(A& W) on land owned by and leased from Mr. Everitt, Parcel #029110000004, proposes to create a"Water Loading Dock"on a portion of the foregoing parcel. Up to 10-20,000 gallon water tanks and appropriate manifolding, served by permitted Industrial Well #12873-FP would utilize the Site. Trucked water will be provided to oil/gas • operations in the area. Additional water sources might be secured in the future. A total of 70 round trip truck tanker loads (85,000# GVW -maximum) per day would occur under the most optimistic of water yield scenarios. Approximately 2.71± acres of the total 1/4 section would be impacted. No employees will be stationed on the Site. Employees will be truck drivers and occasionally a supervisor. Hours of operation will be 24 hours/day, 365 days/year, usually during daylight hours. No septic nor potable water will be required. No paved surfaces nor buildings are proposed. No landscaping nor screening is proposed as the location is within an irrigated, tilled field. All adjacent uses are agricultural and/or owned by the Owner and/or Owner's family. No new grading will occur on the essentially flat Site. An existing gravel access road from WCR 118 and a gravel loading area will be utilized. Adjacent land uses are agricultural in all directions with oil/gas production operations thereon. • The 2.71± acre Site will be separated from the 158± acre total parcel via a Subdivision • Exemption (SE)process, as suggested by Weld County Planning staff. A & W Water Service, Inc. and Mr. Everitt will enter into a lease for the use of the SE Parcel. Appropriate notification will advise the County of any future changes in leasee(s) over the course of the SE/USR. No. 2: Consistency with Weld County Comprehensive Plan A. Section 23-2-220.A.1 —The proposed Use is consistent with Chapter 22 and other applicable code provisions or ordinances in effect. Section 22-2-20.C. A.Goal 3. states: "County land use regulations recognize and respect the rights afforded by the State Constitution and associated statutes of individually decreed water rights. Water rights are considered real property and should be protected as any other private property right." The State Engineer, Division of Water Resources has permitted one (1)well for industrial use via truck hauling on a tract of land 158± acres in area owned by Kenneth H. Everitt. Conversion of other water wells to industrial use may occur in the future. Section 22-2-20.C A. Policy 3.3 states: "Land use regulations should consider the traditional and future operational viability of water-delivery infrastructure when applications for proposed land use changes are considered." The proposed facility will utilize ground water from 1 well (12873-FP) permitted through the Division • of Water Resources for industrial use via truck hauling. Section 22-2-20.G. A. Goal 7. states "County land use regulations should protect the individual property owner's right to request a land use change." Section 22-2-20.G 1.A Policy 7.1. states"County land use regulations should support commercial and industrial uses that are directly related to, or dependent upon, agriculture, to locate within the agricultural areas, when the impact to surrounding properties is minimal, or can be mitigated, and where adequate services are currently available or reasonably obtainable." The proposed water loading dock will support oil and gas companies within a fifty(50)mile radius by supplying water for their oil and gas drilling operations and industrial uses. Section 22-2-20.G. 2.A Policy 7.2. states "Conversion of agricultural land to nonurban residential, commercial and industrial uses should be accommodated when the subject Site is in an area that can support development and should attempt to be compatible with the region." The Site is 3± miles southeast of the Town of Grover and is bordered by County Road 118. The facility will be located on a 2.71± acre Subdivision Exemption parcel. Ground water from the well(s) will be pumped to the loading dock. Section 22-2-80.D AGoal 4. Of the Weld County Code states: "All new industrial • development should pay its own way." Mr. Everitt will be paying for all on-site • and off-site improvements associated with this Use as required through an Improvements Agreement. Section 22-4-30.A WA.Goal.1. states "Support the development of water that is put to beneficial use, along with associated infrastructure." The proposed loading dock will provide a valuable and indispensable service to oil and gas companies. The location for the load-out minimizes the removal of agricultural land from production. Section 22-4-30.A.1. WA Policy 1.1 "Acknowledge a water right as real property that is held by the individual or entity that has developed or maintained the water decree." The State Engineer, Division of Water Resources has permitted one (1) well for industrial use via truck hauling. Section 22-4-30.A WA Goal 2. States "Strive to maintain and protect water supply storage facilities, conveyances and infrastructure adequate to sustain continued water use" The allocation of groundwater and installing a loading dock is an appropriate use in an agricultural area. In fact, the proposed use would ultimately reduce the impacts of oil and gas operations in the area because utilizing local groundwater for production would generate less