HomeMy WebLinkAbout20131704.tiffRESOLUTION RE: ACTION OF THE BOARD IN REGARD TO LETTER OF AGREEMENT CONCERNING USE OF COMMUNITY CORRECTIONS FACILITY AS 'COMMUNITY RETURN TO CUSTODY' FACILITY - INTERVENTION COMMUNITY CORRECTIONS SERVICES (ICCS) WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on June 26, 2013, the Board was presented with a Letter of Agreement Concerning the Use of the Community Corrections Facility as a 'Community Return To Custody' Facility between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Community Corrections Board, and Intervention Community Corrections Services (ICCS), and WHEREAS, the matter was continued to July 3, 2013, to allow time for the potential renegotiation of terms, and WHEREAS, after review, the Board deems it advisable to dismiss said letter agreement consequent to notification by staff that ICCS has withdrawn said request for use of the facility. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Letter of Agreement Concerning Use Of Community Corrections Facility as 'Community Return To Custody' Facility between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Community Corrections Board, and Intervention Community Corrections Services (ICCS), be, and hereby is, dismissed due to the withdrawal of said request. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 3rd day of July, A.D., 2013. (c/o: Intervention Community Corrections Services — ICCS) 1333 W. 120th Avenue, Suite 101 Westminster, CO 80234 Re: Additional Use at the Community Corrections Facility Dear Ms. Sengenberger: The Board of County Commissioners of Weld County authorizes ICCS to use the community corrections facility as a Community Return to Custody Facility (CRCF) to house certain parole violators as set forth in your agreement with the Department of Corrections and as further promulgated by CRS 17-1-206.5. Such use is conditioned upon ICCS accepting, in full, the following: 1. Regular Diversion, Transition or Condition of Parole offenders as defined in Weld County's contract with the State Department of Public Safety shall have placement priority over CRCF offenders; 2. ICCS shall only place parole violators who have already been paroled by the Parole Board to a verifiable residence within the territorial boundaries of Weld County; 3. ICCS must report monthly to the Community Corrections Board all CRCF offenders admitted and discharged from the facility; 4. ICCS shall not exceed fifteen (15) parolees on an average daily population unless otherwise approved by the Community Corrections Board and this Board; 5. ICCS shall conform with all requirements set forth in the Lease Agreement and Sub Contract with Weld County; 6. Any physical plant changes to the facility to accommodate these services (if any) will be made only after consultation with the Director of the Weld County Justice Services Division; and 7. The Community Corrections Board will review the viability of the CRCF program at the facility over the next six (6) months. Such Board may recommend to the Board of County Commissioners that this additional use cease, if the Community Corrections Board 2013-1704 deteunines that such use is not in the best interests of Weld County. The Board of County Commissioners retains the right, at any time and for any reason, to order the removal of part or all of the CRCF parolees and for ICCS to arrange that such parolees be placed at an alternate location and at no cost to Weld County.
