Hwy 257 Windsor, CO 80550 July 5, 2013 Board of Weld County Commissioners 1555 N. 17th Ave. Greeley, CO 80631 Dear Board Members: Re: USR 12-0063, Murdoff Holdings, LLC With regard to the discussion and vote following the public comment period for the above USR last Wednesday, July 3rd, it seemed to have been influenced by an irrigation water issue that was legally settled over a year ago. Please accept a brief explanation: Since no one is allowed to do ditch repairs within an irrigation company's jurisdiction without prior consent, we contacted the Lake Canal Company in 2007. They recommended a company to examine and possibly handle the repair work. The 70 -year old broken cement ditch made two 90 degrees bends, passed under two farm roads and a driveway all with deteriorating culverts, and needed to carry water a half mile. The company recommended burying a 24" pipe to the point where the two properties meet and installing a valve to bring the water up into gated pipe to go east and west to each property. A licensed engineer checked it and Lake Canal Company approved the repairs. The ditch did not move from its historical easement and the water was still moved only by gravity flow. The owners of the neighboring property, Mr. and Mrs. Kelley, agreed that the repairs were necessary, but could not share in the cost. However, they did offer to let us use their one share of water as their only means of compensation and took care of the required paperwork with the ditch office for us to use their 3 acre feet. When Gordon Murdoff took over the property, he vehemently insisted that the pipe be removed because he was "not into farming, was a real estate developer, and was renting the house until it could be sold". His reply to all explanations was "buy me out". Our hired men picked up the pipe leaving the valve in place, picture attached. The following spring he filed a judgment against us. Our attorneys, Gene and Eric Fischer, spent several months with him before scheduling a Mediation on January 18, 2012, presided over by William L. West, a retired Judge from Greeley. The first offer from Gordon Murdoff was again to buy him out. We agreed to purchase his water right with the value to be determined by Sean Hoff who is involved with the majority of water sales within the district. Gordon Murdoff signed the Settlement Agreement and Quit Claim i Deed for the ditch easement, copies attached, and accepted our payment. The agreement stated that this was final and the issue was completely and forever settled. We followed all the rules, recommendations, and requirements. We took advantage of no one; we paid all the costs for repairs, and attempted to do whatever was required to be a good neighbor. It is extremely distressing to have our name and reputation potentially harmed with false accusations. Our family homesteaded on the Big Thompson River above Johnstown in the 1850's and has been involved in farming and ranching for over 150 years. As to your request to speak at the September hearing, it is my understanding that the Board of Commissioners closed public testimony and indicated that no further comments would be received at the upcoming hearing on 9/30/13. The decision to re -open public comment would be completely up to the board, and likely a majority would have to support the request.
