WHEREAS, a public hearing was held on September 22, 1975, in
the chambers of the Board of County Commissioners, Weld County,
Colorado, for the purpose of hearing a petition of Roger Sears, (Sierra
Investments), 818 12th Street, Greeley, Colorado, requesting a change
of zone from "E" Estate District (Planned Unit Development) and "H"
- High Density Residential District (Planned Unit Development) to "R" Resi-
`- dential District (Planned Unit Development) and change of name from
,� Chalet West to Carriage Estates, and
WHEREAS, the petitioner was present, and
WHEREAS, there was no opposition to-the change of zones, and
WHEREAS, the Board of County Commissioners heard all the testi-
mony and statements of those present, and
WHEREAS, the Board of County Commissioners has studied the re-
quest of petitioner and studied the recommendations of the Weld County
Planning Commission as submitted, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that the petition of Roger Sears (Sierra Investments), 818
12th Street, Greeley, Colorado, for a change of zone from "E" Estate Dis-
trict (Planned Unit Development) and "H" High Density Residential District
(Planned Unit Development) to "R" Residential District (Planned Unit Develop-
ment), said area being more particularly described as follows:
A tract of land located within the West Half of the
Southwest Quarter (WzSW4) of Sect ion 24, Town-
ship 5 North, Range 66 West of the Sixth Principal
Meridian, Weld County, Colorado, and being more
particularly described as follows:
Commencing at the West Quarter (W4) corner of said
Section 24 and considering the West line of the South-
west Quarter (SW-41-) of said Section 24 to bear South
00°59'40" East and all other bearings contained herein
being relative thereto.
Thence South 00O59'40" East along the West line of the
Southwest Quarter (SW4) of said Section 24 a distance
of 164. 00 feet to the true point of beginning; thence
North 89°26'01" East, 1, 326. 39 feet to a point on the
East line of the West Half of the Southwest0 Quarter

is hereby granted under the conditions following:
1. That any water and sanitation facilities to be installed shall be
approved by the State Health Department.
2. All applicable subdivision regulations and zoning regulations
shall be followed and complied with in accordance with the zoning resolutions
of Weld County, Colorado.
3. Subject to recording in the office of the Weld County Clerk and
Recorder of an Affidavit of Change of Name from Chalet West, First Filing
and Chalet West, Second Filing to Carriage Estates.
4. Subject to providing a holding pond for waste and/or flood waters
on tract "A" of said Carriage Estates, First Filing, in accordance with
agreement of September 24 , 1975, copy attached herewith and made a part
hereof by reference, and which agreement shall be recorded in the office of
the Weld County Clerk and Recorder.

Know All Men By These Present, that the undersigned are the owners of
various parcels of land located within the West Half of the South West Quarter
(W1, SWG) of Section Twenty-four (24) Township Five (5) North, Range Sixty-
Six (66) West of the 6th Principal Meridian, Weld County, Colorado and more
further described as Chalet West First Filing and Chalet West Second Filing
as shown by the recorded maps and plats thereof in the Weld County Clerk and
Recorders office;
That the present owners of a majority of the real property as described
above as Chalet West First Filing and Chalet West Second Filing desire to
change the name of said subdivision to Carriage Estates;
That the undersigned owners have no objection to such change of name
from Chalet West First Filing and Chalet West Second Filing to Carriage Estates;

— to the Official Unit Development Zoning Plat known as Chalet West (to
L) be known in the future as Carriage Estates) , consisting of a tract of
land located in the West Half of the Southwest Quarter of Section 24,

The petitioner, Sierra Investments; 818 12th Street; Greeley, Colorado,
proposes a change from the former zoning of E-UD to R-UD and a portion
of the former H-UD to R-UD to make the area more desirable for todays
sales market. The proposed R-UD zoning consists of 17.7 acres comprising
54 single-family residences for a density of 3.05 per acre, with each
U lot consisting of in excess of 6,500 square feet.

An Architectural Control Committee shall be formed by the Developer and
function until the project is completed. They will be charged with the
responsibility to review all building construction including residences,
garages and carports to ascertain compliance with reasonable architectural
design standards for Carriage Estates. Said Committee shall have the
authority to deny construction if said construction does not meet reasonable
architectural design standards set for this unit development.

Dear Mr. Sears:
We have investigated the Amended Development Zoning Plat for Carriage
Estates with the idea of ascertaining the need, if any, of additional
storm drain runoff facilities due to the change in zoning.
Using the study as prepared by Nelson, Haley, Patterson and Quirk on
August 31 , 1971 , and the Drainage Report for the City of Greeley as •
prepared by Hogan & Olhausen, P.C. , we have determined that a runoff '
coefficient of between 0.55 and 0.60 should be used in the rational
formula Q = C. I.A. , in which the coefficient referred to is C. Inas-
"- much as Nelson, Haley, Patterson and Quirk used the upper extreme of
0. 60 in their original study, we do not feel that additional ponding '
area is necessary. Further, we feel that the original design is con-
servative based on the study made by Hogan & Olhausen, P.C. for this
locale.

Section 24 Township 5 North Range 66 West, all in Weld County, Colorado.
The soils on this plot of land do not pose any limitations on
subdivision development.
The soil survey is made on the basis of 50 to 60 inch borings. This
information should be used for general planning and does not exclude F- -
the need for on-site investigation for specific engineering purposes.

Gentlemen:
On July 25 , i971 , a letter was mailed to the County Commis—
si.o:. :rs of Weld County, with a copy to the Weld County Planning
Commission, advising; of problems arising from the House-McNurphy
Gcepn"e Ditch ant' surface runoff from the Southwest Quarter (514)4)
of :section 19,. a small part of Section 30, in Township 5 North,
Mange 65 Lest.. of the Gth 1'.N. , and almost nll of Section 24 and
the North Half (N1/4) of Section 25 in- Township 5 North, Range 66
• West of the 6th 1'.PI. , in Weld County, Colorado.
This area has been a problem for flood waters and seep waters
for some years. The problem has become greater because of the
increased development and the increase in the drain waters coming
from the ]louse-McMurphy Seep Ditch.
An inspection was made of this area by Ph'. Robert Adams, an
employee of the Weld County Planning Commission, shortly after the
receipt of our letter of July 25, 1974.
We are now advised that the Evans Council has agreed to a
development of a tract of land being 45-acres bounded on the West
by 23rd Avenue, on the East by Magnolia Street, on the South by
37th Arcot and on the North by 34th Street.
We are writing' a letter to the Mayor and Trustees of the City
of Evans requesting them to require a provision for flood control
and disposal of . surface waters and seep waters from this develop-
ment.
We have had no cooperation, other than the site inspection
by Mr. Adams, from the Planning Commission or the County Commis-
sioners of Weld County since our letter of July 25, 1974.
• We respectfully request that some action be taken by the
County Conunissionors and the Planning Commission of Weld County
to see that any further development has provisions for handling
of surface runoff and seep waters, and that steps be talc iuedi_
ately to work out a permanent solution for the flood pOter

At such time as Wass Investment Company seeks' to close the
ditch allowing said waters to pond in an area north of the Evans
Ditch, there will be no place for said waters to go and they will
• flood and destroy property of people lying to the south, including
the Berliers.
It is believed that a little cooperation on the part of all
$ of the people contributing to this problem could result in a solu-
tion which will benefit all and that, if .no cooperation is experi-
enced, it hill be necessary that the County Commissioners do all
in their power to stop further development in the area until this
, problem can be solved.