noise, dust, traffic and waste. • Section 22-6-20.C.1 ECON Policy 3.1. "County activities and regulation should protect the rights of private property owners and the public healthy, safety and welfare, recognizing that these basic rights and protections allow the free market to prosper and grow the local economy." B. Section 23-2-220.A.2—The proposed Use is consistent with the intent of the A (Agricultural) Zone District. Section 23-3-40.A.2 of the Weld County Code provides for Oil and Gas Support and Service as a Use by Special Review in the A (Agricultural) Zone District. C. Section 23-2-220.A.3 The Uses which will be permitted will be compatible with the existing surrounding land uses. The facility is located in a rural agricultural area on a parcel containing no improvements. Adjacent properties are utilized for grazing and similar farming/ranching operations. Oil and gas facilities are existing encumbrances on adjacent properties. There is one residence southeast of the SE/USR and the Town of Grover is some 3± miles to the northwest. Development Standards and Conditions of Approval will ensure that this Use will be compatible with surrounding land uses. D. Section 23-3-220.A.4 The Uses which will be permitted will be compatible with future development of the surrounding area as permitted by the existing zoning and with the future development as projected by Chapter 22 of the Weld • County Code and any other applicable code provisions or ordinances in effect, or • the adopted Master Plans of affected municipalities. The Site is located within the 3-mile referral for the Town of Grover. E. Section 23-2-220.A.5 —The application complies with Section 23-5 of the Weld County Code. The existing Site is not within a recognized overlay district, including the Geologic Hazard, Flood Hazard or Airport Overlay District. The existing Site is within the County Road Impact Fee Area and the Capital Expansion Impact Fee area. Effective April 25, 2011, Building Permits issued on the proposed lots will be required to adhere to the fee structure of the Weld County Road Impact Program (Ordinance 2011-2). Section 23-2-220.A.6—Mr. Everitt is demonstrating a diligent effort to conserve prime agricultural land in the locational decision for the proposed Use. No. 3: Consistency with Weld County Zoning Ordinances • The Applicants' USE is consistent with the intent of the Weld County Zoning Ordinance for a Commercial USE in the Agricultural(A) Zone District under the provisions of Section 23-3-40, Uses by Special Review. No. 4: SurroundingUSES The parcel abuts CR-118 and is located approximately 3± miles southeast of the Town of Grover. Farm/ranch/grazing operations are to the north, west, east and south with a rural residence to the southwest. Gas wells abound throughout the area. No. 5: Ouestionnaire Response a. Everitt And A & W Water Service,Inc. 45571 WCR 118 Grover, CO 80729 Water Loading Dock Water truck tankers (85,000# GVW) would service the Water Loading Dock from graveled CR- 118. An occasional supervisor with pickup will inspect the operations. Traffic will comply with Weld County's Oil & Gas Haul Route Map dated April, 2011, as may be revised. Traffic will enter the Site on an existing gravel access, commence north/northwesterly at minimal (10 mph) speed, circle the Water Loading Dock,thence egress to CR-118 via the entry access. • An Access Permit Application Form is hereby tendered for the entry/egress point. Traffic to and from the USR Site is dependent upon actual water well yield. Initial projections based on the existing industrial well and potential conversion of an existing irrigation well to industrial production suggested some 20±round-trip trucking events per day, spread over a 24- hour period. These levels were discussed in the Pre-Application Review of July 22, 2011 and at that time Ms. Heidi Hansen of Public Works indicated a Traffic Study would be waived. That said, future additional off-site water sources could provide additional water availability and an attendant increase in truck trips. Both the Applicant, Mr. Kenneth Everitt, and Weld County are desirous of realistic traffic projections. Minimal existing traffic occurs on CR-118 and its intersections with CR-95 and with CR-390. A May, 2011 Traffic Impact Study by Fox Higgins Transportation Group on behalf of Dietzler Water Resources Corporation as a part of the USR-1787, indicates existing Levels of Service (LOS) 'A' on CR-118, at the CR-118/CR-95 intersection and at the CR- 118/CR-390 intersection. LOS remains at 'A' in the near term (2013) and even in 2035. The Applicant would like to forego a Traffic Study if at all possible given its cost, the fact good traffic data is available from the Dietzler/USR-1787 Proceeding and that traffic events over and above the originally projected 40 trips per day(20 round trips) are highly speculative due to unknown future water production yield. • • Recent analyses suggest a maximum of 70 round trips assuming optimistic water yield levels and a resultant maximum of 6 vehicles per hour (vph). Most traffic (90%±) is projected to enter and exit the USR Site on CR-118 and travel from and to CR-390. Traffic levels are therefore projected at no more than 70 round trips per day and waiver of a Traffic Study is respectfully requested. • • • Waste Handling Plan USR - Kenneth H.
