A Use by Special Review permit for a multiple well, oil and gas pad.
The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process.
COMMENTS:
C St. is under the jurisdiction of the City of Greeley. The City will address any access or right-of-way
requirements
Tracking control is required at the access point. General note #2 on the Plat addresses the construction
specifications of the access road will address tracking of mud and debris onto the paved roadway.
In the event that 1 or more acres are disturbed during the construction and development of this site, the
applicant shall obtain a stormwater discharge permit from the Water Quality Control Division of the
Colorado Department of Public Health and Environment.
If more than 1 acre is to be disturbed, a grading permit will be required prior to the start of construction.
The grading permit application must contain: an erosion and sediment control plan, a grading plan,
installation details of all BMPs to be utilized, typical installation and maintenance notes for all BMPs to be
utilized, and a copy of the approved CDPHE stormwater permit.
A majority of the property lies in a Special Flood Hazard Area (SFHA) defined by the Federal Emergency
Management Agency (FEMA). This SFHA is delineated on the current effective Flood Insurance Rating
Map (FIRM), panel number #080266-0628C dated September 28, 1982 and on the Flood Boundary and
Floodway Map (FBFM) Panel #080266-003 dated September 28, 1990. Portions of lots located in the
current effective FEMA 100-yr floodplain may not be buildable.
The applicant has obtained Conditional Approval for construction of the facility under Flood Hazard
Development Permit FHDP-818.
This site is located in a State Designated, Municipal Separate Storm Sewer System (MS4) Area which
may trigger specific water quality requirements or other drainage improvements if the lot develops further.
The applicant has submitted a water quality design and memo signed and stamped by a registered
Professional Engineer licensed to practice in Colorado which adequately addresses the Water Quality
requirements for this facility.
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA).

REQUIREMENTS:
1. Show on the Plat:
a. Show and label the boundaries of the 100 -year floodplain.
2. Before Construction:
a. In the event that 1 or more acres are disturbed during the construction and development
of this site, the applicant shall obtain a stormwater discharge permit from the Water
Quality Control Division of the Colorado Department of Public Health and Environment.
b. If more than 1 acre is to be disturbed, a grading permit will be required prior to the start of
construction. The grading permit application must contain: an erosion and sediment
control plan, a grading plan, installation details of all BMPs to be utilized, typical
installation and maintenance notes for all BMPs to be utilized, and a copy of the
approved CDPHE stormwater permit.
3. Add the following notes to the plat:
a. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist
on the property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds.
b. WARNING: LOTS MAY NOT BE BUILDABLE DUE TO FLOODPLAIN OR FLOODWAY
DESIGNATION. Please be advised that owners of Parcel 0805-36-0-00-009 may not be
able to obtain building permits to construct non-agricultural structures. All construction or
improvements occurring in the floodplain as delineated on Federal Emergency
Management Agency Flood Insurance Rate Map (FIRM) Community Panel Map
#080266-0628C dated September 28, 1982 and on the Flood Boundary and Floodway
Map (FBFM) Panel #080266-003 dated September 28, 1990, shall comply with the Flood
Hazard Overlay District requirements of Chapter 23, Article V, Division 3 of the Weld
County Code and all applicable FEMA regulations and requirements as described in 44
CFR parts 59, 60, and 65.
c. Flood hazard development permits will be required for development activities located
within the FEMA mapped Cache La Poudre Floodplain. The FEMA definition of
development is any man-made change to improved or unimproved real estate, including
by not limited to buildings or other structures, mining, dredging, filling, grading, paving,
excavation, drilling operations, or storage of equipment and materials.
d. FEMA's floodplain boundaries may be updated at any time by FEMA. Prior to the start of
any development activities, the owner should contact Weld County to determine if the
floodplain boundaries have been modified.
e. This site is located in a State Designated, Municipal Separate Storm Sewer System
(MS4) Area which may trigger specific water quality requirements or other drainage
improvements if the lot develops further.
f. Weld County is not responsible for the maintenance of onsite drainage related features.

