In establishing the boundaries of the territory proposed to be annexed, no land held in identical ownership, whether consisting of one tract or parcel of real estate or two or more contiguous tracts or parcels of real estate, has/have been divided into separate parts or parcels of real estate without the written consent of the land owner or land owners thereof, except and unless where such tracts or parcels are already separated by a dedicated street, road, or other public way. 4. In establishing the boundaries of the territory proposed to be annexed, no land held in identical ownership, whether consisting of one tract or parcel of real estate or two or more contiguous tracts or parcels of real estate comprising twenty (20) acres or more which, together with the buildings and improvements situated thereon have an assessed valuation in excess of $200,000 for ad valorem tax purposes for the year next preceding the filing of the written petition for annexation, has/have been included within the territory proposed to be annexed without the written consent of the land owner or land owners. 5. The territory proposed to be annexed does not include any area which is the same or substantially the same area in which an election for an annexation to the City of Greeley was held within the twelve months preceding the filing of this petition. 6. The territory proposed to be annexed does not include any area included in another annexation proceeding involving a city other than the City of Greeley. 7. The territory proposed to be annexed is not presently a part of any incorporated city, city and county, or town. 8. The property owned by each petitioner is described on each separate signature sheet and, when needed, described more fully in the exhibits attached hereto and incorporated herein by reference. 9. The signer(s) of this petition comprise(s) more than fifty percent (50%) of the land owners and owning more than fifty percent (50%) of the property, excluding public streets and alleys, and any land owned by the annexing municipality, and are, in fact, owners of one hundred percent (100%) of the property set forth in Exhibit A attached hereto and incorporated herein by reference. Accompanying this petition are the original and four copies of an annexation plat map containing the following information: A. A written legal description of the boundaries of the area proposed to be annexed. B. A map showing the boundary of the area proposed to be annexed. C. Currently, the plan for the site is to annex 103.413 acres with two zone districts as follows: I -M - 77.667 ac. C -I I - 25.746 ac. The proposed development site is surrounded on the east, north and west by agricultural land, all of which is unincorporated and part of Weld County. No adverse impacts are anticipated to arise from the addition of the proposed project. Weld County offices and facilities are directly to the south of the site. The commercial portion of the project will include pedestrian connectivity to these offices to allow for commuting on foot as well as the ability to utilize the amenities that The Grainery will offer. The 2060 Comprehensive Plan for the City of Greeley does not specifically identify future land uses for this site. However, the Land Use Guidance Map identifies O Street as a future multi -modal corridor, US 85 as a commercial corridor, and a future commercial node located at the southeast corner of the property. The comprehensive plan for the area stresses the need for pedestrian friendly development, park and open space land and uses that work well with other proposed and existing uses. This project takes into account these needs and is compatible with the intent of the City's 2060 Comprehensive Plan, particularity LW and LU4. The property is also within the LREGA but just outside of the proposed APFA. At this time there are surface use agreements with the operators of several of the oil and gas facilities. It is expected that all site oil and gas facilities will have private surface use agreements in place prior to the platting process. Currently there are no public agreements in place. It is anticipated that an annexation agreement will be a part of this proposal. The Grainery project complies with the following land use characteristics of the City's 2060 Comprehensive Plan: L U3 Land Use Characteristics — Commercial A — Adopt commercial land use standards related to type, size, location and design which support neighborhoods and the community's broader needs The C -H zoned parcel is situated in an ideal location for a potential Micro -Commercial or Neighborhood Market. The area contains 25.746 acres and is adjacent to future multi -family development that will have a minimum of 6 dwelling units per acre. The parcel is located at the intersection of 'O' Street and the extension of 17rl' Avenue. A mix of businesses such as office, commercial, retail, personal service shops and restaurants that can serve the adjacent neighborhood and the employees of Weld County to the south as well as the employees of the industrial uses to the east. When future development is proposed for the site, City water and sanitary sewer service will be extended to serve the site. The property is proposed to be withdrawn from the Eaton Fire Protection District and receive fire services from the Greeley Fire Department. The annexation will extend the external boundary of the City to the north. The annexation of this property into the City would be consistent with present growth patterns and Comprehensive Plan policies. There is evidence that this site shares a common interest with the City's future.
