Use by Special Review (USR) Questionnaire
1. A proposed Subdivision Exemption (SE) lot is located on a parcel that is presently
open range and in the Crop Rotation Program (CRP). The SE lot area, 2.0 acres, is to be
pulled out of the CRP. A lease is being created for the parcel, 5 years with an option for
an additional 5 years. The USR is for the proposed SE lot.
The proposed use of the SE lot and USR is for explosive bunker storage for a company,
GEODynamics, which is supporting the Gas and Oil industry in Weld County.
GEODynamics produces explosive products used in the fracking of Gas and Oil wells.
The amount of explosives the bunker system is designed for is 7,000 pounds. The actual
amount of explosives that will be stored at the site is approximately 4,000 pounds. The
site location is ideal as it is close, 1 IA miles, to the site where the fracking charges are
manufactured.
2. Chapter 22, Comprehensive Plan
Economic development, The creation of the explosives storage site will help the existing
company grow and create jobs as the business grows to meet the demand for the fracking
charges used in the gas and oil industry.
Industrial development, The location of the proposed explosives storage is in an area that
meets the set -backs, as defined by ATF, the set -back, under unbarricaded magazines, for
this explosives bunker to any occupied building is 1,600 feet, see attached insert from
ATF Manual, § 555.218 Table of distances for storage of explosive materials and the
enclosed definition of inhabited building. Therefore the site is not located in a
commercial or industrial subdivision. The proposed development does not comply with
the Comprehensive Plan for Weld County due to the ATF regulations for the safe storage
of explosives.
3. The site is located in a Agricultural Zone, the proposed use of explosives storage
used in the creation of fracking charges used in the gas and oil industry and would be
considered oil and gas support and service. Sec. 23-3-40. Uses by special review. The
following BUILDINGS, STRUCTURES and USES may be constructed, occupied,
operated and maintained in the A (Agricultural) Zone District upon approval of a permit
in accordance with the requirements and procedures set forth in Article II, Division 4 of
this Chapter.

4. The surrounding uses is as open range and is presently in the CRP. The 2 AC SE
parcel is to be removed from the CRP program. The site would be visible from WCR
100. Explosives storage requires large set -backs in regards to public safety, see attached
set -back table from the ATF Title 27, Code of Federal Regulations, Part 555 -Commerce
in Explosives. The area of the SE lot is two (2) acres and includes the 1.1 AC portion for
the access road and the explosives storage site which is 0.90 AC.
5. Describe, in detail, the following.
a. Number of people who will use the site.
One (1) to two (2) people will access the site at a time. It is assumed that one to two
trips a day will be made to the explosives storage site to pick up or store materials.
b. Number of employees proposed to be employed on this site. No employees will
work at this site. Storage only.
c. Hours of operation. The site will be accessed between the hours of 8 A.M. to 5 P.M.
d. Type and number of structures to be erected (built) on this site. Two (2) explosives
storage magazines will be placed at the site, one (1) 6' by 22' and one (1) 6' by 6'. The
site will have a security fence installed around the explosive storage site.
e. Type and number of animals, if any, to be on this site. No animals will be at this
site.
f. Kind of vehicles (type, size, weight) that will access this site and how often. The
vehicle used to access the site will be a pickup truck up to a 1 ton pickup truck.
g. Who will provide fire protection to the site? The Nunn Fire Protection District will
provide fire protection. However, by ATF rules, explosives fires are not be fought.
h. Water source on the property (both domestic and irrigation). There is not existing
water service for the site. No water is required at the site as no other buildings are
allowed at the explosives storage site, per ATF rules, as they would be considered an
occupied building. The set -back for any occupied building is 1,600'.
i. Sewage disposal system on the property (existing and proposed). No sewage
disposal is required at this site, see h. above.
j. If storage or warehousing is proposed, what type of items will be stored?
Explosives and Detonating Caps.
6. No landscaping is proposed for the site. There will be no existing or proposed water
source for landscaping.
7. The proposed gravel drive area will be tilled and replanted in the surrounding
native grasses. The storage magazines and security fences will be removed from the site.
8. Water Quality Capture Volumes (WQCV) will occur at the lowest portion of the
storage site. Off -site flows will be directed around the site.
9. The actual construction at the site will be very short, site grading and driveable
surface construction, 1 to 2 weeks. Placement of pre -built explosive magazines, 1 to 2
days. Construction of security fence and security system 1 week.
10. The explosive storage magazines will be place on the western side of the storage
site. No stockpile of waste will occur at this site. No waste will be generated at this site.
The Use by Special Review (USR) is being placed on a SE Lot and both applications will
be submitted concurrently.

