SUBJECT: USR13-0014, UFI Feeding (Beall -Sports Complex)
The Weld County Public Works Department reviewed the submitted application for critical items,
including but not limited to Site Plan, Traffic Study, Preliminary Drainage Report, Geotechnical Soils
Report, and Flood Hazard Development Permit. A detailed review of these items was not completed at
this step in process. Comments made during this stage of the review process will not be all inclusive;
as revised materials are submitted other concerns or issues may arise. All issues of concern and
critical issues during further review must be resolved with the Public Works Department.
COMMENTS:
CR 46 is a local gravel road and requires a 60 -foot right-of-way at full build out. There is presently a
60 -foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK
in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way
line.
CR 13 is an arterial road and requires a 140 -foot right-of-way at full build out. There is presently a 60 -
foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in
the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
IMPROVEMENTS AGREEMENT:
This Use by Special Review will be subject to a designated Traffic route (CR 46) and any intersection
improvements such as adequate turning radiuses, dust control if needed, on -site improvements or
upgrades necessary to accommodate this type of use.
TRAFFIC STUDY:
The applicant has provided some traffic information for the Sports Complex facility prepared by AGPRO
fessionals. After reviewing the information, I have prepared the following comments:
1. The applicant is proposing approximately 254 round trips per day to the facility at final build out
and 134 in short term traffic. Due to the large amount of traffic to the facility a Traffic Study will
be required.
2. Public Works staff has identified the Traffic Route for this facility: from the entrance east on CR
46, ''A mile to the paved portion of CR 13.
3. Roadways Improvements may be triggered due to traffic associated with the facility:
a. Full Depth Mag-Chloride will be required when the traffic volumes reach 200 vpd.
b. CTB (Concrete Treated Base) with a Chip Seal or RAP is required when the traffic
volumes reach 300 vpd.
c. Pavement is required when the traffic volumes reach 500 vpd.

4. Turn lanes will be triggered once traffic volumes meet the following warrants:
a. 25 vph turning right into the facility during a peak hour.
b. 10 vph turning left into the facility during a peak hour.
c. 50 vph turning right out of the facility during a peak hour.
5. A stop sign will be required to be installed at the facility access onto CR 46.
6. The access will have 45' radius to accommodate entering and exiting the site. This is reduced
from 60' because there is no truck traffic to the facility.
7. No parking or staging of vehicles on the county road is allowed. Use on -site parking area.
DRAINAGE:
The applicant has provided water quality feature calculations for the Beall Sports Complex project.
Stormwater runoff from the parking lot and buildings must be captured by the water quality feature. The
water quality feature as shown on the map provided does not appear to capture stormwater runoff from
the development. Please address. Show on the plat a scale, flow arrows, flow arrows showing how
water gets to water quality feature, any necessary swales, elevations of topographic lines and property
boundaries.
Grading Permit: Prior to recording of the final plat, the applicant needs to submit a grading permit
showing: proposed grading, erosion control placement, typical details for all BMPs to be utilized, and a
Construction Stormwater permit from the Colorado Department of Public Health and Environment. The
permit must be stamped by a registered professional engineer licensed in the State of Colorado.
Please note that the grading permit will not be released until the applicant has signed the improvements
agreement, posted collateral, and submitted the final plat for recording.
Flood Hazard Development Standards: This area IS NOT in a Special Flood Hazard Area (SFHA) as
determined by the Federal Emergency Management Agency (FEMA).
Noxious Weeds: Should noxious weeds exist on the property or become established as a result of the
proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Section 15-1-180 of the Weld County Code.
Easement: The applicant shall place on the plat drawing: 30 -foot access easement across the SE Lot
for the benefit of USR13-0014.

Environmental Health Services has reviewed this proposal for a use permitted as a
Use by Right, an Accessory Use, or a Use by Special Review in the Commercial or
Industrial Zone Districts, (batting cages, gymnastics facility and baseball fields), in the A
(Agricultural) Zone District.
The gymnastics facility will be constructed with an attached three bedroom residence.
Little Thompson Water District will provide water to the facility and has submitted a will
serve letter with specific conditions.
An engineer designed septic system will be installed. The Board of Health approved a
septic system designed for a 3 bedroom residence and a gymnastics facility for up to 83
persons @ 15 gpd/person, without showers, on March 26, 2013. If there are changes to
the number of people utilizing the facility a revised engineer design is required. A Class
V injection well permit is required for any septic system which serves 20 or more people
a day. The application did not specify if people using the baseball field will use the
gymnastics facility for restrooms. A new engineer designed septic system can be
installed for the baseball fields if needed.
The dust abatement plan indicates that gravel and/or road base will be used at the
entrance, internal roads and parking areas. A water truck will be utilized if necessary.
The waste handling plan indicates there will be a dumpster provided which will be
serviced by a local disposal company such as B&C Refuse.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to the issuance of the Certificate of Occupancy:
1. An individual sewage disposal system is required for the proposed facility and
shall be installed according to the Weld County Individual Sewage Disposal
Regulations.
2. The applicant shall submit evidence of an Underground Injection Control (UIC)
Class V Injection Well permit from the Environmental Protection Agency (EPA)
for any large -capacity septic system (a septic system with the capacity to serve
20 or more persons per day). Alternately, the applicant can provide evidence
from the EPA that they are not subject to the EPA Class V requirements.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions. The facility shall operate in accordance with the approved
"waste handling plan", at all times.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
5. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in Section 14-9-30 of the Weld County Code.
6. Adequate drinking, hand washing and toilet facilities shall be provided for
employees and patrons of the facility, at all times.
7. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
8. The facility shall utilize the existing public water supply. (Little Thompson Water
District)

9. The applicant shall obtain a Colorado Discharge Permit System or CDPS permit
from the Colorado Department of Public Health and Environment (CDPH&E),
Water Quality Control Division, as applicable.
10. The applicant shall comply with Colorado Retail Food Establishment Rules and
Regulations governing the regulation of food service establishments.
11. The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

After reviewing the application for a change of use from Ag-Exempt structure to an A-3 /R-3
Occupancy the Building Department has the following comments:
A building permit will be required for any new construction, alteration, or addition to any
buildings or structures on the property. A building permit application must be completed and
two complete sets of engineered plans including engineered foundation plans bearing the wet
stamp of a Colorado registered architect or engineer must be submitted. A geotechnical
engineering report performed by a registered State of Colorado engineer shall be required or a
open hole inspection.
Buildings, equipment and structures shall conform to the requirements of the various codes
adopted at the time of permit application. Currently the following has been adopted by Weld
County: 2012 International Building Code; 2012 International Mechanical Code; 2012
International Plumbing Code: 2012 International Energy Code; 2006 International Fuel Gas
Code; 2011 National Electrical Code; 2009 ANSI 117.1 Accessibility Code the 2012
International Plumbing Code. and Chapter 29 of the Weld County Code.
A plan review shall be approved and a permit must be issued prior to the start of construction.

The property is located within the Town of Johnstown Comprehensive Planning Area, but is not
contiguous to Town limits. The Town does not anticipate additional annexations in this area in
the foreseeable future. The Town does not extend utilities to non -annexed properties.
The proposed recreation complex would have several potential impacts on the general area, as
follows:
Measure to manage additional traffic and access to I-25 Frontage Road or CR 13;
Dust control or pavement on the unpaved roadway;
Complex exterior lighting;
Security/crowd management at tournaments or other major events.

The Johnstown Fire Protection District has met with the owner, Rex Beall on several
occasions to discuss fire department requirements for the proposed complex. The
owner has hired a fire sprinkler company and plans have been submitted to the Fire
Department for review.
