WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the City of Greeley, Colorado and the County of Weld desire to enter into a joint effort of combining forensic services of the Greeley Police Department with those of the Weld County Sheriff' s Office, and WHEREAS, this joint effort is for the purpose of improving both the quantity and quality of forensic services available to both the County and the City, and WHEREAS, the Board of County Commissioners deems it advisable and in the best interest of Weld County, Colorado, to enter into such an agreement, a copy of which is attached hereto and incor- porated herein by this reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that said Board does approve of the Agreement by and between the City of Greeley, Colorado and the County of Weld, and authorizes the Chairman of the Board to execute the same. Designated Name. The combined forensic services of the Weld County Sheriff and the Greeley Police Department shall be entitled "Weld County Forensic Services" . 2. Term. The term of this Agreement shall be for one year, commencing on June 1, 1978 , through June 1, 1979 , and to continue from year to year thereafter unless sooner terminated by either party giving written notice to the other party at least thirty (30) days prior to the end of the term. 3. Premises. The County shall provide suitable space at the Weld County Law Enforcement Building for the operations of the Weld County Forensic Services. 4. Personnel. The Weld County Forensic Services shall con- sist of three officers - one from the Weld County Sheriff' s office and two from the Greeley Police Department. All three officers shall be deputized by the Weld County Sheriff in order that all shall have county-wide jurisdiction. When time is available all three officers shall assist each other even if the case involved is in the jurisdiction of the other de- partment. Officers shall work a standard eight hour shift, five days a week. Salaries, overtime, vacation, workman' s compensation, and other employee policy matters shall be in accordance with those policies of each officer ' s respective employer. 5. Chain of Command. All matters shall be handled in accord- ance with the chain of command as outlined in the organizational chart below. The Sergeant of the Investigaton Division of the Weld County Sheriff ' s Office shall be the first line supervisor of the Weld County Forensic Services. Any matters that cannot be handled at this level shall be handled jointly by the Lieutenant of Investigation of the Weld County Sheriff ' s Office and the Lieutenant of Investigation of the Greeley Police Department. Any matters that cannot be handled at this level shall be handled jointly in the same manner at the next higher level of the chain of command. CAPTAIN CAPTAIN GREELEY P.D. WELD COUNTY S.O. On Call Schedule (off duty hours) . The Sergeant of the Investigation Division of the Weld County Sheriff ' s Office shall be responsible for setting the "on call schedule" . The Weld County Sheriff ' s officer shall be responsible for responding to calls handled by the Weld County Sheriff relating to forensic services . The Greeley Police Department' s junior officer shall be responsible for responding to calls handled by the Greeley Police Department relating to forensic services. The Greeley Police Department 's senior officer shall be on call respectively for either the Weld County Sheriff or the Greeley Police Department when one of the other officers is not on call. 7 . Operation Equipment. All equipment needed to operate the Forensic Services shall be supplied by the County and the City. This equipment will consist of equipment currently used by the technical services sections of the Weld County Sheriff ' s Office and the Greeley Police Department and the equipment which is budgeted by each for the year 1978 and that which may be budgeted for -2- suceeding years while this Agreement is in effect. 8. Budget and Supplies. The Weld County Sheriff ' s Office and the Greeley Police Department shall each maintain its own budget and all supplies shall be purchased separately by each, according to what each feels that it will use. All items pur- chased will be marked with the name of each department. 9. Officer Responsibilities. a. All officers are responsible for booking and releasing evidence. A twenty-four (24) hour advance notice shall be required for the release of evidence. An individual requesting the release of evidence shall be required to make an appointment prior to release. b. Photography. The City' s junior officer and the County' s officer are responsible for all lab photography. The City' s junior officer is responsible for field photography in the City of Greeley and the County' s officer is respon- sible for field photography within Weld County, excluding the City of Greeley. c. Fingerprinting. The City' s senior officer has the main responsibility for fingerprinting in the lab (approximately 85%) while the County' s officer and the City' s junior officer have secondary responsibility. d. Analysis. The City' s senior officer is responsible for all analysis in the lab. 10 . Default. Should either party breach any term of this Agreement, then the other party may terminate the Agreement by serving thirty (30) days prior written notice on the defaulting party. 11. Notices. WHEREAS , the City and the County are both engaged in providing forensic services ; and WHEREAS, the City and the County can provide more efficient and economical forensic services by combining such services into one operation ; and WHEREAS, it is the finding of the City Council of the City of Greeley , Colorado that the attached agreement will facilitate this objective . NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GREELEY, COLORADO: Section 1. Pursuant to Section 3-7 of the Greeley Charter the Mayor and appropriate City officials are hereby authorized to enter into an agreement with Weld County to provide forensic services. Said agreement shall establish the Weld County Forensic Services to be administered by the Greeley Police Department and the Weld County Sheriff's Office. Said agreement is attached hereto and incorpora- ted herein by reference. Section 2 . This ordinance shall become effective five (5) days after its final publication as provided in Sections 3-16 and 3-17 of the Greeley Charter.
