Upon motion lily made and seconded, it was
RESOLVED, that the Board of County Commissioners
of Weld County, Colorado, sign easement with Edwin C. Schmidt & Emma
E. Schmidt for gravel pit located in Wk Section 30, Township 3 North,
Range 66 West containing 1.75 acres more or less.

The resolution was unanimously adopted.

A tract of land located in the West Half of Section 30, Twp 3 North, Range 66 West,
of the 6th P.M. Weld County, Colorado, described as follows:
Commending at the Northwest corner of old Ft Vasquez as now reconstructed, thence
North 14 feet to the north boundary fence line of said Ft Vasquez tract, thence, West
projecting said North fence line to the West a distance of 270 feet to the place of
beginning, said point of beginning being 50 feet westerly from the westerly right-of-way
of US Highway No. 85, running thence from said point of beginning southeasterly 400
feet parallel with said westerly right-of-way line of said Highway, thence West 192
feet, parallel with the said north boundary line of said Ft Vasquez tract, thence
northwesterly 400 feet, parallel with the said westerly right-of-way line of said

Obis Agreemrnt, Made this 28th day of May A. D. 19 48 ,
by and between Edwin C. Schmidt & Emma E. Schmidt, Platteville
of Weld County, Colorado, part ies of the first part, and The County of Weld, in the State of Colorado,
a municipality, party of the second part:
WITNESSETH: The parties of the first part, for and in consideration of
Three Hundred Fifty and No/100 Dollars,
to first part ies in hand paid by the party of the second part, the receipt whereof is hereby confessed
and acknowledged, do hereby bargain, sell and convey unto the party of the second part, its succes-
sors and assigns, the right to remove all gravel, sand and road-making and building material which it
shall he able to remove from the following described lands, situate in the County of Weld and State of
Colorado, to-wit:
A tract of land located in the West It of Sec. 30, Twp. 3 North, Range 66 best
of the 6th P. M. , Weld County, Colorado, described as follows; re

The County of Weld, as a further consideration for this Deed and by acceptance thereof, agrees
that said tract of land shall be excluded from further assessment for taxes; the first part ies hereby
granting to the party of the second part the right to enter upon said lands at any time hereafter and to
excavate and remove therefrom all gravel, sand and earthen material which it shall find suitable to its
needs, together with the rights and privileges incident to the proper enjoyment thereof.
This instrument shall give no title to said land, and shall only give the right to remove therefrom
the part of the surface thereof as hereinabove set forth. This contract shall be binding upon and inure
to the benefit of the heirs, administrators, and assigns of the rt iesof the part, and the succes-
sors and assigns of the party of the second part. il
