RE: APPROVAL OF RECORDED EXEMPTION NO. 370 - MARVIN AND MILDRED BAY
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public hearing held
on the 29th day of January, 1979 in the Chambers of the Board
of County Commissioners of Weld County, Colorado, that the divi-
sion into two parcels of a certain parcel of land, as shown on the
plat known as Recorded Exemption No. 370, being the property of
Marvin and Mildred Bay, described as part of the East One-Half
of Section 1, Township 6 North, Range 65 West of the 6th P.M. ,
Weld County, Colorado, being more particularly described as follows :
A tract of land located in the East Half of Section 1,
Township 6 North, Range 65 West of the 6th Principal
Meridian, Weld County, Colorado and being more parti-
cularly described as follows:
Beginning at the Southeast Corner of said Section 1,
and considering the East line of said Section 1 to
bear North 00°02'03" West and with all other hearings
contained herein being relative thereto:
Thence North 00°02'03" West along the Fast line of
said Section 1, 40.01 feet to the True Point of
Beginning: Thence North 88°50'46" West, parallel
with the South line of said Section 1, 1411.74 feet;
Thence along the outer boundary of a tract of land,
being Recorded Exemption No. 0803-1-4-RE 138 and
filed under Reception No. 1689160 Weld County Records,
by the following four courses:
North 30°19'54" West, 463.01 feet;
North 17°02'16" West, 445.13 feet;
North 02°10'53" East, 765.31 feet;
Thence North 55°19'43" West, 408.06 feet;
Thence North 21°52'57" West, 888.78 feet to a point on
the East-West centerline of said Section 1;
Thence South 88°10'24" East along said Fast-West center-
line, 844.84 feet; thence along the easterly bank of an
irrigation ditch by the following three (3) courses:
North 28°17'00" West, 175.15 feet;
North 22°10'20" West, 130.90 feet;
North 01°46'30" East, 510.85 feet;
Thence South 80°09'50" East along an existing fence and
its easterly extension, 1708.83 feet to a point on the
East line of said Section 1, from which point Northeast
corner of said Section 1 bears North 00°02'03" West,
2094.23 feet; thence South 00°02'03" Fast along the East
line of said Section 1, 544.14 feet to the East Quarter
corner of said Section 1; thence continuing South 00°02'03"

tains 138.141 acres more or less and is subject
to any rights-of-way or other easements as granted
or reserved by instrunents of record or as now
existing on said tract of land.

"subdivision" and "subdivided land, " pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definition of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973, as amended,
and Section 2-1A(3) of the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Marvin and Mildred Bay be, and hereby is,
exempt from the definition of the terms "subdivision" and "sub-
divided land" pursuant to its authority under Section 30-28-101
(10) (d) , CRS 1973, as amended.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 29th day of
January, A.D. , 1979.

RE : Recorded Exemption #370
Dear Commissioners :
The attached application, plat and related items are in reference to
a request for a recorded exemption from Marvin and Mildred Bay. The
parcel of land is described as Pt . Ea Section 1 , T6N, R65W of the 6th
P. M. , Weld County, Colorado. This property is located 5 miles east
of Eaton and 1 mile west of Galeton. The property contains approxi-
mately 138 acres of Class II , III and VI irrigated soils.
The request is to split the property into parcels of 6. 7 acres and
131.4 acres more or less. The Bays wish to sell the smaller parcel
to finance a center pivot sprinkler system on the remaining 131. 4
acres. The sprinkler system will be more efficient than the present
flood irrigation system. The Bays have no need for the improvements
on the smaller parcel because they now own and reside on a nearby
farm. The 6. 7 acre parcel would not be covered by the sprinkler sys-
tem.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends the re-
quest be approved for the following reasons :
1 . The proposed split conforms with Section 9-2 of the Weld County
Subdivision Regulations (intent clause of the recorded exemption
procedure) , Section 3-3 A. of the Weld County Zoning Resolution
(intent clause of the Agricultural Zone District ) , and the Weld
County Comprehensive Plan in that the use will be compatible
with surrounding agricultural uses. The request will allow agri-
cultural and related uses to be the predominant land use. There

will be no reduction in the amount of land currently used for
agricultural production. The Bays will be improving agricultural
production on the property by installing the center pivot sprinkler
system.
2 . The request complies with the provisions of Section 9-4 A. of the
Weld County Subdivision Regulations .

Dear Board:
We request a recorded exemption on the herein
described property' as we have no need for the house and
buildings on this property. We own a farm, on which we
reside, less than one mile north of the property we wish
to sell. We have two houses on the farm on which we reside
and have no need for the expense and worry of another set
of buildings.
We plan to install a center pivot sprinkler on
the south farm and this corner to be sold would be missed
by the irrigation system, so for all practical purposes, is
waste land for agricultural purposes. Selling this
property will enable us to finance the center pivot system.

The soil owned by Marvin Bay located in the SEa, Section 1 ,
Township 6 North, Range 65 West, appears adequate for an
individual sewage disposal system. High groundwater in the
area may cause problems with the system installation. However,
this can only be ascertained by the performance of a percola-
tion test and evaluation of an eight foot test hole.
