Gathman Case Number: USR12-0013 Hearing Date: June 5, 2012 Applicant: Petroleum Development Corporation CIO Mac Neumann Address: 1775 Sherman Street, Suite 3000, Denver, CO 80203 Request: A Site Specific Development Plan and Use by Special Review Permit for a 150-foot Telecommunication Antenna Tower in the A (Agricultural) Zone District Legal Description: Part of the S2 of Section 25, T4N, R65W of the 6th P.M., Weld County, Colorado • Location: Approximately 600-feet north of County Road 40 and approximately 1/2 mile west of County Road 49. Parcel Size: +/- 212.78 acres - (Telecommunication Antenna Tower to be located on 60-foot x 60-foot leased parcel) Parcel Number: 105525000007 Case Summary: This request is to extend the height of a telecommunication tower originally approved from 60-feet to 150-feet in height. THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE APPROVED FOR THE FOLLOWING REASONS: 1. The submitted materials are in compliance with the application requirements of Section 23-2-260 of the Weld County Code. 2. It is the opinion of the Department of Planning Services' staff that the applicant has shown compliance with Section 23-2-220 of the Weld County Code as follows: a. Section 23-2-220.A.1 --The proposed use is consistent with Chapter 22 and any other applicable code provisions or ordinance in effect. Section 22-2-20.1 A.Goal 9. States: "Reduce potential conflicts between varying • land uses in the conversion of traditional agricultural lands to other land uses." USR12-0013-PDC Telecommunication Tower Page 3 Petroleum Development Corporation has indicated that they are proposing to build/extend a new tower versus co-locate on an existing tower to limit interference from other users on existing towers and to provide for the option to install additional antenna and associated equipment which may not be possible in a collocation situation. b. Section 23-2-220.A.2 --The proposed use is consistent with the intent of the A (Agricultural) Zone District. Section 23-3-40.L allows for Telecommunication Antenna Towers as a Use by Special Review in the A (Agricultural) Zone District. c. Section 23-2-220.A.3 -- The uses which will be permitted will be compatible with the existing surrounding land uses. The surrounding area is agricultural in character. The parcel that the telecommunication tower is proposed is vacant with the exception of existing oil and gas improvements (wellheads and tank batteries). An existing single-family residence is located approximately 500 feet to the southwest of the tower site. The tower will be located to the northeast of the existing single family residence and will not interfere with any views of the mountains to the west. There are existing communication towers (approved under USR-854) located to the east of the site (across County Road 49). The applicant's engineers have indicated that the towers are light-duty guyed towers and would likely not be able to support the microwaves and SCADA equipment used by PDC. Additionally, Petroleum Development Corporation has indicated that they are proposing to build a new tower versus co-locate on an existing tower to limit interference from other users on existing towers and to provide for • the option to install additional antenna and associated equipment which may not be possible in a collocation situation. d. Section 23-2-220.A.4 --The uses which will be permitted will be compatible with future development of the surrounding area as permitted by the existing zoning and with the future development as projected by Chapter 22 of the Weld County Code and any other applicable code provisions or ordinances in effect, or the adopted Master Plans of affected municipalities. The proposed USR site is not located within the 3-mile referral area of a municipality. e. Section 23-2-220.A.5 -- The site does not lie within any Overlay Districts. Effective April 25, 2011, Building Permits issued on the proposed lots will be required to adhere to the fee structure of the Weld County Road Impact Program. (Ordinance 2011-2) Effective April 25, 2011, Building Permits issued on the proposed lots, will be required to adhere to the fee structure of the County Facility Fee and Drainage Impact Fee. (Ordinance 2011-2) f. Section 23-2-220.46-- The applicant has demonstrated a diligent effort to conserve prime agricultural land in the locational decision for the proposed use. The proposed site is designated as "other land" per the 1979 Soil Conservation Service Important Farmlands of Weld County Map. • USR12-0013-PDC Telecommunication Tower Page 4 • g. Section 23-2-220.A.7 --The Design Standards (Section 23-2-240, Weld County Code), Operation Standards (Section 23-2-250, Weld County Code), Conditions of Approval and Development Standards ensure that there are adequate provisions for the protection of health, safety, and welfare of the inhabitants of the neighborhood and County.
