WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners has determined at a public hearing held on the 28th day of August, A.D. , 1978, in the Chambers of the Board of County Commissioners of Weld County, Colorado, that a certain tract of land is owned by Leo Bissell , which land is more particularly described as follows: The North Half of the Northwest Quarter (N1/2NW0 of Section Sixteen (16) , in Township One (1) North, of Range 66 West of the 6th P.M., Weld County, Colorado, containing 80 acres more or less. WHEREAS, the owner of said tract of land desires to obtain a variance from the minimum lot size requirement so that said applicant may make application to the Board of County Commissioners for a recorded exemption, as set forth in Section 9-4.A. (6) of the Subdivision Regulations, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, feels that the applicant has shown good cause for granting a lot size variance under Section 9-4.A(6) of the Weld County Subdivision Regulations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that a variance from lot size requirements, be and hereby is, granted to Leo Bissell for the abovedescribed parcel of land. N2NW* Section 16, T1N, R66W of the 6th P.M. , Weld County, Colorado. This property is located 1 mile southeast of the Town of Ft . Lupton. The property con- tains approximately 102 acres of Class III and IV irrigated soils. There is an existing residence and other improvements located at the north end of this property at the present time. The request is to obtain a variance from the minimum lot size requirement , Section 9-4 A. (6) , so that he can make applica- tion to apply for a recorded exemption. If this lot size variance is granted, Mr. Bissell will proceed with his appli- cation for a recorded exemption to divide the property into two parcels. Mr. Bissell wishes to sell approximately 1 acre which will be used for a residential building site. Based upon the information submitted and the adopted policies in the County, the Department of Planning Services Staff recommends the request be approved for the following reasons : 1. The request conforms with Section 9-2 of the Weld County Subdivision Regulations (intent clause of the Recorded Exemption procedure) , Section 3. 3A. of the Weld County Zoning Resolution (the intent clause of the Agricultural Zone District) , and the Weld County Comprehensive Plan in that the proposed use will be compatible with the surrounding agricultural uses.