Environmental Health Services has reviewed this proposal for an oil and gas production facility
in the R-1 (Low -Density Residential) Zone District. Portable toilets and bottled water will be
provided for employees and contractors during drilling/construction.
There is an existing residence on the property served by an individual sewage disposal system
(SE -0600083). The septic permit, issued in 2006, is a Statement of Existing which is
information provided by the property owner on the size and location of an unpermitted septic
system. The drawing provided with the Statement of Existing did not show the location and
dimensions of the existing septic system. The applicant will be required to provide a revised
drawing showing the dimensions and location of the septic system on the property. In addition,
evaluation of the existing septic system for permit SE -0600083 revealed an illegal graywater
discharge. Specifically, graywater was discharging on top of the ground vs. to the septic system.
The applicant will need to submit documentation that the graywater discharge has been
connected to the septic system. Environmental Health Services will perform an inspection to
verify.
The residence is served by City of Greeley water. However, no documentation was provided
with the application confirming water service is available. In addition, the applicant noted that in
their Best Management Practices (BMP) that they "will make best efforts to reduce truck traffic
related to water hauling by using the onsite water source, if available in sufficient supply form
the City of Greeley, to supply drilling and completion water." If proposing to use the onsite water
service for the drilling operation, the applicant will need to submit documentation from City of
Greeley that water service is approved for the proposed uses.
The applicant submitted a waste handling plan describing storage and disposal of wastes
generated from the oil and gas exploration and production, such as drilling fluids, petroleum
contaminated wastes, produced water and solid wastes. The Spill Control and Countermeasure
Plan will address spill procedures.
The dust abatement plan stipulates that water will be utilized during construction to control dust.
Access drives will be constructed of road base material, and speeds will be limited to 10 miles
per hour to reduce dust. Disturbed areas will be revegetated.
The applicant has obtained a field -wide stormwater discharge permit (COR03H509) from the
Colorado Department of Public Health and Environment, Water Quality Control Division.
The applicant should utilize best management practices to reduce noise as applicable. The
facility shall comply with the Colorado oil and Gas Conservation Commission noise regulations.
In accordance with Colorado Oil and Gas Conservation Commission Rule 603.e.(12), berms or
other secondary containment devices in high density areas shall be constructed around crude
oil, condensate, and produced water storage tanks and shall enclose an area sufficient to
contain and provide secondary containment for one -hundred fifty percent (150%) of the largest
single tank. Berms or other secondary containment devices shall be sufficiently impervious to
contain any spilled or released material. No more than two (2) crude oil or condensate storage
tanks shall be located within a single berm. The applicant will need to submit documentation
demonstrating that the Commission's secondary containment requirements have been met.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be recorded:
1. The existing residence is served by existing septic system, Septic Permit No. SE -
0600083. The septic permit, issued in 2006, is a Statement of Existing which is
information provided by the property owner on the size and location of an unpermitted
septic system. The drawing provided with the Statement of Existing did not show the
location and dimensions of the existing septic system. The applicant shall provide a
revised drawing showing the dimensions and location of the septic system on the
property.
2. The applicant shall designate the location of the existing septic system on the plat. The
septic system must be protected from vehicle traffic.
3. Evaluation of the existing septic system for Septic Permit No. SE -0600083 revealed an
illegal graywater discharge. Specifically, graywater was discharging on top of the
ground vs. connected to the septic system. The applicant shall submit documentation
that the graywater discharge has been connected to the septic system. Environmental
Health Services will perform an inspection to verify.
4. Submit documentation from City of Greeley indicating that water service is available
and approved for the proposed uses.
5. Submit documentation demonstrating that the secondary containment to be constructed
around the aboveground tanks complies with the Colorado Oil and Gas Conservation
Commission's Rule 603.e.(12).
We recommend that the following requirement be incorporated into the permit as a condition
that must be met 45 days after first production:
1. The applicant shall submit evidence of an Air Pollution Emission Notice (APEN)
application from the Air Pollution Control Division, Colorado Department of Health and
Environment. Alternately, the applicant can provide evidence from the APCD that they
are not subject to these requirements.

