WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Weld County Sheriff ' s Office - Jail Division is in need of services in the field of mental health for staff training, consultation, diagnosis and therapy, and WHEREAS, a contract between Weld County, Colorado and Weld Mental Health Center, Inc. for such services has been presented to the Board of County Commissioners of Weld County, Colorado, a copy of which is attached hereto and incorporated herein by reference, and WHEREAS, the term of said contract shall be from June 1 , 1979 through September 30 , 1979 , and WHEREAS, the Board of County Commissioners deems it advisable and in the best interests of Weld County, Colorado to approve said contract. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the contract between Weld County, Colorado and Weld Mental Health Center , Inc. con- cerning services in the field of mental health for staff training, consultation, diagnosis and therapy be, and hereby is, approved. The above and foregoing Resolution was , on motion duly made and seconded, adopted by the following vote on the 4th day of June, A.D. , 1979 . •..yi n �-j • , BOARD OF COUNTY COMMISSIONERS ATTEST: '��� II itM,t& �' y✓ WELD COUNTY, COLORADO ,JJ Weld County Clerk and Recorder Cl �� �- and Clerk to the /) (By 74- nt X n� t puty Couy erk AI APPROVE S T FORM: County A Sr e- 790591 e/ DATE PRESENTED: JUNE 6 , 1979 CONTRACT THIS CONTRACT entered into on the 4th day of June , 1979 by and between WELD COUNTY, COLORADO, acting by and through its Board of County Com- missioners , hereinafter referred to as the "County" , and WELD MENTAL HEALTH CENTER, INC. , hereinafter referred to as the "Center" , WITNESSETH: WHEREAS, the Weld County Sheriff' s Office - Jail Divi- sion, hereinafter referred to as the "Jail" is in need of services in the field of mental health for staff training, consultation, diagnosis and therapy, and WHEREAS, the Center possesses the staff and facilities to provide said services , and WHEREAS, the Law Enforcement Assistance Administration (LEAA) Grant Project No. 77-AGE-100 (1) C2-119 permits the Jail to seek such services . NOW, THEREFORE, the parties agree as follows : 1) The Center is to provide services , as specified in the following sections, to the Jail . The County shall pay the Center Sixteen dollars and eighty- seven cents ($16 . 87) per hour for services ren- dered to the Jail , but in no event shall the monthly payment to the Center by the County exceed One hundred thirty-five dollars ($135 . 00) per day nor One hundred sixty-eight dollars and seventy cents ($168. 70) per calendar month. 2) The provisions of this Contract shall apply only to those services supplied by the Center to the Jail which are specifically set forth herein. Services not specifically set forth herein may not be purchased by use of funds obtained under LEAA Project No. 77-AGE-100 (1) C2-119 . 3) The term of this Contract shall run for the period of June 1 , 1979 through September 30 , 1979 . NOW, THEREFORE, it is further mutually agreed as follows : I . DUTIES OF THE CENTER Center agrees : 1) To provide necessary services at the location shown as the address of the Center or at the Jail ; located at 910 10th Avenue , Greeley, Colorado , 80631 , as more specifically set forth herein. 2) Provide training and development programs for the Jail staff selected by the classification/intake project director or Jail administrator. (a) This training and development shall include , but not be limited to - inservice training in the areas of basic psychopathology, recogni- tion and assessment of mental health needs , emergency hold and treat laws, and job related stresses . (b) The Center shall provide approximately nine (9) hours of this service during the term of this Contract, the number and duration of training sessions to be determined by mutual agreement between the Center and the classifica- tion/intake project director. 3) To consult with Jail classification/intake section counselors regarding specific cases , treatment plans and clinical approaches to treatment of Jail inmate-clients . (a) The Center agrees to provide approximately four (4) hours per month of this service , the exact amount to be determined by mutual agreement of the Center and the classifi- cation/intake project director. 4) To provide a certified psychologist to the Jail for consultations and review of Jail psychological testing of Jail inmate-clients . The certified psychologist will be available for such services when test results will be used for external purposes , but in no event shall the services of the psychologist under this Contract be used for either court ordered testing or attorney requested testing of Jail inmate-clients . (a) The Center agrees to provide approximately two (2) hours per month of such services ; the exact amount to be determined by the project director. 5) To provide limited direct therapy services for emergency evaluations and for evaluation of medication treatment programs for Jail inmate- clients . (a) The Center agrees to treat Jail inmate- clients at the medication clinic located at the Center, but if transportation to the Center involves a "high security risk" under the Terms of "Section II-4" of this Contract, the Center agrees to treat the inmate-client within the confines of the Jail or as other- wise ordered by the Court . The Center agrees to abide by all security measures of the Jail when treating an inmate-client within the confines of the Jail . (b) The Center agrees to provide approximately two (2) hours of such services per month. Any or all of the two hours not required for services during each month may be carried forward and used in the succeeding months , but in no event may total accumulated time carried over exceed two (2) hours , and further, the total amount of time for this service during the term of this Contract shall not exceed eight (8) hours . 