RE: ACTION OF BOARD CONCERNING WAIVER OF TEN-DAY WAITING PERIOD FOR
CONSIDERATION AND INVESTIGATION OF BID #B1300175, ROAD BUILDING
MATERIALS - DEPARTMENT OF PUBLIC WORKS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Department of Purchasing has requested waiver of the ten-day waiting
period for Bid Request #61300175, Road Building Materials, for the Department of Public
Works, due to the 2013 Flood Emergency, and
WHEREAS, the Board of County Commissioners deems it advisable to waive the
ten-day waiting period for said bid, and grant discretion to the Public Works project managers to
choose the bidder best located to provide the lowest combination of haul costs and materials.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the ten-day waiting period for Bid Request #B1300175, Road
Building Materials, for the Department of Public Works, be, and hereby is, waived.
BE IT FURTHER RESOLVED by the Board that these bids be, and hereby are,
accepted, and discretion granted to the Public Works project managers to choose from these
seven (7) bidders the one best located to provide the lowest combination of haul costs and
construction materials.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 30th day of September, A.D., 2013.

SUBJECT: Emergency Materials Bids
Bid Number 1300175 closed at 10 am on September 26, 2013. Nine bids were submitted by various
companies. The bidders were L.G. Everist, Varra Companies, Best Way Concrete, Connell
Resources, J-2 Contracting, Dietzler Construction, Elk Creek Sand and Gravel, Don Kehn
Construction, Aggregate Industries.
Two of the bids, Dietzler Construction and Elk Creek Sand and Gravel are not located in the areas
that received flood damage. The other seven companies are located much closer to the areas
impacted by the recent flood event. Due to the increased cost of hauling material obtained from
Dietzler Construction and Elk Sand and Gravel, it is recommended that contracts not be awarded to
these two companies.
The other 7 companies have gravel pits located much nearer to areas that were impacted by the
flooding event. Emergency contracts should be awarded to each of these companies because of
their gravel pit locations in proximity to the flood damages.
Connell's Carr Pit is situated close to flood damaged gravel roads in the north portion of the County.
The pit has quantities of Class 6 aggregate base, pit run, and structural fill to meet the County's
needs in the northern portion of the County. There are no other gravel pits located near the flood
damages in this portion of the County. It is recommended that Connell Resources be granted a
contract for the purchase of emergency construction materials.
Aggregate Industries is the only company who placed bids that has 12" and 18" rock riprap in stock.
Their Morrison Pit also has class 6 aggregate road base, pit run, structural fill, and concrete rubble.
The Morrison Pit would be used mainly for the 12" and 18" rock riprap. The other products would only
be used if the other bidders cannot supply class 6 aggregate road base, structural fill, or concrete
rubble at locations closer construction sites. It is recommended that Aggregate Industries be granted
a contract for the purchase of emergency construction materials.
L.G. Everist has four gravel pits in locations that were hard hit by flood damage. The Carbon Valley
and Firestone/Nelson pits are near the center of the flood damaged roads and bridges in the
Firestone, Dacono, and Frederick area. The Firestone/Nelson pit has class 6 aggregate road base,
pit run, and structural fill that will be useful in repairing road and bridge damage in the southwest part
of the County. A few of L.G. Everist's pits also have concrete rubble that can be used for bridge
abutment and scour hole repair. It is recommended that L.G. Everist be granted a contract for the
purchase of emergency construction materials.
Best Way Concrete is one of three bidders who can provide flow fill for use in the emergency repairs.
Their batch plants that can provide flow fill are located in areas that are centrally located to the
damaged roads and bridges. A couple of their pits also have concrete rubble, concrete riprap. Due

to the proximity of the Best Way pits to the damaged road and bridge projects, it is recommended that
Best Way Concrete be granted a contract for the purchase of emergency construction materials.
Varra Companies, owner of several gravel pits in different parts of Weld County, is the second bidder
who can provide flow fill for use in the emergency repairs. Their batch plants are not as centrally
located as the Best Way batch plants but may be able to provide flow fill in the event that Best Way
cannot. A couple of the Varra gravel pits are located in areas that are close to flood damaged roads
and bridges. It is recommended that Varra Companies be granted a contract for the purchase of
emergency construction materials.
J-2 Contracting has a gravel pit located very close to one of the damaged road and bridge projects
that will require large quantities of construction materials to repair. J-2 also has large quantities of
concrete rubble, crushed concrete, and concrete road base that could be used to repair road and
bridge damage. It is recommended that J-2 Contracting be granted a contract for the purchase of
emergency Construction materials.
Don Kehn Construction is the third bidder who is capable of providing flow fill for use in the
emergency repairs. Their batch plant is located in southeast Fort Collins and is not located in an area
that is centrally located to Weld County's flood damage. Kehn Construction also has unlimited
quantities of class 6 aggregate road base, pit run, and structural fill. It is recommended that Kenh
Construction be granted a contract for the purchase of emergency materials.
Recommendation
An evaluation of the 7 bidders with materials available for use in the emergency repairs of roads and
bridges damaged by the flood shows that the pricing for various products does not vary significantly
from bidder to bidder. The County does not gain a cost savings by going with the low bidder in this
case. Therefore, it is recommended that contracts be granted to the 7 bidders listed above and to
allow the Public Works project managers to choose the bidder best located to provide the lowest
combination of haul costs and construction materials.
