RE: APPROVE REQUEST CONCERNING DELETION OF CONDITIONS OF APPROVAL #2.D,
#2.E, #3.8, AND #4.A, AND DEVELOPMENT STANDARDS #27, #28, #29, #30, AND #31
FOR AMENDED USE BY SPECIAL REVIEW PERMIT #1102 - L.G. EVERIST, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on May 18, 2011, the Board of County Commissioners approved the application
of L.G. Everist, Inc., P.O. Box 5829, Sioux Falls, South Dakota 87117, for a Site Specific
Development Plan and Amended Use by Special Review Permit #1102 for a Mineral Resource
Development including Open Pit Mining and Materials Processing (sand, gravel and stone),
including concrete and asphalt recycling and a concrete and asphalt batch plant facility in the
A (Agricultural) Zone District, on the following described real estate, being more particularly
described as follows:
Part of Section 32, Township 3 North, Range 67 West
of the 6th P.M., Weld County, Colorado
WHEREAS, the request to the Board of County Commissioners for deletion of Conditions of
Approval #2.D, #2.E, #3.B, and #4.A and Development Standards #27, #28, #29, #30, and #31 for
AmUSR #1102, was submitted by Lynn Mayer Shults, Regulatory Manager of L.G. Everist, Inc., due
to the acceptance and approval of the Letter of Map Revision (LOMR) by the Federal Emergency
Management Agency (FEMA) which removes the entire L.G. Everist Firestone Resource Pit from the
St. Vrain River floodplain and eliminates the needs for said Conditions of Approval and
Development Standards, and
WHEREAS, the Board of County Commissioners heard all the testimony and statements of
those present, studied the request of the applicant and the recommendations of the Weld County
Department of Planning Services and, having been fully informed, finds that this request shall be
approved and the following shall be deleted:
Condition of Approval #2.D - The boundaries of the FEMA approved floodplain shall be
visible on all drawings.
Condition of Approval #2.E -A portion of the site is located within the FEMA mapped Zone A
100 -Year Floodplain and/or possibly the floodway. The Weld County Code prohibits the
construction of buildings within the floodway. The applicant has stated that no new
structures will be built. Any stockpiling of materials in the floodplain will require a Flood
Hazard Development Permit.
Condition of Approval #3.B - The applicant shall provide evidence of an approved Amended
Flood Hazard Permit from the Department of Public Works to the Department of Planning
Services.

Condition of Approval #4.A - The applicant shall address the issue of the railroad
embankment. The current effective Flood Insurance Rate Map (FIRM) appears to show that
the railroad embankment is the eastern boundary of the floodplain. It appears that the
applicant plans to remove the railroad embankment during mining operations. It stands to
reason, that removing the railroad embankment will extend the floodplain boundaries to the
east; therefore, the applicant needs to show what the impact of removing the railroad
embankment will be on the floodplain. Pursuant to the letter from FEMA, dated January 13,
2011, a Letter of Map Revision will need to be issued by FEMA prior to release from DRMS.
Development Standard #27 - WARNING: LOT MAY NOT BE BUILDABLE DUE TO
FLOODPLAIN OR FLOODWAY DESIGNATION. Please be advised that owners of Parcels
#120932000027, #120932000032, #120932000031, and #120932000035 may not be able
to obtain building permits to construct structures. All construction or improvements occurring
in the floodplain, as delineated on the FEMA FIRM Community Panel Map #808266-0855C,
dated September 28, 1982, shall comply with the Flood Hazard Overlay District requirements
of Chapter 23, Article V, Division 3 of the Weld County Code, and all applicable FEMA
regulations and requirements as described in 44 CFR parts 59, 60, and 65.
Development Standard #28 - Flood hazard development permits will be required for
development activities located within the FEMA mapped Saint Vrain River Floodplain.
Development Standard #29 - The installation of any septic system within the 100 -year
floodplain shall comply with the Weld County I.S.D.S. Floodplain Policy. In accordance with
the State of Colorado I.S.D.S. Regulations, no septic system shall be installed within the
floodway.
Development Standard #30 - Future development occurring within the floodplain shall be in
compliance with the floodplain codes in effect at that time.
Development Standard #31 - The applicant shall comply with County and FEMA floodplain
regulations and obtain a Letter of Map Revision (LOMR) from FEMA prior to the release from
DRMS.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request of L.G. Everist, Inc., to delete the Conditions of Approval and
Development Standards listed above, for Amended Use by Special Review #1102, be, and hereby
is, approved.

