When he spoke to her he was still talking about haul routes in multiple directions so I said that at Planning Commission he said that 100% of the traffic will go east on CR 380 to Hwy 34. I told her that when he gets back to her with the additional info she should send her comments to you and then you'll forward them to Don, Jen & Janet (if needed). Below is the estimated traffic distribution going to the site: • 4 trucks per hour from eastbound SH 34 turning left on WCR 69; • 4 trucks per hour from westbound SH 34 turning right on WCR 69; • 4 trucks per hour from southbound WCR 69 turning right on WCR 380. How are they getting to the county road. Even at 12 trucks, given the passenger car equivalents, it potentially could trigger improvements to the highway. I need that information to determine that. The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: CR 380 is a local gravel road and requires a 60 -foot right-of-way at full build out. There is presently a 60 - foot right-of-way. These roads are maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state highways. Please contact Gloria Hice-ldler at the Greeley office (970-350-2148 or 970-350-2163) to verify the access permit or for any additional requirements that may be needed to obtain or upgrade the permit. (State Highway 34) Please submit an Access Permit Application for the two proposed accesses to the property. The Access Permit Application Form is available on the Public Works Website under Permits & Applications. The photos at the proposed access location, standard traffic control plan and fees are required (please see the application form). The application will be reviewed by the County Traffic Engineer and either approved or denied. Please show the approved accesses on the Plat and label them with the approved Access Permit number (will be provided). Access improvements are required and shall include 60' radiuses to accommodate turning trucks and tracking control to prevent the tracking of mud onto the gravel roadway. The applicant is showing the standard tracking control consisting of double cattle guards which is acceptable. The proposed traffic stated in the application is 75 round trips per day. The applicant agreed to the triggers for paving and turn lanes in their application. These triggers will be a part of the Improvements Agreement. The applicant has not specified a haul route. Maintenance, damage repairs, and upgrades may be required for the roadways utilized by traffic from the facility as determined by County staff observations and traffic counts. An Improvements and Road Maintenance Agreement is required for this site. Public Works will provide a draft of the Agreement after the Board of County Commissioners hearing for this project. There shall be no parking or staging of vehicles on CR 380. The maximum number of proposed trucks utilizing the site is 75 roundtrips per day. If the number of trucks exceeds this maximum, the Improvements and Road Maintenance Agreement may be revised and additional improvements may be required to mitigate the additional impacts to the haul route. No outdoor storage or overnight parking of vehicles is proposed for this site, therefore the water quality area has been waived. The property lies in a Special Flood Hazard Area (SFHA) defined by the Federal Emergency Management Agency (FEMA). This SFHA is delineated on the current effective Flood Insurance Rating C:\Documents and Settings\byatabe\Local Settings\Temporary Internet Files \Content.Outlook\8A5GP4JP\USR13-0030 PW referral.docx Map (FIRM), panel number #080266 0800C, dated September 28, 1982. Portions of lots located in the current effective FEMA 100-yr floodplain may not be buildable. Flood hazard development permits (FHDP) will be required for development activities located within the FEMA mapped floodplain. The FEMA definition of development is any man-made change to improved or unimproved real estate, including by not limited to buildings or other structures, mining, dredging, filling, grading, paving, excavation, drilling operations, or storage of equipment and materials. The applicant has applied for and received conditional approval of FHDP-813 for the water depot. REQUIREMENTS: 1. Add the following conditions of approval to the plat: a. Submit an Access Permit Application for the two proposed accesses to the site. b. Show and label the approved access points on the Plat (will be provided). c. Please label the floodplain on the plat with the FEMA Flood Zone and FEMA Map Panel Number. d. An Improvements and Road Maintenance Agreement is required for this site. Access improvements shall include 60' turning radiuses and double cattle guards to prevent the tracking of mud onto the County roadway. The triggers for roadway improvements agreed to by the applicant in the application will be included in the agreement. The agreement and form of collateral (if collateral is required as a condition prior to recording the plat) shall be reviewed by County Staff and accepted by the Board of County Commissioners prior to recording the Use by Special Review plat. 2. Add the following development standards to the plat: a. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. b. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. c. There shall be no parking or staging of vehicles on CR 380. d. The maximum number of proposed trucks utilizing the site is 75 roundtrips per day. If the number of trucks exceeds this maximum, the Improvements and Road Maintenance Agreement may be revised and additional improvements may be required to mitigate the additional impact to the haul route. e. WARNING: LOTS MAY NOT BE BUILDABLE DUE TO FLOODPLAIN OR FLOODWAY DESIGNATION. Please be advised that owners of Parcel #096534304028 may not be able to obtain building permits to construct non-agricultural structures. All construction or improvements occurring in the floodplain as delineated on Federal Emergency Management Agency FIRM Community Panel Map #080266 0800C dated September 28, 1982, shall comply with the Flood Hazard Overlay District requirements of Chapter 23, Article V, Division 3 of the Weld County Code and all applicable FEMA regulations and requirements as described in 44 CFR parts 59, 60, and 65. f. Flood hazard development permits will be required for development activities located within the FEMA mapped South Platte River Floodplain. The FEMA definition of development is any man-made change to improved or unimproved real estate, including by not limited to buildings or other structures, mining, dredging, filling, grading, paving, excavation, drilling operations, or storage of equipment and materials.
