(a)Legal description ne 'A, ne 1/4, section 16, T7N, R59W 6th PM (b) main entrance location: 40.3446700 N, 103.58258800 W EXHIBIT B SITE DESCRIPTION FOR THE GOODMILLER PIT APPLICATION SUBMITTED BY VESCO CONSULTING SERVICES, LLC This property is located in the nw' of section 16, T7N, R59W, of the 6th PM. The site is owned and managed by the Colorado State Board of Land Commissioners, 1127 Sherman St. #300, Denver, Co. The land is currently rangeland used as pasture and leased to a local rancher for that purpose. (a) The site was previously mined for sand and gravel and partially reclaimed after mining ended. The site is near the top of a hill and is covered with native grasses and some cactus. The soils in the area are Olney fine sandy loam and Cascajo gravelly sandy loam. A map from the Conservation Service along with a description of the soils is attached. (b) There are no existing structures or improvements except for a perimeter fence of barbed wire in fair condition. (c) There are no water resources on the property or in the immediate vicinity The nearest defined drainage is Wildcat Creek to the west southwest approximately 150 ft lower in elevation. It is our opinion that neither surface nor groundwater systems will be affected by this mining operation and that no discharge permits will be required. EXHIBIT C MINING PLAN GOODMILLER PIT/ VESCO CONSULTING SERVICES, LLC (a) Mining will commence on November 1, 2013 and continue thru November 1, 2023 or until the deposit is depleted. (b) The mining plan is to strip the topsoil using scrapers and pile it along the northern perimeter of the permit area. The topsoil stockpile will be graded to a maximum 3:1 slope and seeded with native grasses to prevent erosion. The topsoil pile will be graded and seeded to prevent erosion. (c) The depth of the topsoil on the site varies from none to approximately 4 inches with the previously mined area having little or no topsoil. The upon completion of mining the topsoil will be replaced to its historical depth including on the slopes which will be sloped to a 4:1 slope after during the mining process. (d) There is no overburden below the topsoil in this pit and all material will be used in the finished product. (e) The deposit is estimated to be approximately 15 feet in depth across the mining area. (f) The mining area is 675 ft east to west and 629 ft north to south. There will be a road of 260 ft long and 20 ft wide leading onto the site. The total affected area is approximately 9.87 acres. The new road will be 20 ft in width, crowned and ditched to control wastewater. The ditches will direct wastewater into the pit area where it will be contained. (g) The access road from the county road will be 260 ft in length and 20 ft wide. The mine roads wilt also be 20 ft wide and built in a one way configuration. All roads in the pit area will be graded, compacted, crowned, ditched and hard surfaced with road base. (h) The only water used on site will be for dust control. Water will be purchased from a commercial source in the area and applied to the roads as necessary either with a water truck or sprinkler system on an as needed basis. (i) There will be no groundwater encountered nor will any surface water be disturbed in any way. This operation will produce no storm water runoff as all water will be contained on site. The perimeter of the site will be bermed to contain all storm water and a catch basin will be constructed on site. (j) It is my opinion that no Colorado water rights will be affected or damaged in any way by this mining operation. (k) The only previous use of this property has been a small mine and grazing so there should be no refuse, acid or toxic materials exposed during mining of the site. If any refuse is encountered it will be collected and disposed of at an appropriate permitted disposal site. (I) By capturing all runoff water on site the subject area should not alter the hydrologic balance in any way. After mining and reclamation is complete the area will be reseeded and straw crimped to prevent any excessive runoff from the subject area. The 4:1 slopes and reseeding should make a stable site consistent with the proposed future use. (m) After stripping material will be fed into the processing equipment on the eastern side of the permit area and processed, then conveyed to the stockpile area on the southern edge of the permit area where it will be loaded, scaled and delivered using CR 115. The pit run will be mined using a front end loader, loaded into a crushing/screening plant and then stockpiled using conveyors. When the deposit is mined to its maximum depth the area will be graded and sloped to a 4:1 slope in preparation for reclamation. The pit will be mined from the northeast to the southwest, with the processing equipment moving to the mined area as needed to facilitate mining of the complete permit area. No explosives or chemicals will be used. All trash will be manages on site and hauled by a commercial trash company. (n) The primary commodities to be mined are gravel and dirt for construction in the area. (o) There are no incidental products projected in this operation (p) There will be no explosives used in this operation. EXHIBIT D RECLAMATION PLAN (1) (a) The reclamation of the site will take place after completion of mining. The topsoil will be stripped from the mining area as needed and stockpiled on the north edge of the permit area. The topsoil on this site varies from 0 to 4 inches in depth in depth. The topsoil removed will be replaced at a uniform depth across the mined area at the same depth as historically found in the area. (b) The banks of the pit will be sloped to a minimum slope of 4:1 then covered with topsoil to the same depth as found originally. (c) i. Topsoil depth is minimal. It will be replaced at the same depth as when removed,. ii. As mining is completed topsoil will be replaced, disced and reseeded. Seed bed will be straw crimped. iii. Buffalo Grass 6 lbs/acre Little Bluestem 4 lbs/acre Sideoats Grama 3 lbs/acre Blue Gramma 6 lbs/acre Total 19 lbs/acre iv. Seed is to be drilled v. seed bed will be straw crimped using a mechanical crimper vi. N/A (d)After mining is completed nothing will remain except the gate. (e) N/A (2) The estimated cost of reclamation is as follows. Placement and preparation of topsoil and mobilization $1,000 per acre Soil prep and till $ 65 per acre Seeding and straw crimping of the site $800.00 per acre Grading and sloping $ 175 per acre Total reclamation cost $2,045 per acre x 10 acres $20,450 During the mining process the base elevation will be established and sloping work will be done. Therefore, there are a number of important requirements which you, as a permittee, should fully understand. These requirements are listed below. Please read and initial each requirement, in the space provided, to acknowledge that you understand your obligations. If you do not understand these obligations then please contact this Office for a full explanation. 1. Your obligation to reclaim the site is not limited to the amount of the financial warranty. You assume legal liability for all reasonable expenses which the Board or the Office may incur to reclaim the affected lands associated with your mining operation in the event your permit is revoked and financial warranty is forfeited; 2. The Board may suspend or revoke this permit, or assess a civil penalty, upon a finding that the permittee violated the terms or conditions of this permit, the Act, the Mineral Rules and Regulations, or that information contained in the application or your permit misrepresent important material facts; 3. If your mining and reclamation operations affect areas beyond the boundaries of an approved permit boundary, substantial civil penalties, to you as permittee can result; 4. Any modification to the approved mining and reclamation plan from those described in your approved application requires you to submit a permit modification and obtain approval from the Board or Office; 5. It is your responsibility to notify the Office of any changes in your address or phone number; 6. Upon permit issuance and prior to beginning on -site mining activity, you must post a sign at the entrance of the mine site, which shall be clearly visible from the access road, with the following information (Rule 3.1.12): a. the name of the operator; b. a statement that a reclamation permit for the operation has been issued by the Colorado Mined Land Reclamation Board; and, c. the permit number. 7. The boundaries of the permit boundary area must be marked by monuments or other markers that are clearly visible and adequate to delineate such boundaries prior to site disturbance; 8. It is a provision of this permit that the operations will be conducted in accordance with the terms and conditions listed in your application, as well as with the provisions of the Act and the Mineral Rules and Regulations in effect at the time the permit is issued. 9. Annually, on the anniversary date of permit issuance, you must submit an annual fee as specified by Statute, and an annual report which includes a map describing the acreage affected and the acreage reclaimed to date (if there are changes from the previous year), any monitoring required by the Reclamation Plan to be submitted annually on the anniversary date of the permit approval. Annual fees are for the previous year a permit is held. For example, a permit with the anniversary date of July I, 1995, the annual fee is for the period of July 1, 1994 through June 30, I995. Failure to submit your annual fee and report by the permit anniversary date may result in a civil penalty, revocation of your permit, and forfeiture of your financial warranty. It is your responsibility, as the permittee, to continue to pay your annual fee to the Office until the Board releases you from your total reclamation responsibility. 10. For joint venture/partnership permittee: the signing representative is authorized to sign when document and a power of attorney (provided by the partner(s)) authorizing the signature of the representative is attached to this application. -6 - NOTE TO COMMENTORS/OBJECTORS: It is likely there will be additions, changes, and deletions to this document prior to fmal decision by the Office. Therefore, if you have any comments or concerns you must contact the applicant or the Office prior to the decision date so that you will know what changes may have been made to the application document.
