is that work performed by Weld County when notified by an appropriate Air Force official as listed in the appendix to this agreement, of conditions that require attention in order that access to the sites shall remain unimpeded. Weld County will be expected to complete the requested work within a matter of three (3) days from the time of notification by the Air Force. It is anticipated that Weld County's normal maintenance of these public roads, including an annual blading, keeping culverts open, and so on, should provide adequate access for the Air Force needs except in unusual circumstances such as flooding or excessive frost actions. (2) Extraordinary snow removal means that Weld County, upon notification of appropriate agents of the United States Air Force, shall react within two (2) hours to commence the placing of snow removal equipment in a condition to remove snow from these hereinbefore designated access roads, and shall then endeavor to the best of its ability to remove snow and snowdrifts as rapidly as possible from those access roads to control centers and launch sites designated by the Air Force. Within a period of twenty-four (24) hours from the time of the notification, denial of access to launch control centers and to inopera- tive launching sites will become operationally unaccept- able to the National Defense. The clearing of snow and snowdrifts from access roads to other launch facilities will then be undertaken on the priority given by Air Force agents at the time the County was notified. It is agreed that after any snowstorm Weld County will undertake normal snowplowing operations on these access roads if no notification is given by the Air Force that an extraordinary snow removal effort is required. (3) Weld County agrees to perform the extraordinary mainten- ance and snow removal as herein described on the defense access roads designated in this agreement, when notified by an authorized agent representing Warren Air Force Base, Cheyenne, Wyoming, as listed in the appendix to this agreement. Authorized personnel to be contacted in 3 Weld County for the extraordinary work are also listed in the appendix to this agreement. These listings may be revised at any time by either the Air Force or the County if written notice is sent to the other party and to FHWA. (4) Weld County will be reimbursed by FHWA with funds provided by the United States Air Force for actual costs of oper- ators, labor, equipment, and materials incurred in the performance of extraordinary maintenance and snow removal on the defense access roads designated in this agreement, when performed in accordance with the terms stated herein. "Actual costs" means the costs incurred by the County for: (a) The costs of operators and labor to include wages for both straight time and overtime, and for fringe benefits normally paid, such as contributions to the retirement system, insurance programs, and annual and sick leave benefits; (b) The invoice costs of any materials incorporated into the maintenance and snow removal task; (c) An hourly rental cost of equipment used in the work based on rates not to exceed those established in the latest edition of the "Construction Equipment Rental Rate Manual" published by the Department of Highways, State of Colorado. In accordance with procedures on page II of the May 1, 1971, edition of the manual for all publicly-owned equipment, the applicable hourly rate will consist of the service rate plus seventy-five percent (75%) of the listed bare rate. (5) Weld County shall submit a semiannual certified statement of the actual costs incurred in performing extraordinary maintenance and snow removal operations on these defense access roads. Documentation of actual costs shall be recorded and maintained by Weld County and are to be retained and made available for inspection and audit by FHWA until such time as the county is notified in writing that such records are no longer required. Documentation of equipment used should include its rated size in the same units as given in the Construction Equipment Rental Rate Manual. No additional reimbursement will be made for attachments to the prime piece of equipment. 4 (6) This agreement shall be subject to renegotiation or termination annually at the end of each fiscal year (September 30) , upon the request of any of the parties hereto. The agreement shall immediately terminate upon notification to all parties concerned that Federal fns are no longer available. This agreement shall expire on September 30, 1981, without the request of either party. An extension of the maintenance activities beyond that time will require a new executed agreement. (7) It is further agreed that, with respect to any Federal activities and Federal property within the affected area, nothing contained herein shall be construed as holding Weld County liable for any personal damage or personal liability injury to any person or thing while removing snow or snowdrifts from the hereinbefore described defense access roads. (8) It is further agreed that, except for any willful breach of this agreement by Weld County, FHWA shall hold harmless Weld County from any and all claims by its agents, contractors, or subcontractors, or any persons by FHWA, employed or under agreement with said FHWA, by reason of any failure of Weld County to fulfill this agreement. IN WITNESS WHEREOF, the parties hereto have executed this agreement effective as of June 30, 1976. Warren Air Force Base, Wyoming 82001 gy�— Attention: DEL Subject: Certification of Transporter Erector (TE) Route Bridges Dear Mr. Wright, We have your September 9, 1974 request for assurance that the TE vehicle can safely negotiate all stream crossing and overpasses on the missile route roads. As you are probably aware, the design and construction supervision of these roads was done by the Colorado Division of Highways in cooperation with the Federal Highway Administration. This work was done under our Project Num- ber R-AD 36(1) and R-OM 36(2) in 19.63-64 and 1970 respectively. The