There are no existing Septic Systems or Water Wells on the existing parcel. No Septic
Systems or Water Wells or Water Services are being requested for the proposed lots as
the ATF rules consider the use of a port -a -let as an occupied structure. The set -back,
under Unbarricaded magazines, for this explosives bunker to any occupied building is
1,600 feet, see attached insert from ATF Manual, § 555.218 Table of distances for
storage of explosive materials and ATF title 27, Code of Federal regulations -Part 555 -
Commerce In Explosives/Definitions.

Waste Handling Plan
No waste will be generated at the site. Materials will be brought to the site in packages
and removed from the site in the same packaging material.
Any debris that accumulates around the fence area and inside the site will be removed
from the site and properly disposed of at the manufacturing site in Nunn.
Dust Abatement Plan
The access road to the storage site and the storage site will be treated with a dust inhibitor
and then treated annually or as needed to control dust.
The last 100 feet, of the access, adjacent to Weld County Road 100, will be recycled
asphalt. Dust generated by this portion of the access will be minimized by the recycled
asphalt, however this portion of the access will also be treated with a dust inhibitor and
then treated annually or as needed to control dust.
The access road will have a 10 mile per hour speed limit.
Traffic Narrative
Traffic generated by this site will consist of a pickup truck, up to a one ton, accessing the
site more than four (4) times per day

Alles Taylor & Duke, LLC has been contracted to produce a portion of the required
documentation for the required Use by Special Review (USR). A topographic site survey
has been preformed and a copy of said survey has been attached to this drainage
narrative.
As requested a brief narrative of the existing storm water drainage patterns follows:
1. Off -Site Flows: Any off -site flows generated to the north and northwest will be
routed around the site by the use of shallow swale on the eastern, western and
northern sides.
2. Storm Water Flows leave the storage site on the southern side of the site. The
area of the site that has been developed is located and is configured as a flag
pole. All storm water flows leaving the storage site will first be captured in
drainage swales which will be located on the western, eastern and southern
sides of the storage site. When these drainage swales overflow, the storm water
flows will then flow out into the open range that surrounds the site.
3. The storm water flows at the site flow from the northwest to the southeast at
approximately 0.77%, see attached topographic survey.
4. From the existing conditions at the site, no drainage problems exist on the site.
From information obtained from the Weld County Public Works Department, Water
Quality Capture Volumes (WQCV) shall be calculated and provided on the site for the
proposed development. The area the WQCV was calculated for is the developed area
only and does not include the access drive. The area used in the WQCV calculations is
39,120 sf or ±0.90 AC. The imperviousness value obtained for the developed area is
0.12 or 12%, see attached computations. As outlined in the Urban Storm Drainage
Criteria manual, the WQCV was calculated using the equation found on page SQ-24.
The required WQCV obtained is 600 cf, see attached computations.
The proposed WQCV pond will consist of the proposed drainage swale due to the
required WQCV. The proposed WQCV pond/ swale has been designed as a retention
style pond and the WQCV will be percolated into the ground water. The existing site
condition, sandy soils, is well drained and is assumed that the WQCV pond will drain
within 72 hours after the end of storm events. The design volume of the WQCV pond is
864 cf and exceeds the required WQCV of 600 cf. The maximum depth of ponding is
2012-106

Inhabited building. Any building regularly occupied in whole
or in part as a habitation for human beings, or any church,
schoolhouse, railroad station, store, or other structure where
people are accustomed to assemble. except any building occupied
in connection with the manufacture, transportation, storage, or
use of explosive materials.
Interstate or foreign commerce. Commerce between any
place in a State and any place outside of that State, or within any
possession of the United States or the District of Columbia, and
commerce between places within the same State but through any
place outside of that State.
Licensed dealer. A dealer licensed under this part.
Licensed importer. An importer licensed under this part.
Licensed manufacturer. A manufacturer licensed under this
part to engage in the business of manufacturing explosive
materials for purposes of sale or distribution or for his own use.
Licensee. Any importer, manufacturer, or dealer licensed under
this part.
Limited permit. A permit issued to a person authorizing him
to receive for his use explosive materials from a licensee or
perntittee in his state of residence on no more than 6 occasions
during the I2 -month period in which the permit is valid. A limited
permit does not authorize the receipt or transportation of explo-
sive materials in interstate or foreign commerce.
Magazine..Any building or structure, other than an explosives
manufacturing building, used for storage of explosive materials.
Manufacturer. Any person engaged in the business of manu-
facturing explosive materials for purposes of sale or distribution
or for his own use.
Mass detonation (mass explosion). Explosive materials mass
detonate (mass explode) when a unit or any part of a larger
quantity of explosive material explodes and causes all or a
substantial part of the remaining material to detonate or explode.
Mental institution. Includes mental health facilities, mental
hospitals, sanitariums, psychiatric facilities, and other facilities
that provide diagnoses by licensed professionals of mental
retardation or mental illness, including a psychiatric ward in a
general hospital.
Natural barricade. Natural features of the ground, such as
hills, or timber of sufficient density that the surrounding expo-
sures which require protection cannot be seen from the magazine
when the trees are bare of leaves.
Number 8 test blasting cap. (See definition of "blasting
agent") '
Permittee. Any user of explosives for a lawful purpose who
has obtained either a user permit or a limited permit under this
part.
Person. Any individual, corporation, company, association,
firm, partnership, society, or joint stock company.
Plywood. Exterior, construction grade (laminated wood)
plywood.
Propellant actuated device. Any tool or special mechanized
device or gas generator system which is actuated by a propellant
or which releases and directs work through a propellant charge.
Pyrotechnic compositions. A chemical mixture which, upon
burning and without explosion. produces visible. brilliant
displays, bright lights. or sounds.
Railway. Any steam, electric, or other railroad or railway which
carries passengers for hire.
Region. A geographical region of the Bureau of Alcohol,
Tobacco and Firearms.
Regional director (compliance). The principal regional
official responsible for administering regulations in this part.
Renounced U.S. citizenship. (a) A person has renounced his
U.S. citizenship if the person, having been a citizen of the United
States, has renounced citizenship either —
(1) Before a diplomatic or consular officer of the United States
in a foreign state pursuant to 8 U.S.C. 1481(a)15); or
(2) Before an officer designated by the Attorney General when
the United States is in a state of war pursuant to 8 U.S.C.
1481(a)(6).
(b) The term will not include any renunciation of citizenship
that has been reversed as a result of administrative or judicial
appeal.
Responsible person. An individual who has the power to direct
the management and policies of the applicant pertaining to
explosive materials. Generally. the term includes parmers, sole
proprietors, site managers. corporate officers and directors, and
majority shareholders.