6) To provide case histories to the Jail of inmate- clients treated under this Contract upon pre- sentation by the County of an appropriate written authorization, signed by the inmate, for the release of such information. Such case histories shall include diagnosis, prognosis and psychological test results . 7) The Center agrees to maintain daily records on services rendered to the Jail . Such records shall contain a listing of the hours worked on the project and dates worked and the services per- formed. The Center agrees to provide copies of said records to the Jail on a quarterly basis . II . DUTIES OF THE COUNTY County agrees : 1) To provide space for scheduled jail staff training and development programs . The County agrees to cooperate with the Center in identifying training needs and planning for the implementation of training. The County further agrees to photocopy printed materials to be used during the training sessions , but , in no event , may photocopies be made without express approval of the intake/classi- fication project director. 2) To be available for case consultations as agreed upon by the Jail ' s intake/classification project director' s designee, and the Center' s designee . The space for these consultations will be provided for by the Jail . 3) To secure appropriate written authorizations for release of information by the Jail to the Center from the inmate-client prior to case consultations with the Center. 4) To determine whether or not there would be a "high security risk" in transporting inmate-clients to the Center for any of the services enumerated herein. The Watch Commander or a member of the Program Staff Unit of the Jail shall make the determination based upon the classification made at the time of intake of the inmate-client , further observation of the inmate-client , and the availability of manpower from the Jail to provide security for transporation to the Center and treatment at the Center. 5) To transport inmate-clients , where there is no "high security risk, " to the Center, for the psychological testing services referred to in "Section I - 4" of this Contract but only after obtaining an appointment with the Center. Such transportation will not be required if the psycholo- gist is at the Jail for other services . 6) To take all feasible steps to minimize the use of the Center for emergency evaluations and medica- tion clinics , and to utilize the services only for actual emergencies . Further, the County agrees to transport inmate-clients to the Center for such services but only in the event there is no "high security risk. " 7) The County agrees to pay the Center in accordance with the rate as determined for services rendered on a quarterly basis on July 1 , 1979 and October 1, 1979 . III . GENERAL PROVISIONS IT IS FURTHER AGREED AND UNDERSTOOD by County and Center that : 1) All books , records and other documents relevant to this Contract shall be retained for three (3) years after the final payment under this Contract, or until a Federal audit is completed, or until the findings of a completed audit have been resolved satisfactorily, whichever occurs later, and State, Federal auditors and any person duly authorized by the County shall have full access to and the right to examine any of said materials during said period. 2) All applicable Federal and State laws and regu- lations regarding the confidentiality of the books , records and documents aforementioned will be complied with. 3) This Contract contains the entire understanding between the parties and no modification, amend- ment, renovation, renewal or other alteration to this Contract shall be deemed valid or of any force or effect whatsoever, unless mutually agreed upon by the parties and embodied in writing. 4) Incorrect payments to the Center, due to omission, error, fraud or defalcation, shall be recovered from the Center either by deduction from subse- quent payments or by the County as a debt due the County. 5) In no event shall the Center be considered nor act directly or indirectly as an employee , servant or agent of the County or any of its agencies , but shall be deemed an independent contractor for all purposes . 6) It is understood and agreed that in the event State and Federal or County funds are not obtained and continued at an aggregate level sufficient to allow for the purchase of the indicated quantity and quality of purchased services , the obligations of each party hereunder shall thereupon be terminated, provided that any formation of this Contract shall be without prejudice to any obligations or lia- bilities of either party already accrued prior to such termination. 7) This Contract may be cancelled or terminated by either the County or the Center during the term of this Contract; however, the party seeking to terminate or cancel this contract must give written notice of its intention to do so to the other party at its address hereinabove stated, at least thirty (30) days prior to the effective date of cancellation or termination.
