SUBJECT: USR12-0073, Harbortronics Time Lapse Photo
A Use by Special Review (USR) permit for research, repairing, manufacturing, fabrication,
processing, assembling, storage and retail sales of time lapse photo equipment.
The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process.
COMMENTS:
The roadway accessing this property is on 60 ft of WCR86 unmaintained county right of way (section line
access). A Nonexclusive License Agreement is required for use of unmaintained County Right -of -Way.
The nonexclusive agreement states that the applicant is aware that they are using unmaintained County
section line right-of-way and that the County will not be responsible for maintenance or upgrades of the
right-of-way and that the applicant's use of this right of way is not exclusive. Public works has supplied
the applicant with the non-exclusive license agreement application package.
Public Works strongly recommends that the property owner establish an access road maintenance
agreement with other property owners utilizing the shared access so that future owners of the properties
will be aware of their requirements for shared maintenance of the access road. This is not a requirement
for the USR but is recommended to avoid property owner conflicts in the future.
An access permit has not been approved for this project. The access from this project onto a county
roadway is considered the intersection of the unmaintained county right (section line access WCR86) and
WCR15. Please provide photos looking North, East and South at this intersection. The access permit fee
has been waived by the County Traffic Engineer. Please show the approved access on the Plat and
label it with the approved Access Permit number.
The applicant is responsible for providing a water quality feature that conforms to the methodology
outlined in Volume 3, Section 3.3.0 of the Urban Storm Drainage Criteria manual. The web site address is
as follows http://www.udfcd.orq. Please provide Water Quality Control Volume (WQCV) calculations and
modify the design to meet these criteria. Outletting concentrated flows into a roadside ditch is not allowed.

The access driveway culvert shall be installed according to the specification of the Department of Public
Work as to size and location in the County rights -of -way or other County property in which such culverts
may be installed. The property owner shall be responsible for cleaning the borrow ditch to the extent
required to accommodate the road access culvert and insuring proper drainage.
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA).

REQUIREMENTS:
1. The applicant shall complete a Nonexclusive License Agreement for the Upgrade and
Maintenance of Weld County Right -of -Way.
2. Off-street parking spaces including the access drive shall be surfaced with gravel, asphalt,
concrete or the equivalent and shall be graded to prevent drainage problems.
3. Each parking space shall be equipped with wheel guards or curb blocks when necessary to
prevent vehicles from extending beyond the boundary of the space and from coming into contact
with other vehicles, walls, fences or plantings.
4. Parking lots shall conform to all standards of the American with Disabilities Act.
5. Add the following conditions of approval to the plat:
a. Show the access points on the Plat and label them with the Access Permit number.
b. Show and label an approved Water Quality Areas on the Plat.
c. The applicant shall indicate specifically on the plat the type of right-of-way/easement and
indicate whether it is dedicated, private, or deeded to provide adequate access to the
parcel. Section line accesses are considered private lanes with no county maintenance.
6. Add the following development standards to the plat:
a. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist
on the property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds. All
vegetation, other than grasses, needs to be maintained at a maximum height of 12
inches until the area is completely developed.
b. The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent
property damage of the type generally attributed to run-off rate and velocity increases,
diversions, concentration and/or unplanned ponding of storm run-off.
c. Weld County is not responsible for the maintenance of onsite drainage related features.
d. Please delineate the water quality feature on the plat and label as "No Build/Storage
Area".

Environmental Health Services has reviewed this proposal for a Site Specific
Development Plan and Special Review Permit for a Use Permitted as a Use by Right,
an Accessory Use, or a Use by Special Review in the Commercial or Industrial Zone
Districts, (research, repairing, manufacturing, fabricating, processing, assembling,
storage and retail sales of time lapse photo equipment) in the A (Agricultural) Zone
District
The application indicates there are 4 employees plus the owner. Potable water is
provided by North Weld County Water District. An engineer designed commercial
septic system will be installed when the facility is constructed. The septic system is
required to be approved by the Board of Health.
The waste handling plan indicates a local service will provide trash pickup on a weekly
basis. Aluminum shavings and paper products will be recycled.
The dust abatement plan states driveways and parking areas will be either gravel or
recycled asphalt.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirement be incorporated into the permit as a
condition that must be met prior to the issuance of the Certificate of Occupancy:
1. An individual sewage disposal system is required for the proposed facility and
shall be installed according to the Weld County Individual Sewage Disposal
Regulations. The septic system is required to be designed by a Colorado
Registered Professional Engineer.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions. The applicant shall operate in accordance with the
approved "waste handling plan", at all times.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
5. This facility shall adhere to the maximum permissible noise levels allowed in the
Non -specified Zone as delineated in Section 14-9-30 of the Weld County Code.
6. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
7. The facility shall utilize the existing public water supply. (North Weld County
Water District)
8. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of the facility, at all times.
9. The applicant shall obtain a Colorado Discharge Permit System or CDPS permit
from the Colorado Department of Public Health and Environment (CDPH&E),
Water Quality Control Division, as applicable.
10. All potentially hazardous chemicals must be handled in a safe manner in
accordance with product labeling and in a manner that minimizes the release of
hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All
chemicals must be stored secure, on an impervious surface, and in accordance
with manufacturer's recommendations.

11. The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

Dear Sir/Madam,
The Weld County Building Department has reviewed the history and investigated any complaints or
violations that accompany the parcel the establishment resides on. The findings are as followed:
Building permits and engineered plans are required for new structures. Applicant must notify the fire
department and provide verification of notification to the building department. Engineered drawings
are required for the foundation, electrical, mechanical, plumbing and structure.
Any owner or authorized agent who intends to construct, enlarge, alter, repair, move, demolish, or
change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair, remove,
convert or replace any electrical, gas, mechanical or plumbing system, or to cause any such work to be
done, shall first make application to the building official and Weld County to obtain the required permit.