We recommend that the following requirements be incorporated into the permit as development
standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities
Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in
a manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not meant to
include those wastes specifically excluded from the definition of a solid waste in the
Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance
conditions.
4. The applicant shall operate in accordance with the approved "waste handling plan", at all
times.
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The
facility shall be operated in accordance with the approved dust abatement plan at all
times.
6. The operation shall comply with Oil and Gas Conservation Commission Noise
Regulations, Rule 802.
7. The operation shall comply with all applicable oil and gas operations regulated by the
Colorado Oil and Gas Conservation Commission.
8. In accordance with Colorado Oil and Gas Conservation Commission Rule 603, berms or
other secondary containment devices in high density areas shall be constructed around

9. The facility shall be constructed and operated to ensure that contamination of soil and
groundwater does not occur.
10. Any petroleum contaminated soils on the facility shall be removed, treated or disposed of
in accordance with all applicable rules and regulations.
11. The Spill Prevention, Control and Countermeasure Plan shall be made available at all
times.
12. Adequate toilet facilities (portable toilets) shall be provided during drilling/construction.
13. Bottled water shall be utilized for drinking and hand washing during drilling/construction.

14. Any septic system located on the property must comply with all provisions of the Weld
County Code, pertaining to Individual Sewage Disposal Systems.
15. The facility shall utilize the existing public water supply (City of Greeley).
16. The operation shall comply with all applicable rules and regulations of the State and
Federal agencies and the Weld County Code.

After reviewing the application and documents submitted the Building Department has the
following comments:
Oil and gas permits are required for all tanks and equipment set on site A building permit will be
required for any new construction, alteration, or addition to any buildings or structures on the
property. A building permit application must be completed and two complete sets of engineered
plans including engineered foundation plans bearing the wet stamp of a Colorado registered
architect or engineer must be submitted. A geotechnical engineering report performed by a
registered State of Colorado engineer shall be required or a open hole inspection.
Buildings, equipment and structures shall conform to the requirements of the various codes
adopted at the time of permit application. Currently the following has been adopted by Weld
County: 2012 International Building Code; 2012 International Mechanical Code; 2012
International Plumbing Code: 2012 International Energy Code; 2006 International Fuel Gas
Code; 2011 National Electrical Code; 2009 ANSI 117.1 Accessibility Code the 2012
International Plumbing Code. and Chapter 29 of the Weld County Code.
A plan review shall be approved and a permit must be issued prior to the start of construction.

General Comments
❑ Due to the site's proximity to existing urban residential densities, the use of City right-of-
way, and the potential use of the City water system to conduct operations on the site
(similar to other Mineral Resources, Inc. facilities throughout the community) the City
requests that the site be developed to City standards as it relates to impact mitigation
(such as but not limited to visual impact mitigation).
❑ Advisory. Access to the site is only available via City right-of-way.
❑ Advisory. If the applicant requests the use of the City of Greeley's water distribution
system to fill an on -site temporary water tank for use in hydraulic fracturing operations,
determining the final operations plan will significantly impact the number of truck trips
depending on if this on -site temporary tank can be filled via the City water system or via
tanker trips.
❑ Advisory. One of the support guy lines for the adjacent broadcast antenna appears to be
within the normally required setback distance for overhead utilities.
❑ Please provide details on the location and scope of equipment and materials used for the
completion/recompletion phases while hydraulically fracturing the wells.

Screening/Landscaping
❑ The site will be prominently visible from the adjacent Clover Creek subdivision and
residential uses to the south and east. City requirements for screening of sites such as this
would require the planting of a "Buffer Yard I)" between the site and adjacent residential
uses. City code would require a minimum of a "Buffer Yard A" to adjacent vacant land
such as the northern boundary of the site. This requirement is modified through a
combination of angular screening provided by grade and/or fencing.
❑ Recommendation. Staff recommends the use of evergreen trees to provide year-round
screening of the subject site. Staff recommends exchanging the proposed Picea Punges -
Colorado Spruce with Pinus Edulis — Pinyon Pine to address concerns about hardiness.
Notice
❑ The City requests that public hearing notice be provided at a minimum to those property
owners within 500' of the subject properties boundary.
❑ Will a neighborhood meeting be held for the proposed site? Similar projects proposed
within the municipal limits have been required to hold a neighborhood meeting to
establish a dialog between the developers and the adjacent residential property owners.
As the proposal require access to City right-of-way and has proposed the use of City
water to conduct operations the City would want to attend such a meeting.
Noise
❑ Recommendation. The City recommends the use of straw bales in addition to noise
mitigation best practices to reduce the impact to the adjacent residential subdivisions to
the west and south.