L.G. Everist, Inc. contacted the Department of Planning Services by electronic mail on
September 5, 2013 requesting reconsideration of four (4) Conditions of Approval and five (5)
Development Standards for AmUSR-1102 approved by the Board of County Commissioners on
May 18, 2011 fora Site Specific Development Plan and Amended Use by Special Review
Permit #1102 for a Mineral Resource Development, including open pit mining and materials
processing (sand, gravel and stone), including concrete and asphalt recycling and a concrete
and asphalt batch plant facility in the A (Agricultural) zone district.
The Conditions of Approval and Development Standards are specific to the St. Vrain River
floodplain. Mr. Clay Kimmi, Weld County Floodplain Administrator in his letter dated March 8,
2013 to Lynn Shults, Regulatory Manager for L.G. Everist, Inc. stated that on December 20,
2012, the Federal Emergency Management Agency (FEMA) approved Letter of Map Revision
(LOMR) Case number 12-08-0745P that will be effective May 3, 2013. The LOMR removes the
entire L.G. Everist Firestone Resource Pit from the St. Vrain River floodplain. Since the gravel
pit is no longer in a FEMA mapped floodplain, the federal, state, and local floodplain regulations
do not apply.
Given the acceptance and approval of the LOMR, and Mr. Kimmi's March 8, 2013 letter, the
applicant is requesting the following Conditions of Approval be considered for elimination:
Under the heading of the plat shall be amended to delineate the following:
Condition of Approval 2.D states
"Please show the boundaries of the FEMA approved floodplain on all drawings." (Department of

Condition of Approval 2.E states

DESIGNATION. Please be advised that owners of Parcels # 120932000027, #120932000032,
#120932000031, & #120932000035 may not be able to obtain building permits to construct

Thank you for the finalized Firestone Road Improvements Agreement. Now we can finalize the whole
USR, finally!
So, as we discussed last week, here are the Firestone plat maps (attached) with any floodplain
references marked in RED as a suggestion to take out. (see Steve O'Brian's email below). I have also
included the Resolution (attached) and crossed out various paragraphs there as "revision
suggestions". Maybe the resolutions doesn't get changed, but amended? Or however it needs to work
as per Weld County protocol.

APPLICABLE NFIP .REGULATIONS/CONIMUNITY OBLIGATION
We have made this determination pursuant to Section 206 of the Flood Disaster Protection Act of 1973 (P.L. 93-234) and in accordance with
the National Flood Insurance Act of 1968, as amended (Title XIII of the Housing and Urban Development Act of 1968, P.L. 90-448), 42
U.S.C. 4001-4128, and 44 CFR Part 65. Pursuant to Section 1361 of the National Flood Insurance Act of 1968, as amended, communities
participating in the NFIP are required to adopt and enforce floodplain management regulations that meet or exceed NFIP criteria. These
criteria, including adoption of the FIS report and FIRM, and the modifications made by this LOMR, are the minimum requirements for
continued NFIP participation and do not supersede more stringent State/Commonwealth or local requirements to which the regulations
apply.
We provide the floodway designation to your community as a tool to regulate floodplain development. Therefore, the floodway revision
we have described in this letter, while acceptable to us, must also be acceptable to your community and adopted by appropriate community
action, as specified in Paragraph 60,3(d) of the NFIP regulations.
COMMUNITY REMINDERS
We based this determination on the base (1 -percent -annual -chance) flood discharges computed in the FIS for your community without
considering subsequent changes in watershed characteristics that could increase flood discharges. Future development of projects
upstream could cause increased flood discharges, which could cause increased flood hazards. A comprehensive restudy of your
community's flood hazards would consider the cumulative effects of development on flood discharges subsequent to the publication of the
FIS report for your community and could, therefore, establish greater flood hazards in this area.
Your community must regulate all proposed floodplain development and ensure that permits required by Federal and/or
State/Commonwealth law have been obtained. State/Commonwealth or community officials, based on knowledge of local conditions and
in the interest of safety, may set higher standards for construction or may limit development in floodplain areas, If your
State/Commonwealth or community has adopted more restrictive or comprehensive floodplain management criteria, those criteria take
precedence over the minimum NFIP requirements.
We will not print and distribute this LOMR to primary users, such as local insurance agents or mortgage lenders; instead, the community
will serve as a repository for the new data. We encourage you to disseminate the information in this LOMR by preparing a news release for
publication in your community's newspaper that describes the revision and explains how your community will provide the data and help
interpret the NF1P maps. In that way, interested persons, such as property owners. insurance agents, and mortgage lenders, can benefit
from the information.

We are processing a FIRM and FIS report for Weld County, Colorado, and its incorporated areas in our countywide format; therefore, we
will not physically revise and republish the FIRM for your community to incorporate the modifications made by this LOMR at this time.
Preliminary copies of the countywide FIRM and FIS report, which present information from the effective FIRMs and FIS reports for your
community and other incorporated communities in Weld County, will be distributed in approximately two months. At this point, it is
unknown when the countywide FIRM and FIS report will become effective. Therefore, the modifications made by this LOMR will either
be superseded when the countywide FIRM and FIS report become effective or will be incorporated into the countywide FIRM and FIS
report before they become effective. If the modifications made by this LOMR are not incorporated into the countywide FIRM and FIS
report, then we will reissue this LOMR after the effective date of the countywide FIRM and FIS report.
As part of this revision, the format of the map panels has changed. Previously, flood hazard information was shown on both the FIRM and
the Flood Boundary and Floodway Map (FBFM). In the new format, all BFEs, cross sections. zone designations, and floodplain and
floodway boundary delineations are shown on the FIRM, and the FBFM has been eliminated. Some of the flood insurance zone
designations were changed to reflect the new format. Areas previously shown as numbered Zone A were changed to Zone AE. Areas
previously shown as Zone B were changed to Zone X (shaded). Areas previously shown as Zone C were changed to Zone X (unshaded).
This determination is based on the flood data presently available. The enclosed documents provide additional information regarding this determination. If you have any
