This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: CR 18.5 (CR 47.5) is a local gravel road and requires a 60 -foot right-of-way at full build out. There is presently a 60 -foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right- of-way line. CR 49 is an arterial road, which requires a 140 -foot right-of-way at full build out. There is presently a 80 - foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The applicant shall delineate an additional 30 -foot of right-of-way parallel to the WCR 49 right-of-way for full build -out. A complete access permit has been submitted for the proposed new access and has been forwarded onto the Traffic Engineer for review. The Traffic Engineer reviews all new accesses to ensure they are placed in a safe location in accordance with Chapter 12 Article IV of Weld County Code. Please label the approved access on the plat with approved access permit number once provided. Show on the plat 60ft radii access or an alternate turning template design adequate for large turning trucks. Show on the plat standard double cattle guards across the access to prevent the tracking of mud onto the County maintained gravel roadway. An Improvements Agreement between the Applicant and the County is required for this project. It will detail the approved haul route(s), any offsite requirements, and a maintenance agreement for the haul routes. The applicant provided a Traffic Impact Study (TIS) and agrees to construct improvements in accordance with the recommendations from the TIS. The offsite improvements to be constructed prior to operation are: 1) Design and constructed a paved roadway along CR 18.5 (CR 47.5) from CR 49 to the project access 2) Design and construct a left deceleration lane on CR 49 3) Design and construct a right deceleration lane on CR 49 4) Design and construct a right acceleration lane on CR 49 A right of way permit is required for any work within the County right of way. Final drainage related construction drawings are being developed by the Engineer. Public Works is working with the Engineer to finalize these items. A portion of the property lies in a Special Flood Hazard Area (SFHA) defined by the Federal Emergency Management Agency (FEMA). This SFHA is delineated on the current effective Flood Insurance Rating Map (FIRM), panel number #080266-0900C dated September 28, 1982. Portions of this lot located in the current effective FEMA 100-yr floodplain may not be buildable. Flood Hazard Development Permits are required for development in the floodplain. Should development occur in this area, please contact the Floodplain Administrator at 970-304-6496x3741. REQUIREMENTS: 1. Prior to recording the plat: A. Plat shall be amended to delineate the following: 1. County Road 18.5 (CR 47.5) is designated on the Weld County Road Classification Plan as a local gravel road, which requires 60 feet of right-of-way at full build -out. This road is maintained by Weld County. 3. Show the approved access on the plat and label with the approved access permit number (will be provided). 4. Show and label the floodplain and floodway (if applicable) boundaries on the plat. Label the floodplain boundaries with the FEMA Flood Zone and FEMA Map Panel Number. B. An accepted Final Drainage Report stamped and signed by a Professional Engineer registered in the State of Colorado is required. C. An improvements and road maintenance agreement for offsite improvements and road maintenance are required for this site. Required offsite improvements include: paving CR 18.5 (CR 47.5) from CR 49 to the project access, constructing a left deceleration lane and right acceleration and deceleration lanes on CR 49. Road maintenance includes damage repair. 2. Prior to Construction: A. If more than 1 acre is to be disturbed, a Weld County grading permit will be required prior to the start of construction. B. Right of way permit is required for any work within the public right of way. C. Special transport permit is required for any over size or over weight vehicles. 3. Prior to Operation: A. Accepted construction drawings for the offsite roadway improvements are required prior to operation. Development Standards (notes on the plat): 1. Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II, of the Weld County Code. 2. The historical flow patterns and runoff amounts will be maintained on the site. Weld County is not responsible for the maintenance of onsite drainage related features. 4. There shall be no parking or staging of vehicles on County roads. On -site parking shall be utilized. 5. All construction or improvements occurring in the floodplain as delineated on Federal Emergency Management Agency FIRM Community Panel Map #080266 0900C dated September 28, 1982, shall comply with the Flood Hazard Overlay District requirements of Chapter 23, Article V, Division 3 of the Weld County Code and all applicable FEMA regulations and requirements as described in 44 CFR parts 59, 60, and 65. 6. Flood hazard development permits are required for development activities located within the FEMA mapped Jim Creek Floodplain. The FEMA definition of development is any man-made change to improved or unimproved real estate, including by not limited to buildings or other structures, mining, dredging, filling, grading, paving, excavation, drilling operations, or storage of equipment and materials. 7. FEMA's floodplain boundaries may be updated at any time by FEMA. Prior to the start of any development activities, the owner should contact Weld County to determine if the floodplain boundaries have been modified. C:AUsers\kfordAAppDataALocalAMicrosoflIWindows\Temporary Internet FilesVContent.IE5VCBICX9TLVUSR13-0033%20cr49- 47%20injection[1 t.docx COLORADO Memorandum TO: Kim Ogle, Weld County Dept. of Planning Services FROM: Troy Swain, Weld County Dept. of Public Health & Environment, Environmental Health Division DATE: July 8, 2013 SUBJECT: Anadarko Non -Commercial Injection Well USR13-0033 The Department has reviewed the application for a Non -Commercial Class 11 Injection Disposal Well and recommends that the following be adopted as part of any approval: The Department recommends that the following requirements be met by the applicant prior to recording the plat: The applicant shall file an Air Pollution Emissions Notice (APEN) with the Air Pollution Control Division, Colorado Department of Public Health and Environment. