INDIVIDUAL SEWAGE DISPOSAL SYSTEM - RANDOLPH AND JUDY CASS, C/O
STEVEN AND CHRIS SCHULTZ
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, pursuant to Section 2-4-10 of the Weld County Code, the Board of County
Commissioners has received an appeal from Randolph and Judy Cass, c/o Steven and Chris
Schultz, 34978 County Road 83, Briggsdale, Colorado 80611, concerning the decision by the Board
of Public Health to deny the Variance Request for an Individual Sewage Disposal System to be
located at 37967 Highway 14, Briggsdale, Colorado 80611, and
WHEREAS, upon consideration of such appeal, including a review of all information
submitted by the appellant and the Board of Public Health, the Board deems it advisable to grant the
appeal of Randolph and Judy Cass, c/o Steven and Chris Schultz, based on the finding that raising
the system would pose an economic hardship to new business owners, there are no immediate or
serious health risks, the water table is deep, and the appellants are moving forward fully informed of
the risks of taking no corrective action.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the decision of the Board of Public Health be, and hereby is, waived and the
appeal of Randolph and Judy Cass, do Steven and Chris Schultz, be, and hereby is, granted.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 10th day of April, A.D., 2013.

Please accept this request for an appeal hearing due to the denial of a variance by the Weld County
Board of Health on the above referenced septic permit. The variance is requested because the
installation of a new septic system, installed as a rehab for the older home, is in excess of four feet
below the surface, due to the location and terrain of the property. The contractor who installed the
system has experience with installing deeper systems in the Briggsdale area. The installation was not for
economic gain but installed as it was because of the location of the house, the fence and where the
plumbing exits the residence.
The static water table at the water well is 137 feet deep and the well is cased to a depth of 123 feet.
The water table is not an issue in this matter.

This is to inform you that your Individual Sewage Disposal System Variance Request has been
reviewed and denied as submitted.
The variance request was Sewage Disposal Regulations iand Environmental Health Services ed based uon the following Sections of the Weld County Individual
Policy:
1. Weld County Code Section 30-5-40 B and C. Absorption trench or bed construction:
... shall be constructed with a depth not exceeding three (3) feet to the bottom of the
excavated trench or bed from existing ground level.
2. Per Environmental Health Services Policy (10/01/02), the maximum
depth allowed for repairs is 4 ft. providing the bottom of the absorption field is not
within 4 ft. of groundwater or limiting layer.
3. Weld County Code Section 30-9-50. Prohibitions on granting of variance requests:
A. No variance will be issued to mitigate an error in construction involving any element
of property improvements.
B. No variance will be issued where the property can accommodate a conforming
ISDS.
4. Weld County Code Section 30-9-20. Requirements for variance consideration:

Dear Sir:
On March 5, 2013, I preformed an inspection of the soil profile at the subject site.
I observed that the infiltrator system, as installed, is 6' below the existing ground elevation,
which is deeper than permitted by Weld County Code, Chapter 30.
The profile hole was dug next to the trench system/infiltrator located on the south eastern
portion of the absorption system. The depth of the profile hole is 10' 2". No ground water was
observed at 10' 2". Instructions were given to not back -fill the profile hole to allow the Weld County
Health and Environment an opportunity to perform their inspection. The surrounding agricultural
practice is ranching and winter wheat. Little to no irrigation is preformed in the surrounding area.
Agricultural practices in the surrounding area do not impact the ground water tables in the area.
From field observations, a minimum 4 feet of separation exist between the bottom of the infiltrators
and the ground water table.
The soil profile is consistent with the observed soil profile as observed on October 22, 2012.
The soil present at 6' is sand/sandy loam. The expected percolation rate of this soil would be
between 10 to 15 min./in. which is faster than the design percolation rate of 20 min./in. from the
septic design dated October 22, 2013.
The absorption system, as built, is adequate for the three (3) bedroom home.

TERMS AND CONDITIONS
A permit fee, as set by separate ordiance of the Board of Weld County Commissioners, shall be required of applicants for new individual
sewage disposal systems (1508), payable at time of application. Permit fen are non-refundable: permit applications are
nen-transferable. It both a building permit and an 1505 are issued for the same property and construction is not commenced pror to the
expiration date of the building permit, the ISDS permit shall expire at the same lime as the building permit If an ISDS permit is issued for a
properly that does not require a building permit, the ISDS permit shall expire one year after its issuance if construction on the septic system
has not commenced Any change in plans or apeoicatione alter the permit has been issued invalidates the permit unless approval is
secured from the Health Officer or hiamer designated agent. Expired permits can be renewed by payment of the permit fee only it

change is reviewed and approved by a Division Represenlative.
B. The surrounding land. its use or zoning has not changed so -as -to cause the original application not to be acceptable under these

The completeness of this application is conditional upon further mandatory and additional tests and reports as may be required by the Weld
County Department of Public Health and Environment (WCOPHE). The issuance of the permit is subject to such terms and conditions as
deemed necessary to insure compliance with rules and regulations adopted under article 10 title 25. CRS as amended. The applicant cornea

The following septic design for Randolph & Judy Cass is submitted for your review and approval.
1. I preformed a percolation test for the site on October 22, 2012 and the percolation rate
obtained was 15.16 Min./in., use 20 min./in for design, see attached computations. The
soil profile is as follows: 0" - 11" Top Soil, 11" - 31" Sandy Loam, 31"- 45" sandy silt and
black clay, 45" - 63" Sandy Silt with a Trace of clay, 63"-96" Sand/Sandy Loam. No limiting
layer in the soil to be used for absorption trench was observed and no groundwater was
observed in the soil profile pit.
2. For a three (3) bedroom house, 287 SF of trench absorption, Table 30-2, is required for each
bedroom. The required square footage of absorption trench is 861 SF, 3 * 287 = 861 SF.
Quick 4 Infiltrators will be used at the site, reduction factor = 0.5, 861 * 0.5 = 430.5 SF, and
a minimum of 47 Quick 4 Infiltrators will be used, 430.5 /9.2 = 46.8 units, use a
minimum of 47 infiltrator units. The absorption trench configuration shall be built to fit the
existing site conditions.
3. The existing 1000 gallon septic tank is in poor condition. A new 1000 gallon septic will be
required per Table 30-1.
4. The absorption field and septic tank shall be constructed and installed in accordance with
Weld County Health Department regulations.
5. The absorption bed/trench shall be place a minimum of 100 feet from any existing water
well.
6. No traffic shall be permitted on the new absorption field after construction.
