Garcia, Chair Commissioner Douglas Rademacher, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer Also present: Acting Clerk to the Board, Susan Brown Assistant County Attorney, Brad Yatabe Planning Department representative, Michelle Martin Public Works representative, Jennifer Petrik Health Department representative, Mary Evett The following business was transacted: ea I hereby certify that pursuant to a notice dated May 15, 2013, and duly published May 20, 2013, in the Greeley Tribune, a public hearing was conducted to consider the request of Jennifer Jaquish, for a Site Specific Development Plan and Use by Special Review Permit, USR13-0011, for a Child Care Center in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. LEI Michelle Martin, Department of Planning Services, presented a brief summary of the proposal. She reported that the Town of Frederick had no comment and the Town of Firestone commented they did not support the increased traffic and that the Firestone Regional Trail proximity was of concern. In a follow-up email the Town indicated that the applicant could request an amendment to the easement from the Firestone Town Board directly. She said the Conditions of Approval address the sentiments of Firestone. Ms. Martin reported there is no opposition on record from surrounding property owners and land uses, and the Planning Commission recommended approval unanimously. Ms. Martin showed pictures of the site and explained the location/proximity of the Firestone Trail, which their access easement crosses over. Commissioner Kirkmeyer questioned the difference between Condition of Approval #1.6 and #1.E, Ms. Martin confirmed that #1.E was redundant, but referenced the Department of Public Works, whereas #1.B referenced Planning Services. Commissioner Kirkmeyer also referenced #1.C. It was noted that Colorado Department of Human Services was erroneously referred to as Human Resources, which will be corrected. cc: e,ti, PL, Pay //G 2013-1512 PL2220 HEARING CERTIFICATION - JENNIFER JAQUISH (USR13-0011) PAGE 2 • Jennifer Petrik, Department of Public Works, provided a brief overview of the transportation plans and requirements and further addressed the access easement. • Mary Evett, Department of Public Health and Environment, reviewed the water and sewer provisions. She said they have complied with Development Standard #13 and are currently working to get the well water into compliance. to Mickey Leyba-Farnesworth, Permontes Group, represented the applicant, and reviewed progress on the Conditions of Approval andexisting access, and reported the well has been converted to commercial use. She said the only site improvement will be a playground. The Town of Firestone requested a discussion regarding the access crossing the trail. She noted the applicant's ultimate goal is to have a large-scale daycare in the Frederick area, as there are none. The applicant will provide Yield to Pedestrian signs before the trail, provide snow plowing, and also some asphalt improvements; she indicated the Town of Firestone is in agreement. a John Jaquish, Daycare Director, said the facility will serve 11 children; hours will be Monday thru Friday, from 6:00 a.m. to 6:00 p.m., there will be one employee; the facility has been recently remodeled with 2,500 square feet of playground; ages will be infants up to three years; lastly, he noted that they eventually hope to be annexed to Firestone with a larger facility. In response to Commissioner Rademacher, Mr. Jaquish said the site is 2.5 acres and they hope to put in an educational garden as well. g� Chair Garcia opened the meeting up to the public. No public testimony was offered concerning this matter. Ms. Leyba-Farnesworth confirmed she is comfortable with the Conditions of Approval and Development Standards. • Commissioner Rademacher referenced Development Standard #4, in regard to number of employees and the applicant's representative indicated this was acceptable. Chair Garcia noted that Development Standard #16, and Condition of Approval #1.C require correction. Anywhere it says "Human Resources" should be corrected to read "Human Services", by assent of the Board. Commissioner Rademacher proposed striking the last sentence of Development Standard #20, which was done by assent of the Board. Commissioner Kirkmeyer suggested the deletion of Condition of Approval #1.E, which was deleted by assent of the Board, and she questioned the hours of operation. Due to emergency late parents, Development Standard #3 was amended to be 7:00 p.m., by assent of the Board. Commissioner Kirkmeyer questioned the referenced approval from the fire protection district in Development Standard #31, and Ms. Martin said that if the Fire Protection District has a stricter fire code than the Building Department, they would most likely follow the County Code for issuing the building permit. Chair Garcia noted the fire department does a walk-through for any child care facility. By assent of the Board, Development Standard #31 was deleted. la Ms. Leyba-Farnesworth confirmed she and the applicant have reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as amended. • Commissioner Rademacher moved to approve the request of Jennifer Jaquich for a Site 2013-1512 PL2220 HEARING CERTIFICATION - JENNIFER JAQUISH (USR13-0011) PAGE 3 Specific Development Plan and Use by Special Review Permit, USR13-0011, for a Child Care Center in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended and entered into the record. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. There being no further discussion, the hearing was completed at 11:52 a.m. This Certification was approved on the 1st day of July, 2013.