General Comments
❑ New. Is it anticipated that all wells will be drilled at one time or will the site be phased?
What is the anticipated time frame for full build out? Please include this information with the
next application.
El New. Label the setback from the existing rail line to the wellhead, production tanks, and
production equipment. The City of Greeley Development Code 18.56.040(1) requires all
wellheads, production tanks, and/or associated on -site production equipment be set back at
least 150 feet or one and one-half times the height of the derrick, whichever is greater to any
rail line.
Fire
❑
New. Provide all setback waiver agreements for the adjacent properties.
Advisory. While the subject property is located in Western Hills Fire Protection District, the
City of Greeley will provide fire protection and complete any necessary inspections.
❑ Code. All flammable and combustible tank installations require application for a permit
through Greeley Fire Department. The fee is $150.00 +$50.00 per additional tank per site.
This fee is required to obtain a permit to install or remove flammable or combustible liquid
tanks.

❑ Code. Access roads to tank batteries shall meet the requirements set forth in IFC Section
503.2. An all weather surface is required, maximum grade of access road is 10%. The angle
of approach and departure for any means of access shall not exceed 8 degrees.
❑ Code. A final site inspection by the Fire Department is required upon completion of the
wells and production facilities. Call 970-350-9510 to schedule.
❑ Code. Tank storage area to comply with applicable requirements of NFPA 30.
❑ Code. Signage is required to be posted listing emergency contact information.
Water/Sewer
❑ Code. How will water be brought into the site during the drilling and fracturing operations?
Is it known how much water would be required? If a fire hydrant is proposed to be extended
into the site, the city would request that the fire hydrant be connected to the 16" water main
in C Street. See the link below to access the City of Greeley website for the size and location
of existing water lines in the area.

El Advisory. If a hydrant or service is extended in to the property please note that all customary
and applicable fees (Labor and Materials fee to drill the tap, and fire hydrant meter rental
fee's) would be due.
❑ Advisory. Consideration would be given by Water and Sewer to the installation of a
temporary water service and vault depending on the required demand during drilling and
fracturing operations. Upon full build out of the site it would he a responsibility of the
applicant to abandon the water service per City of Greeley Water Standards Volume III
Appendix A9 or replace the meter with a hydrant if the service is constructed to meet hydrant
lateral standards.
❑ New. How will landscape screening around the site be watered? If it is determined that an
irrigation system is needed, a separate water tap would require annexation to the City of
Greeley. Additionally raw water (based on required tap size), plant investment fees, labor
and materials, and water meter fees would be due as a part of a water service. A backflow
prevention assembly on the irrigation system will be required per City of Greeley Code and
State Health Department regulations. Please submit an irrigation system plan for review by
the City of Greeley.
❑ Advisory. Please address how the water will be stored on site and show the location of the
water storage tank on the site plan. Due to the location of the oil and gas site the City of
Greeley has concern that a large above ground tank failure could impact the surrounding
developments and infrastructure. Please provide documentation that adjacent development
and infrastructure would not be impacted by a storage tank failure.
❑ Advisory. It would be highly recommended to locate any existing septic systems/leech fields
located within the property. The septic systems shall be protected from construction or oil
and gas related traffic. If the existing septic system were to be damaged during construction
there is potential that a new septic system would not be permitted through Weld County due
to the relative closeness of the parcel to the sanitary sewer main located on the north side of