(I) lerms found in the [able of distances for storage of
exp olive. materials are defined in :555.11
(2) When two or more storage magazines are located on the
sr.o e property, each magazine must comply with the minimum
distances specified from inhabited buildings, railways, and
rughways, and in addition, they should be separated from each
other by not less than the distances shown for "Separation of
Magazines,` except that the quantity of explosives contained in
cap magazines shall govern in regard to the spacing of said cap
:magazines from magazines containing other explosives. If any
two or more magazines are separated from each other by less than
the specified "Separation of Magazines"' distances, then such two
o: more magazines, as a group, mast be considered as one
magazine, and the total quantity of explosives stored in such
group must or treated as if stored m a single magazine located :
the site or any magazir_e of the group, and must comp) "i'n Cx
m!i.imum of distances specifed from other magazines, inhabit: d
hui;cings. railways, and highways.
(3) All types of blasting caps in strengths through No 8 cap
should be rated at 1'G lbs. (1.5 lbs ) of explosives per 1.000 caps
For strengths higher than No. 8 cap. consult the manufacturer.
(4) For quantity and distance purposes, detonating cord of
50 or 60 grains per foot should be calculated as equivalent to 9
lbs. of high explosives per 1,000 tee:. Heavier or lighter core 'cads
should be rated proportionately_

CONDITIONS
This Company binds the kind(s) of insurance stipulated on the reverse side. The Insurance is subject to the
terms, conditions and limitations of the policy(ies) in current use by the Company.
This binder may be cancelled by the Insured by surrender of this binder or by written notice to the Company
stating when cancellation will be effective. This binder may be cancelled by the Company by notice to the
Insured in accordance with the policy conditions. This binder is cancelled when replaced by a policy. If this
binder is not replaced by a policy, the Company is entitled to charge a premium for the binder according to the
Rules and Rates in use by the Company.
Applicable in California
When this form is used to provide insurance in the amount of one million dollars ($1,000,000) or more, the title
of the form is changed from "Insurance Binder" to "Cover Note".
Applicable in Delaware
The mortgagee or Obligee of any mortgage or other instrument given for the purpose of creating a lien on real
property shall accept as evidence of insurance a written binder issued by an authorized insurer or its agent if
the binder includes or is accompanied by: the name and address of the borrower; the name and address of the
lender as loss payee; a description of the insured real property; a provision that the binder may not be canceled
within the term of the binder unless the lender and the insured borrower receive written notice of the cancel-
lation at least ten (10) days prior to the cancellation; except in the case of a renewal of a policy subsequent to
the closing of the loan, a paid receipt of the full amount of the applicable premium, and the amount of
insurance coverage.
Chapter 21 Title 25 Paragraph 2119
Applicable in Florida
Except for Auto Insurance coverage, no notice of cancellation or nonrenewal of a binder is required unless the
duration of the binder exceeds 60 days. For auto insurance, the insurer must give 5 days prior notice, unless
the binder is replaced by a policy or another binder in the same company.
Applicable in Nevada
Any person who refuses to accept a binder which provides coverage of less than $1,000,000.00 when proof is
required: (A) Shall be fined not more than $500.00, and (B) is liable to the party presenting the binder as proof
of insurance for actual damages sustained therefrom.