mainten- ance of these facilities, to our knowledge, has been done by the Weld and Logan Counties and the responsibility of the Federal Highway Administration. Therefore, we have had no occasion to conduct the periodic examination Of these structures as is ordinarily done on the State Highway System and have no continuing re- cords or data to indicate their condition. Therefore, in order to satisfy your request it would be necessary for us to make a complete route inspection. This would require considerable time and expense for which we have no alotted or budgeted funds. In order to provide some assistance we have examined the three major structures on the system. By our definition, these are structures over twenty feet total length. Their designated number, location and description is as follows: Structure Number B-21-E, located at mile 2.4 on Road 12 crossing South Pawnee Creek, Timber Bridge approximately 75 feet in length. Sturcture Number B-22-A, located at mile 3.3 on Road 31, crossing Cottonwood Creek, a three-.span concrete slab and Girder Bridge approximately 70 feet in length. • Louis D. Wright October 8, 1974 Page Two Structure Number A-25-AP, located at mile 1.7 on Road 40, a double 10' X 6' Concrete Box Culvert. Each of these structures are in good condition and are adequate to meet the criteria for which each was orginally designed or analyzed when the road system was developed. We would be agreeable to examine the remaining minor drainage struc- tures on the system at such time that some arrangement is made to cover the expense of making the inspections. This letter is necessary to insure that all individuals and agencies involved fully understand Air Force policy rel;arding digging, earth moving and construction activities on the Minute- man Missile Cable right-of-way. 2. The Minuteman Missile System covers a wide area in the states of Wyoming, Colorado and Nebraska. Over 2,000 miles of communi- cation cable link this system together, which is a very important part of the defense of our country. Consequently, I feel you are as interested as I am in protecting this vital cable network. 3. I wish to take this opportunity to emphasize the importance of following the procedures outlined below, since any interference with the missile cable may affect the launch capability of the missiles and thereby reduce our national defense capability. Any intentional interference with the missile cable is a Federal offense and any negligent damage of the cable could result in billing the persons responsible for damages that may occur. Lt. Under our present contract with the landowners, easement rights extend over a 164 foot strip of land comprising the cable right- of-way. The cable path is clearly marked at all road crossings) trails, cattle crossings, etc., by marker poles with two orange bands around the top of each pole. In addition, a pole is placed approximately every three hundred feet along the right-of-way. The cable is normally buried only three feet deep and can be easily damaged. While ordinary cultivating, harvesting and road grading will not affect the cable, activities such as terracing, ditching, leveling, lowering road surfaces or ditches, etc., may either cut it or remove the required minimum earth cover from it. 5. In the event you have future plans for any type of construction or earth moving operations within the cable right-of-way, you are re- quested to give notice in writing at least 120 days prior to com- mencing such construction as agreed in the original grant of ease- FATE OF COLORADO s5. This letter is necessary to insure tit all individuals and agencies involved fully understand Air Force policy regarding digging, earth moving and construction activities on the 1`.inute- man Missile Cable right-of-way. 2. The Minuteman Missile System covers ^ wide area in the states of Wyoming, Colorado and Nebraska. Ovei 2,000 miles of communi- cation cable link this system together, 'hich is a very important part of the defense of our country. Con equently, I feel you are as interested as I am in protecting this vital cable network. 3. I wish to take this opportunity to e:^phasize the importance of following the procedures outlined below, .since any interference with the missile cable may affect the la6ch capability of the missiles and thereby reduce our nationalidefense capability. Any intentional interference with the missil4 cable is a Federal offense and any negligent damage of the cable cof:ld result in billing the persons responsible for damages that mayoccur. L. Under our present contract with the tlandowners, easement rights extend over a 162 foot strip of land co4iprising the cable right- of-way. The cable path is clearly marked at all road crossings, trails, cattle crossings, etc., by mark4r poles with two orange bands around the top of each pole. In a'1dition, a pole is placed approximately every three hundred feet along 'the ri_,ht-of-way. The cable is. normally buried only three feet deep and can be easily damaged. While ordinary cultivating, harvesting and road grading bill not affect the cable, activities such as terracing,- ditching, leveling, lowering, ro^d surfaces or ditches, etc., may either cut it or remove the required minimum earth cover from it. 5. In the event you have future plans for any type of construction or earth moving, operations within the cable right-of-way, you are re- quested to give notice in writing at least 120 days prior to com- mencing such construction as agreed in the original grant of ease- • n • /j 3, /31,s-3 •G, oc)rn r/ Peace . . . in in iir Pretension ment contract with the l-ndowners. Notice should be sent to : 90th Communications Squadron, Attention: Cable Affairs, Francis E. Warren AFB, Wyoming 82001. In addition, a minimum of at least seventy-two (72) hours notice should reach this office, in -writing or by calling 775-2700, prior to any actual on-site work. This notice will provide adequate time for the Air Force to schedule cable personnel to observe the operation. 6.