the railroad right of way. Connection to the existing Greeley sanitary sewer system will
require annexation into the City of Greeley.
Storm Drainage
❑ New. It appears that the proposed 18" culvert crossing for the access will not be sized
adequately to convey developed flows tributary to the channel north of C Street. The City of
Greeley will request that the culvert and channel within the property be sized to convey the
100 -year flow without overtopping the access as to maintain emergency access to this
property. In addition the backwater at the proposed culvert shall not increase the tailwater
condition for the pipes daylighting into Outlot B of Clover Creek Subdivision. The design
flow rate for the culvert and channel shall be 185 cfs plus additional historic 100 -year flow
from the undeveloped parcel to the west. The following flow rates tributary to the property
have been identified from approved studies; Northview Regional Detention Pond 28°i
Avenue Basin Study (155 cfs), Northview Land Lease Detention Pond (2.9 cfs), Northview
Mini Storage Detention Pond (0.6 cfs), Clover Creek Subdivision Detention Pond (15.5 cfs),
Northview Land Lease (2.9 cfs), and flows in C Street from the multiple drainage studies
(10.4 cfs).
❑ New. To assure that the developed flows will continue to be safely conveyed through this
property it will be requested that drainage maintenance agreement he signed by the owners of
the property. In addition an easement of adequate width shall be dedicated to the City of
Greeley the entire length of the property. The City of Greeley is currently preparing the
agreement and will provide a copy of this agreement to the applicant and the county upon its
completion.
❑ Advisory. It is recommended that the applicant provide a drainage basin map and associated
drainage calculations for the proposed site as to make a determination if onsite detention
would be required. Consideration should be given to installing a detention facility with a
valve that will provide additional spill containment above and beyond what is being required
by COGCC regulation. The installation of additional containment could ease public concerns
that have been identified during recent public hearings for urban oil and gas applications.
Floodplain
❑ New. The site is located within the 100 -year floodplain as indicated by the U.S. Army Corps
of Engineers 2006 flood study, and therefore the improvements will require a floodplain
development permit from Weld County Public Works. The City of Greeley would like a
copy of the approved floodplain development permit for our files since the site is adjacent to
property that is within Greeley's jurisdiction and the subject property will likely be annexed
into the City of Greeley at some point in the future.
❑ New. If it is found that the proposed improvements will create a rise in the 100 -year
floodplain within the City of Greeley, it will he required to submit a Floodplain Development
Permit through the City of Greeley.
❑ New. The City of Greeley recommends that the proposed facilities (tanks, separators, wells)
be protected (elevated or anchored) from floodwaters to an elevation at least two (2) feet
above the base flood elevation since the improvements arc considered critical facilities. The
City of Greeley also recommends that the proposed facilities have continuous non -inundated
access during a 100 -year flood event.

Erosion Control
❑ Code. Due to the projects proximity to City of Greeley limits please submit an Erosion and
Sediment Control Plan along with a SWMP report for review. In addition a stormwater
discharge permit will be required from the Colorado Department of Public Health and
Environment (CDPIIE) prior to any clearing, grubbing, and site grading operations.
Development Agreement
❑ Code. The required setbacks for this oil and gas facility will limit future development on this
parcel. As the property owner is looking to develop this parcel of land for oil and gas
production it is the City of Greeley's policy that the property owner will be responsible for
future roadway improvements. C Street has not been improved to its ultimate section along
the frontage of the property from Clover Creek Subdivision to 23rd Avenue. As opposed to
requesting that the improvements be completed now the City of Greeley would request that
the property owner participate in a development agreement. In general this agreement will
define participation and timing requirements for public improvements, payback,
maintenance, etc. As a part of this agreement Greeley will request the property owner
participate in the design and construction of the north half of C Street adjacent to the
development. The City of Greeley is currently preparing the agreement and will provide a
copy of this agreement to the applicant and the county upon its completion.
Traffic
❑ New. The access to the site off of C Street shall have a 30 foot long paved approach the full
width of the access. The paved surface is being requested to keep sediments from tracking
onto C Street.
❑ New. Please justify the required 60' radius at the access off of C Street as the radius seems to
be quite large and unnecessary.
❑ New. A Public Works Right -of -Way permit will be required for any construction located
within City of Greeley ROW, including installation of a hydrant and construction of the
proposed access off of C Street.
❑ New. As the property will be accessed from City of Greeley right of way it would be
requested that the applicant provide a traffic memo detailing truck traffic for each phase of
the drilling and fracturing process and the production phase. This memo should include a
construction schedule, truck volumes, distribution, and traffic routes.
