RE: RECORDED EXEMPTION NO. 259 - LEO TOLLE.
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held
on the 23rd day of May, 1977, in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that a certain
parcel of land, being the property of Leo Tolle, 4 miles south
of Carr, Colorado, more particularly described as follows :
All of the West Half of Section 15 , Township 10 North,
Range 67 West of the 6th P.M. , County of Weld, State
of Colorado. Said West Half is subject to a 30 . 00 foot
wide reservation for County Road along the Northerly
side thereof.
does not come within the purview of the definition of the terms
"subdivision" and "subdivided land" as set forth in Section 30-
28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado desires to exempt this particular division of land from
the definition of "subdivision" and "subdivided land" pursuant to
its authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended,
and Section 2-1A(3) of the Weld County Subdivision Regulations .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove de-
scribed parcel of land owned by Leo Tolle, be exempt from the
definition of the terms, "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973 ,
as amended, and Section 2-lA (3) of the Weld County Subdivision
Regulations.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 23rd day of
May, A. D. , 1977.

Dear Cormissioners:
The attached application, plat, and related items are in reference to a request
by Leo Tolle for a recorded exanption. The parcel of land in question is
described as the Wz of Sec. 15, T1ON, Range 67W of the 6th p.m. , Weld County,
Colorado. Said property is located 4 miles south of Carr. The subject property
contains approximately 320 acres of Class III non-irrigated soils. The request
is to split the property into parcels of 4.29 acres and approximately 315 acres.
As indicated in a letter sutnitted fran Mr. Charles Hill and Mr. Leo Tolle,
Mr. Tolle desires to convey the 4.29 acre parcel to Mr. Charles Hill who has
burn a long time farm employee. Mr. Hill has worked and lived on the subject
property for the past 12 years and now desires to construct his own residence on
the property.
Based upon the information sutsnitted and the adopted policies in the county, the
Planning Conmission Staff reccmnends the request be approved for the following
reasons:
1. The proposed split conforms with the intent clause of the recorded exanption
procedure (Section 9-2 of the Weld County Subdivision Regulations), the
intent clause of the Agricultural District (Section 3.3A of the Weld County
Zoning Resolution), and the Weld County Ccwprehensive Plan since the use
would be compatible with the surrounding agricultural uses.

Dear Sirs:
I would _ike to get a recorded excemption because , I have
lived on this property for the past 12 years. I have seen living in
a :mobile home and would like to build a permanent dwelling.
hr. Tolle has 320 acres on the home place. he ha.. 320
acres leaved east of Pierce. He puts up 2000acres of hay each year.
There is his son and grandson meiping him , as he has arthritus so bad
that he is disabled. I have been working on the farm in the evenings
and on my days off. i do just about all of the farming on the home
place.
I plan on staying on the firm, learning more about faraing
and livestock. The only future plan, 1 have for the 4 acres is to
build a horse darn_, aecause my wife and daughter both have ..orses,
and my daughter in her second year in 4H, which she takes a great
interest.
We do not plan on moving the isosile home, because ay nephew
is 20 years wld and thinking of getti g married. le help his dad and
grandpa with the farming and haying operation, so he will be needigg a
place to live on the farm.
The only reason we need to go through all this is oecause , I
need a deed to the 4 acres so i can get a V.A. loan to build my house
with.
air. Toile is getting along in years. he has three children,
two of which live on the farm and always has and always will.
