Storage
A Use by Special Review permit for a propane gas storage and fueling business.
The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process.
COMMENTS:
CR 77 is an arterial road, which requires a 140 -foot right-of-way at full build out. There is presently a 100 -
foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the
Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The
applicant shall delineate an additional 20 -foot of right-of-way parallel to the WCR77 right-of-way for full
build -out.
Access is off of CR77. The Average Daily Traffic was 1090 in 2010. An access permit application was
submitted. The Traffic Engineer will review the application and assign an access permit number for any
approved accesses to the site.
A traffic narrative was submitted and indicates there may be up to 1 large propane delivery truck per day
and up to 4 smaller distribution delivery trucks per day. Peak season is November through February.
A water quality feature is required to capture and treat stormwater runoff associated with the development
prior to flowing off site onto adjacent properties or downstream water ways. A water quality feature has
been designed and is being revised to capture the development including the access drive. Crow creek is
approximately 1000ft downstream from the site.
An improvements agreement is required for this site. Public Works will provide a draft of the agreement
after the Board of County Commissioners hearing for this project. An example Improvements Agreement
is available on the County Planning website under Application Assistance. Road maintenance after
construction is not required for this site due to the minimal traffic stated in the application (5 trucks/day).
In the event that 1 or more acres are disturbed during the construction and development of this site, the
applicant shall obtain a stormwater discharge permit from the Water Quality Control Division of the
Colorado Department of Public Health and Environment.
If more than 1 acre is to be disturbed, a grading permit will be required prior to the start of construction.
The grading permit application must contain: an erosion and sediment control plan, a grading plan,
installation details of all BMPs to be utilized, typical installation and maintenance notes for all BMPs to be
utilized, and a copy of the approved CDPHE stormwater permit.
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA).
REQUIREMENTS:
1. Show on the Plat:

a. County Road 77 is designated on the Weld County Road Classification Plan as an
arterial roadway, which requires 140 feet of right-of-way at full build out. The applicant
shall verify the existing 100 feet of right-of-way and the documents creating the right-of-
way and this information shall be noted on the plat. All setbacks shall be measured from
the edge of future right-of-way. If the existing right-of-way cannot be verified, it shall be
dedicated. This road is maintained by Weld County.
b. Show the approved accesses on the Plat and label with the approved access permit
numbers (will be provided).
Label the required water quality volume of the water quality feature(s) on the plat.
2. Before recording the Plat:
a. The applicant shall enter into a Private Improvements Agreement According to Policy
Regarding Collateral for Improvements and post adequate collateral for all transportation
(access drive, parking areas, et cetera) and non -transportation (fencing, screening,
drainage, et cetera). The agreement and form of collateral shall be reviewed by County
Staff and accepted by the Board of County Commissioners prior to recording the USR
plat. The applicant may submit evidence that all the work has been completed and
reviewed by the Departments of Planning Services and Public Works.
3. Before Construction:
a. In the event that 1 or more acres are disturbed during the construction and development
of this site, the applicant shall obtain a stormwater discharge permit from the Water
Quality Control Division of the Colorado Department of Public Health and Environment.
b. If more than 1 acre is to be disturbed, a grading permit will be required prior to the start of
construction. The grading permit application must contain: an erosion and sediment

4. Add the following notes to the plat:
a. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist
on the property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds.
b. Off-street parking spaces including the access drive shall be surfaced with gravel,
asphalt, recycled asphalt base, concrete or the equivalent and shall be graded to prevent
drainage problems.
c. The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent
property damage of the type generally attributed to run-off rate and velocity increases,
diversions, concentration and/or unplanned ponding of storm run-off.
d. The applicant must take into consideration storm water quality and provide accordingly
for best management practices.
e. Weld County is not responsible for the maintenance of onsite drainage related features.

