HomeMy WebLinkAbout20132649.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO SEPTEMBER 18, 2013 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, September 18, 2013, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner William F. Garcia, Chair Commissioner Douglas Rademacher, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Susan Brown Director of Finance and Administration, Monica Mika MINUTES: Commissioner Conway moved to approve the minutes of the Board of County Commissioners meeting of September 16, 2013, as printed. Commissioner Kirkmeyer seconded the motion, and it carried unanimously. El CERTIFICATION OF HEARINGS: Commissioner Rademacher moved to approve the Certification of Hearings conducted on September 16, 2013, as follows: 1) Consider Service Plan for Platte Valley Recreation District. Commissioner Conway seconded the motion, which carried unanimously. AMENDMENTS TO AGENDA: Commissioner Rademacher moved to add the following as Item #4, under NEW BUSINESS: Authorization To Pay Building Permit, Plan Check, Drainage Impact, Septic and Demolition Fees Repairs and Reconstruction on Behalf of Weld County Property Owners Impacted by the 2013 Flood Emergency Disaster, and to delete Item #2, Revoke License Agreement with Charles Lee for Use at no Charge of Weld County Well Water in Keota, Colorado. Seconded by Commissioner Conway, the motion carried unanimously. CONSENT AGENDA: Commissioner Rademacher moved to approve the Consent Agenda as printed. Commissioner Conway seconded the motion, and it carried unanimously. PRESENTATIONS: 1) RECOGNITION OF SERVICES, COMMUNITY CORRECTIONS BOARD - ED PHILLIPSEN: Commissioner Conway thanked Mr. Phillipson, noting that he also served on the Greeley City Council Minutes, September 18, 2013 2013-2649 Page 1 BC0016 and the Greeley/Weld Airport Authority, he has really given a lot to this community and citizens of Weld County are grateful. Chair Garcia said that the criminal justice community also appreciated Mr. Philipson. Sharon Berhens accepted the certificate on his behalf. PUBLIC INPUT: Milt Tokunaga, Mayor of the Town of Milliken, thanked the County and the Board for all of their help during this flood event and for their continuing assistance. He said Milliken, with limited capacity and resources would not have been able to withstand this without the County's help. He reviewed some of the measures the County took to help out with access and logistics. Commissioner Rademacher thanked Mayor Tokunaga for having patience and the Mayor replied that the composure, resilience and resourcefulness from everyone have been inspiring. He said this type of event is affecting all of us and the County extended their limited resources to everyone as best as possible. Commissioner Conway noted that Commander Garcia has been of tremendous assistance in the EOC. Mayor Tokunaga said Mayor Holton in Fort Lupton has also been a great help. He thanked the Board for their loan of Janet Carter, Department of Public Works traffic engineer, who is a resident of Milliken, noting that her composure provided initial calm and stability for everyone and praised her competence. Commissioner Kirkmeyer also said last year the Board took people from around the County to training in Washington, D.C., with FEMA, and it really paid off. Commissioner Conway also thanked the Town Board of Milliken for providing good leadership; he said many of the Town's residents have lost everything, but their positive attitude is a reflection of their faith in their community and its leadership. Commissioner Kirkmeyer said she called Julie Cozad of Noble Energy, who immediately said they would take Milliken; Anadarko Petroleum Corporation served Firestone and Frederick. Noble Energy brought 10 trucks full of emergency supplies and water. Mayor Tokunaga expressed gratitude that the groundwork had already been laid for these relationships and so help was immediate when it was needed. Doug Meyer asked that the Board consider the mental health issues that will arise as a result of this flooding; he related a family story. Chair Garcia said that North Range Behavioral Health is at the shelter providing some of those services. Commissioner Conway said that one of the lessons learned from the Windsor Tornado was the need for mental health services, and he thanked Mr. Meyer for reminding the Board of that important aspect of the recovery process. COMMISSIONER COORDINATOR REPORTS: Commissioner Conway extended an invitation to the Public for two community forums, the first will be at the Rocky Mountain Christian Church at 6:00 p.m.; Commissioners will be there to listen to constituents and provide information. He reported the County is working hard to get all the roads opened and repaired; there were 140 roads impacted in Weld County. He mentioned that the Weld County Facebook page has received rave reviews, and Jennifer Finch as done a wonderful job. The other meeting is at the Weld County Administration Building at 6:30 p.m. He noted Commissioner Kirkmeyer attended the 1-25 