RESOLUTION
RE: ACCEPTANCE OF NEW LEASE RATE FOR PROPERTY IN AULT, COLORADO
USED BY WELD COUNTY FOR ROAD EQUIPMENT MAINTENANCE SHOPS.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, Weld County utilizes property in Ault, Colorado for
road equipment maintenance shops, said property owned by Union
Pacific Railroad Company, and
WHEREAS, effective December 1, 1978, the rental for said
property will be increased to $80. 00 per annum for the next five-
year period, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado deems it in the best interests of Weld County to accept
the increased lease rate for said property.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado that the increased lease
rate of $80. 00 per annum for property owned by Union Pacific
Railroad Company and used by Weld County for road equipment
maintenance shops in Ault, Colorado, be, and hereby is, accepted.
The above and foregoing Resol.ption was, on motion duly made
and seconded, adopted by the 'following vote on the 9th day of
August, A.D. , 1978.

Gentlemen:
Reference is made to that certain lease dated February
15, 1974 between Union Pacific Railroad Company and County
of Weld, State of Colorado covering a portion of the Railroad
Company's property at Ault, Colorado to be used as a site for
road equipment maintenance shops. Said lease is identified
in the Railroad Company' s records as OMA-2027.
Section 2 of this lease covers rental, taxes and
assessments and provides for reevaluation of rental at the
end of each five-year period from the effective date of the
lease. In accordance with this provision, we recently reviewed
the present day land values in Ault, Colorado and, in particular ,
in the general vicinity of the lease site.
The results of this study indicate that the present
rental no longer represents a fair annual market rental. Taking
all matters into consideration and applying present day real
estate values of the area, I am of the opinion that a rental
of $80.00 per annum would reflect a fair annual market rental
at this time.
In accordance with the provision of Section 2 of
the lease, this letter is to advise you that effective as of ,
December 1, 1978 the rental for the next five-year period will
be $80.00 per annum in lieu of the present rental of $52.00
per annum.

receipt of this letter indicating your acceptance of the increase
in rental and return the copy marked "UPRRCo. 's Counterpart"
for filing with the Railroad Company's copy of the lease.
The original copy of the letter should be attached to your
copy of the lease.