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. The applicant shall submit a Groundwater Monitoring Plan to the Weld County Health Department of Public Health and Environment for review and approval. Evidence of Department approval shall be submitted in writing to the Weld County Department of Planning Services. The applicant shall submit a Waste Handling Plan to the Weld County Health Department of Public Health and Environment for review and approval. Evidence of Department approval shall be submitted in writing to the Weld County Department of Planning Services. The facility shall post financial assurance with the COGCC. The financial assurance shall be adequate to cover a third -party closure of the facility, including the plugging and abandonment of the well, in accordance with industry standards, and the removal of all structures (including concrete) on the facility. The site shall be returned to its original grade. The facility shall submit evidence to the WCDPHE that the appropriate financial assurance has been obtained. A Detailed Closure Plan shall be submitted to the Weld County Department of Public Health and Environment and the Colorado Oil and Gas Conservation Commission. The Closure Plan shall include a description of the manner in which the well will be plugged and abandoned, as well as specific details regarding reclamation of the property. No structures or equipment associated with the facility shall remain on the property following closure. (Department of Public Health and Environment) The Department recommends that the following requirements be met by the applicant prior to release of building permits: Detailed Plans for a concrete unloading pad shall be submitted for approval. A leak detection system shall be designed and installed beneath the concrete unloading pad(s) and sump(s). Plans shall be submitted to and approved by the Weld County Department of Public Health and Environment. Detailed plans for the concrete secondary containment structure for all storage and processing tanks shall be submitted for approval. Secondary containment volume shall provide containment for the entire contents of the largest single tank plus sufficient freeboard to allow for precipitation. The Weld County Department of Public Health and Environment will consider structures other than concrete, provided a Colorado Registered Professional Engineer provides a certification indicating that the proposed alternate containment system meets, or exceeds, the function of a concrete system with regard to containment, spills, and unintended releases. The Department recommends that the following requirements be incorporated into the permit as development standards: No disposal of waste other than produced and flowback wastewater from wells operated by the injection well operator are permitted. Any changes from this approved use may require an amendment to this Special Use Permit. Analytical data on wastes and environmental monitoring data shall be made available to WCDPHE, who reserves the right to require additional more extensive monitoring. The facility shall be constructed and operated to ensure that contamination of soil and groundwater does not occur. Portable containment, such as drip pans, shall be utilized when working outside containment areas. All liquid waste received at the facility shall be unloaded on the concrete unloading pad. The unloading pad and leak detection system shall be constructed and operated in accordance with the approved design. The unloading pad shall be cleaned at a frequently that prevents oil and other waste from building up on the pad. During winter months the pad shall be maintained free of ice. Any required Spill Prevention Control and Countermeasures Plan (SPCC) shall be prepared and maintained on site pr 40 CFR 112. All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. The maximum permissible noise level shall not exceed 70 dBA measured in accordance with Section 25-12-103 CRS. Fugitive particulate emissions (dust) shall be controlled on this site. The facility shall comply with Colorado Air Quality Control Commission Regulations and any air permits issued by the CDPHE Air Pollution Control Division. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored, treated, and removed for final disposal in a manner that protects against surface and groundwater contamination. Any contaminated soils on the facility shall be removed, treated or disposed of in accordance with all applicable rules and regulations. The facility shall comply with the approved groundwater monitoring plan. All storm water, which has come into contact with waste materials on the site, shall be confined on the site. Portable toilets may be utilized and shall be maintained in a sanitary condition. Dear Kim, The Planning Commission of the Town of Hudson met on Wednesday, June 12, 2013 to discuss the referral of the above referenced project. The referral was received on June I 0`". An ongoing concern of the Town is the impact of traffic accessing the burgeoning oil and gas activity inour community. The southern access route to the facility travels along CR 49 from the 1-76 interchange to the site. The one mile portion of that road between 1-76 and CR 18 is a Town street within the Hudson municipal limits. This section of CR 49 has been identified as "Commercial Streets" in the Town's Overweight Vehicle Ordinance. Therefore, we request that the applicant inform theirconstruction and operations contractors to contact the Town of Hudson to determine whether any vehicles involved in the project would require anOverweight Vehicle Permit. The 40 acre parcel within which this proposed facility is located is bounded on two sides by the Town boundaries. It is located on the only public access to our wastewater treatment facility. Our Planning Commission also has a concern with the effect of oil field wastes injected into the ground in and around the community. The application contained little information about the injection wells themselves. The Commission requested that the applicant provide us with a presentation of the process and effectsof the process at our next Planning Commission meeting, scheduled for July 10"', 7:00 PM at I Iudson Town Hall. Also, please advise as to the state and/or federal agencies that regulate such injection facilities. We arc pleased to hear that the County will be requiring that accel/decel and left turn lanes be added to CR49 to serve this site. The speed of the traffic and the poor sight distance at this location make these improvements a very positive addition to the roadway.
