HomeMy WebLinkAbout20130222.tiffRESOLUTION RE: APPROVE RESCINDING DOCUMENT #2012-3277, DATED NOVEMBER 19, 2012, CONCERNING SMALL TRACT OIL AND GAS LEASE -- AED GROUP, LLC WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on November 19, 2012, by Resolution #2012-3277, the Board approved Small Tract Oil and Gas Lease with AED Group, LLC, and WHEREAS, it was later determined that this was a duplicate lease for 2.42 mineral acres already held by a different company pursuant to a lease approved on September 17, 2012, located in the S1/2 of Section 24, Township 8 North, Range 62 West of the 6th P.M., Weld County, Colorado, and WHEREAS, after review, the Board deems it advisable to rescind Document #2012-3277 and refund the bonus amount. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Small Tract Oil and Gas Lease with AED Group, LLC, be, and hereby is, rescinded, Commissioner Conway's signature is nullified, and staff is directed to issue a refund of the bonus payment, in the amount of $968.00. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 21st day of January, A.D., 2013. Lang Stephanie Arries; Esther Gesick RE: Small Tract Leases - S23 and S24, T8N, R62W I'm writing to inform you that unfortunately the miscommunication between you and myself, concerning the amount of mineral acreage, resulted in a delay in submittal of the appropriate paperwork and there is already a lease in the 51/2 of Section 24 (2.42 acres) which predates the lease with AED. As such, I need to get the duplicate lease rescinded and will be issuing a bonus refund, in the amount of $968.00. For future reference, you may use the Small Tract Lease form for any parcels you which to pursue which are five acres or less. If the mineral interest exceeds five acres, then you will need to nominate the parcel for the next scheduled public auction. Lang' Subject: FW: Small Tract Leases - S23 and 524, T8N, R62W Stephanie, The attached e -mails document Mr. Lang's initial inquiry in August; however, I did not do any property research at the time because I was not intending to schedule an auction until later in the fall and was probably just going on the assumption that the 51/2 entailed more than a S -acre tract. Regardless, due to the oversight/misunderstanding another company did approach us in September and subsequently leased the parcel Mr. Lang was interested in. Due to the typo (which has been corrected in document #2012-2517) our research did not catch the existing lease in 524 which resulted in a duplicate lease to AED in November under document #2012-3277. Unless you wish to discuss the matter of the timing further with the County Attorney's Office, I will work to get the duplicate lease rescinded and issue a refund of the bonus payment.