Environmental Health Services has reviewed this proposal for any use permitted as a
Use by Right, an Accessory Use, or a Use by Special Review in the Commercial or
Industrial Zone Districts, (Propane Storage), in the A (Agricultural) Zone District.
The site will consist of two 30,000 gallon storage tanks and two 10,000 gallon storage
tanks at full build out. There will not be any full time employees located at the facility.
Drivers will access the property to fill their propane trucks as well as replenish the
storage tanks.
The following section is from Environmental Health Services, Weld County Department
of Public Health & Environment, Septic Policies.
2.2.K Use of portable toilets and bottled water (revised 5/8/12)
Purpose: To define when portable toilets and commercially bottled water are
allowed.
Policy: Bottled water from a commercial source and portable toilets are allowed
in the following circumstances:
1. Temporary or seasonal uses that are utilized 6 months or less per year
(for example recreational facilities, firework stands, farmers markets )
2. Gravel mines
3. 10 or less customers or visitors per day
and/or one of the following:
4. 2 or less full time (40 hour week) employees located on site
5. 4 or less part time (20 hour week) employees located on site
6. employees or contractors that are on site for less than 2 consecutive
hours a day
Note: Records of maintenance and proper disposal for portable toilets shall be retained
on a quarterly basis and available for review by the Weld County Department of Public
Health and Environment. Portable toilets shall be serviced by a cleaner licensed in
Weld County and shall contain hand sanitizers.
As indicated above, it is the policy of this department that portable toilets are allowed
when employees or contractors are on site for less than 2 consecutive hours a day. As
personnel will be on site for a short duration, in accordance with Environmental Health
Services policy the use of portable toilets is allowed.
The waste handling plan indicates a dumpster will be located on site which will be
serviced by Waste Chasers.
The dust abatement plan states the road going into the property, drive aisles on site and
parking areas will be constructed of gravel. A water truck will be utilized if necessary.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. Evidence of an application submitted to the Colorado Department of Labor and
Employment Division (CDL&E), Oil and Public Safety in accordance with the
Liquefied Petroleum Gas (LPG) rule 7 ccr 1101-15 shall be submitted to
Environmental Health Services, Weld County Department of Public Health &
Environment. Alternately, the applicant can provide evidence from the CDL&E,
Oil and Public Safety Section that they are not subject to these requirements.
2. The applicant shall submit evidence of an Aboveground Storage Tank permit
from the Colorado Department of Labor and Employment (CDL&E), Oil
Inspection Section for any aboveground storage tanks located on the site.
Alternately, the applicant can provide evidence from the CDL&E, Oil Inspection
Section that they are not subject to these requirements.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid

waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions. The applicant shall operate in accordance with the
approved waste handling plan, at all times.
4. The applicant shall comply with all provisions of the Underground and Above
Ground Storage Tank Regulations (7 CCR 1101-14), as applicable.
5. The applicant shall comply with all provisions of the Liquefied Petroleum Gas
Regulations (7 ccr 1101-15), as applicable.
6. The facility shall be operated in a manner to prevent odors. Odors detected off
site shall not equal or exceed the level of fifteen -to -one dilution threshold, as
measured pursuant to Regulation 2 of the Colorado Air Pollution Control
Regulations. Additional controls shall be implemented at the request of the Weld
County Department of Public Health and Environment in the event odor levels
detected off site of the facility meet or exceed the level of fifteen -to -one dilution
threshold, or in the judgment of the Weld County Health Officer, there exists an
odor condition requiring abatement.
7. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved dust abatement
plan, at all times.
8. This facility shall adhere to the maximum permissible noise levels allowed in the
Non -specified Zone as delineated in Section 14-9-30 of the Weld County Code.
9. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of the facility, at all times. As employees or contractors
are on site for less than 2 consecutive hours a day portable toilets and bottled
water are acceptable. Records of maintenance and proper disposal for portable
toilets shall be retained on a quarterly basis and available for review by the Weld
County Department of Public Health and Environment. Portable toilets shall be
serviced by a cleaner licensed in Weld County and shall contain hand sanitizers.
10. All potentially hazardous chemicals must be stored and handled in a safe manner
in accordance with product labeling and in a manner that minimizes the release
of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's).
11. The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

Dear Sir/Madam,
The Weld County Building Department has reviewed the proposed use and has the following comments:
The proposed business and structure will occupy a non -improved lot. No structures are currently located on
this parcel. A MFG Permit will be required for any modular type buildings. A commercial building permit will
be required for new buildings. On the back of this permit you will find the necessary items that must be
submitted with the application. The submittal must be complete with all the documents before it can be
accepted. In addition this building will require the following. Engineered drawings for all structural work and
architectural drawings that show the floor plan, elevations, ect. Also, a life safety plan showing occupancy
and building type, egress routes, emergency lights/exist, frontages, and travel distance must be submitted. A
ComCheck for the building envelope, mechanical, and electrical must be submitted showing that the building
will comply with the 2006 International Energy Code. Bathroom plans with details must be submitted to
show accessibility. Also an overall accessibility plan must be submitted. Mechanical, plumbing and electrical
drawings with a one line and fault current calculations are required. The building must comply with the
requirements set forth by Mountain View Fire District. A letter of notification that they have received the
drawings are they are ok with the release of the building permit must be submitted to our office with the
application.
Currently we are under the 2006 IECC, 2011 NEC and the 2012 IBC, IRC, IFGC, IMC and IPC.

Based upon the information provided, it would appear that the traffic proposed by this development will not
significantly impact the intersection of WCR 77 and SH 14. CDOT has no additional comment.