Coalition Meeting with CDOT; obviously, this will take a backseat for some time in terms of the rebuilding process, but the groundwork is laid for long-term planning. Commissioner Rademacher said rather than try to name everyone; he thanks everyone for their great work, including the municipalities and state officials such as CDOT and the State Patrol. Commissioner Kirkmeyer agreed wholeheartedly and thanked all the staff that went above and beyond. She noted that the County took over dispatch on September 7, 2013, and has also done a fantastic job. She noted that Johnny Olsen, CDOT Engineer, is taking over disaster recovery operations for CDOT in this region. She said it was decided at the aforementioned meeting to put the 1-25 RAMP project on hold for eight months. Commissioner Freeman thanked Roy Rudisill, Director of Emergency Management, for his leadership, and Commissioner Conway thanked all the community organizations, private entities and churches that stepped up to provide emergency shelter. Minutes, September 18, 2013 2013-2649 Page 2 BC0016 BIDS: 1) APPROVE BID #B1300154, ONLINE TAX LIEN SALES - TREASURERS OFFICE: Rose Everitt, explained this is paid for by the investors at no cost to the County. Commissioner Rademacher moved to approve staff's recommendation. The motion was seconded by Commissioner Conway, and it carried unanimously. John Lefebvre, Treasurer, said the vendor who responded is the current vendor from a very limited pool of providers, and this vendor does the vast majority of the online auctions in the State of Colorado. He expressed satisfaction with Real Auction, Inc.'s services and the quality of their technology since 2006. El 2) PRESENT AND APPROVE BID #B1300164, DELINQUENT TAX LIST ADVERTISEMENT - TREASURER'S OFFICE: Mr. Lefebrve said this year the only bidder was the Greeley Tribune (the low bidder for several years) so the Treasurer's Office plans to contract for automatic renewal for the next five years. He said the Tribune puts the insert in all the other papers around the County as well, which is over and above requirements. Commissioner Conway moved to approve staff's recommendation and waive the ten-day waiting period. Seconded by Commissioner Freeman, the motion carried unanimously. NEW BUSINESS: El 1) CONSIDER NONEXCLUSIVE LICENSE AGREEMENT FOR UPGRADE AND MAINTENANCE OF CR 55 AND AUTHORIZE CHAIR TO SIGN - NOBLE ENERGY, INC.: Don Carroll, Department of Public Works, reviewed the location, noted that all adjacent property owners have been contacted with no responses, and requested approval. Commissioner Conway thanked Mr. Carroll for conscientiously working out issues with applicants and land owners before bringing these agreements before the Board. 2) CONSIDER ITEMIZED LIST OF LEGAL HOLIDAYS DURING CALENDAR YEAR 2014: Monica Mika, Director of Finance and Administration recommended approval of the 2014 staff holidays. Commissioner Kirkmeyer moved to approve said holiday list. Seconded by Commissioner Rademacher, the motion carried unanimously. `' 3) CONSIDER LICENSE AGREEMENT FOR USE OF COUNTY PROPERTY AND AUTHORIZE CHAIR TO SIGN - GREELEY-EVANS SCHOOL DISTRICT 6: Toby Taylor, Director of Buildings and Grounds, introduced Bob Billings, Coordinator of Schools for School District 6, who explained this is a cross-country race route. He said the Andy Meyers Invitational was historically run at Montfort Park, but their desire is to expand and improve the race; the route will be from Island Grove, 1.5 miles onto county land, then back to the Poudre Trail and Island Grove. Commissioner Conway said this could potentially become one of the premier youth events in the state. He mentioned that recently, due to weather and flooding a regional site has been compromised at Lyons and they may use this course as well. Commissioner Conway noted the liability issues are all worked out. Ms. Mika commented that the 5A Championship is looking at hosting the state cross-country meet using this course due to the conditions in Lyons, which would bring youth from around the state to Weld County. Commissioner Kirkmeyer moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner Conway, and it carried unanimously. 4) CONSIDER AUTHORIZATION TO PAY BUILDING PERMIT, PLAN CHECK, DRAINAGE IMPACT, SEPTIC AND DEMOLITION FEES REPAIRS AND RECONSTRUCTION ON BEHALF OF WELD COUNTY PROPERTY OWNERS IMPACTED BY THE 2013 FLOOD EMERGENCY DISASTER: Tom Parko, Director of Planning Services, said this resolution will help flood victims by offsetting these fees, which would be an added burden after all this chaos and damage. Commissioner Kirkmeyer noted that citizens have paid these fees up front and shouldn't have to pay them again due to a Minutes, September 18, 2013 2013-2649 Page 3 BC0016 disaster. Commissioner Conway thanked the Planning Department for bringing this idea forward in such a timely manner, noting this is not the norm; Weld County is probably the first to do this and it is a good way to signal the start of recovery. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
