WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners has determined at a public hearing held on the 27th day of June, 1979 in the Chambers of the Board of County Commissioners of Weld County, Colorado that a certain parcel of land is owned by Frank and Kathie Platt, et al. , which land is more particularly described as follows, to-wit: Part of the Northeast Quarter of Section 8, Township 5 North, Range 67 West of the 6th P.M. , Weld County, Colorado. WHEREAS, the owners of said tract of land desire to obtain a variance from the minimum lot size requirement so that they may make application to the Board of County Commissioners for a recorded exemption, as set forth in Section 9-4 .A. (6) of the Subdivision Regulations, and WHEREAS, the Board of County Commissioners, having consid- ered the recommendation of the Department of Planning Services and all of the testimony and evidence in this matter, feels that the applicants have not shown good cause for granting a lot size variance under Section 9-4.A. (6) of the Weld County Subdivision Regulations. The property on which this request has been made is described as Pt. NE4 Section 8, T5N, R67W of the 6th P. M. , Weld County, Colorado . This property is located 3 miles south of the Town of Windsor. The property contains approximately 26 acres of Class III, IV and VI non- irrigated soils. The request is to obtain a variance from the mini- mum lot size requirement, Section 9-4 A(6) of the Weld County Sub- division Regulations so that they may make application for a recorded exemption. If this lot size variance is granted, the Platts will proceed with their application for a recorded exemption to divide the parcel into two parcels of 13 .46 acres each more or less . The Platts wish to sell the two parcels to two separate owners who wish to build resi- dences on each parcel. Based upon the information submitted and the adopted policies in the County, the Department of Planning Services Staff recommends this request be denied for the following reasons : 1. The proposed request does not comply with the Weld County Com- prehensive Plan. The Plan states that agriculture is a valuable resource in Weld County which must be protected from the impacts of urban growth. To accomplish this objective, the Plan states that residential, commercial and industrial uses will be en- couraged to locate around existing incorporated areas so that their impacts will be minimized, and so that the cost of providing the services associated with such uses will be minimized to the greatest extent possible. Board of County Commissioners Page 2 June 27 , 1979 If such residential uses , as proposed in the pending application are allowed to occur, the cost of providing services to such rural areas can only be increased, thus resulting in overall increased costs to the taxpayer. As stated by the Weld County Comprehensive Plan, such uses should be encouraged to locate around existing incorporated areas, where the base for providing such services is already established. 2. This request is not in conformance with the intent clause of the Agricultural Zone District (Section 3 . 3 A. of the Weld County Zoning Resolution) which states : "Intent - The intent in establishing the A-Agricultural Zone District is to allow all agricultural related uses in those areas in which agriculture is and should con- tinue to be the predominant land use. This district is intended to discourage encroachment of incompatible uses upon the agricultural land in a district, to encourage agricultural uses as the highest and best use of the land in the district as compared with other uses in con- flict therewith, and to provide for the orderly expansion of urban growth in conformance with the Weld County Com- prehensive Plan. " This request would not be encouraging agricultural uses as the highest and best uses , it would not be providing for the orderly expansion of urban growth, it would be promoting the division of agricultural land into smaller less economic parcel sizes, and increasing the residential density on the 27 acres. 3 . This request is not in compliance with the intent clause of the recorded exemption procedure (Section 9-2 of the Weld County Sub- division Regulations) . Said Clause states : "The intent in establishing the recorded exemption pro- cedure is to provide, in accordance with the Weld County Comprehensive Plan, a means whereby non-productive agri- cultural lands may be developed for higher and more productive uses insofar as such uses are compatible with surrounding agricultural uses in areas where such land divisions are proposed. (Revised 4-17-74) . " The parcel presently contains no improvements . The split would allow two sets of improvements to be built on the 27 acre parcel and therefore, create an urban encroachment which would be non- compatible with the Agricultural District. The granting of this request would enhance the chance for conflict between agriculture and residential uses, i. e. , the traditional conflicts between urban and agricultural uses . Board of County Coiiuiiissioners Page 3 June 27 , 1979 4. The minimum lot size in the Agricultural Zone District for irriga- ted parcels is 80 acres and for non-irrigated parcels is 160 acres . The intent is to maintain tracts which are large encough for farm purposes, and to assist in the encouragement of agricultural uses as the highest and best use of the land. It is a basic premise of the Weld County Comprehensive Plan that the County should not encourage the break up of agricultural land resulting in the loss of this land to urban pressures , but work towards preserving agri- cultural resources, promoting the agricultural economy and reducing conflicts between urban and rural uses in an agricultural area. The required minimum lot width for road frontage in the Agricultural Zone District is 180 feet as set forth in Section 3 . 14 of the Weld County Zoning Resolution. Section 9-4 A. (3) of the Weld County Sub- division Regulations states : "That the lots resulting from the proposed land division shall be accessible from an existing public road with a minimum frontage in conformance with the Weld County Zoning Resolution" The proposed western lot has no road frontage and is not accessible from an existing public road. Therefore, if this lot size variance is approved by the Board, the Platts should either show compliance with these regulations or obtain approval from the Weld County Board of Adjustment for variances from the regulations prior to approval of a recorded exemption on this property. To whom it may concern: This property is rolling, dryland which slopes down to the north and has a swale in the center causing considerable run-off and washing of seed when rain does come. I have tried to grow crops on this parcel, but due to the nature of the land and no irrigation water, I have been unable to harvest a usuable crop. I feel this land is unsuitable for farming.
