RE: APPROVAL TO CLOSE WINDSOR AND FORT LUPTON SANITARY LANDFILL
SITES.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado held a public hearing on the 24th day of October, 1979
at the hour of 2 : 00 o'clock p.m. for the purpose of considering
the closure of the Windsor and Fort Lupton Sanitary Landfill
sites, more particularly described as follows :
1. The site known generally as the Windsor
Sanitary Landfill which is located on
Southeast Quarter Northeast Quarter of
Section 32, Township 6 North, Range 67
West of the 6th P.M. , Weld County,
Colorado.
2. The site known generally as the Fort
Lupton Sanitary Landfill which is located
on a portion of the North Half of the
Southeast Quarter of Section 19, Township
1 North, Range 66 West of the 6th P.M. ,
Weld County, Colorado.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado heard all of the testimony and statements of those pre-
sent, and all of the exhibits and evidence presented in this
matter and having been fully informed, finds that the closures
of the aforementioned sanitary landfill sites would be in the
best interests of Weld County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the closures of the
Windsor Sanitary Landfill site and the Fort Lupton Sanitary Land-
fill site be, and hereby are, approved conditional on certification
of a South County site and Colorado Landfill , Inc. following the
statutory procedure for notice of closure at such time as they
request closure.

The following business was transacted:
I hereby certify that pursuant to a notice dated September 17, 1979
and duly published September 20, 1979 and October 11, 1979 in the
Platteville Herald a public hearing was held on the request of
Colorado Landfill, Inc. for the closure of solid wastes disposal
sites and facilities. The solid wastes disposal sites and facilities
which were the subject of this hearing are the sites known generally as
the Windsor Sanitary Landfill and the Ft. Lupton Sanitary Landfill.
Mr. Warden reviewed the study made by himself, the Planning Staff
and the Weld County Health Department of the existing landfill sites
in Weld County.
Kenneth Lind, legal counsel for the applicant, elaborated on the
study and his clients request. Lynn Keirns, president and Brad
Keirns, secretary, of Colorado Landfill, Inc. were present and
testified. Vern Nelson, of Nelson Engineering, a consulatant for
the applicant also testified.
Ron Stow of the Weld County Health Department elaborated on the
concerns of the Health Department and findings of methane gas tests
conducted at the Ft. Lupton site.
George Rosenoff, Jr. , owner of the land for the Windsor site, and
his legal counsel, Thomas Hellerich, related to the Board their
opposition to closure of the Windsor site.
Several other peolple were present and voiced their opposition to
the closures of said sites.
After all testimony had been presented and discussed Commissioner Roe
made a motion to approve the closure of the solid waste disposal sites
and facilities in Windsor and Ft. Lupton conditional on the approval
and designation of a south county site. Commissioner Steinmark
seconded the motion.
CHANGE TAPE 79-132
Commissioner Roe amended his previous motion to read closure to take
place conditional on the designation of a south county site, the sites
to be closed upon the opening of the south county site, in any case,
no sooner than 60 days according to the statutory requirements.
The motion carried unanimously.

NOTICE IS HEREBY GIVEN of a hearing before the Board of County
Commissioners of Weld County, Colorado, on the 24th day of
October, 1979 at the hour of 2 : 00 p.m. in the Weld County Com-
missioners ' hearing room, first floor, Weld County Centennial
Center, 915 10th Street, Greeley, Colorado, for the purpose of
considering the application of Colorado Landfill, Inc. for the
issuance of an Official Notice of Closure for two (2 ) solid
wastes disposal sites and facilities located within Weld County,
Colorado. The proposed Official Notice of Closures , in the event
that the operator has properly posted the property, will provide
for official closure of the solid wastes disposal sites and
facilities. This procedure is in accordance with the Solid Wastes
Disposal Sites and Facilities Act, Section 30-20-101, et seq. ,
CRS 1973 , as amended, and regulations promulgated thereto at
6 CCR 1007-2 , Section 7 b.
The solid wastes disposal sites and facilities which are the
subject of this hearing are as follows :
1. The site known generally as the Windsor Sani-
tary Landfill which is located on Southeast
Quarter Northeast Quarter of Section 32 , Town-
ship 6 North, Range 67 West of the 6th P .M. ,
Weld County, Colorado.
2 . The site known generally as the Fort Lupton
Sanitary Landfill which is located on a por-
tion of the NZ SE; of Section 19 , Township 1
North, Range 66 West of the 6th P.M. , WELD

and compacted each working day.
2) Failure to cover as required in CRS 30-20-110, Subparagraph D,
Solid Waste Disposal Sites and Facilities Act of 1976. The placement
of six inches of soil cover each working day is generally deemed
necessary for proper maintenance of a solid waste disposal site.
3) Failure to adequately fence as required in CRS 30-20-110, Subpara-
graph E, Solid Waste Disposal Sites and Facilities Act of 1976. All

Gentlemen:
This letter is to inform the Weld County Commissioners of the
solid waste disposal sites in Weld County which ar-• not being
operated in accordance with the minimum standards presented in the
Colorado Revised Statutes, 30-20-110 of the Solid Waste Disposal Site
and Facilities Act of 1976. A copy of the Act and Regulations is enclosed
for your reference.
Please find attached a list of those sites in Weld County which are
not in compliance with the CRS 30-20-110, Solid Waste Disposal Sites and
Facilities Act. The name of the District Engineer, the date of inspection
and the items of noncompliance are also presented.
Your attention is directed to Section 112 of the State Act which states
that "The Board of County Commissioners , after reasonable notice and public
hearing , shall temporarily suspend or revoke a certificate of designation
that has been granted by it for failure of a site facility to comply with
all applicable laws , resolutions , ordinances or to comply with the provisions
of this Part 1 or any rule or regulation adopted pursuant thereto" .
Your written reply describing a plan of action and/or compliance schedule
to upgrade or close each site in noncompliance must be sent to this office
within 30 days of the date of this letter, to receive appropriate attention
in the evaluation of each site' s noncompliance status. It is in the interest
of the public health and safety that corrective measures he implemented on
a site specific basis as soon as possible.

Dear Mr. Roweder:
The Board of Weld County Commissioners has received a Notice of Violation
for Solid Waste Disposal Sites from the Colorado Department of Health.
That notice states that the Brighton-Ft. Lupton site and the Windsor
site do not meet the minimum standards required in CRS 30-20-110
of the Solid Waste Disposal Site and Facilities Act of 1976.
Under Section 112 of that Act, the Board of County Commissioners , "after
reasonable notice and public hearing, shall temporarily suspend or revoke
a certificate of designation that has been granted by it for failure of a
site facility to comply with all applicable laws , resolutions , ordinances
or to comply with the provisions of this Part 1 or any rule or regulation
adopted pursuant thereto. "
We are attaching the exhibits for the non-complying sites. The Board must
submit a written reply to the State Department of Health by December 15th;
therefore, we wish to have, in writing, your compliance schedule to upgrade
the sites which are in non-compliance. The Board has scheduled a work
session at 4 PM on Monday, December 11th at which time the Board will review
your proposal for compliance. Please plan to attend that session.
Should you have any questions concerning the provisions required in the
compliance plan., please contact Mr. Joe Meek, District Engineer with the
State Health Department, or Mr. Albert J. Hazle, Director of the Radiation
and Hazardous Wastes Control Division, State Health Dept (Phone 320-8333) .
Please confirm by telephone with the Commissioners ' Office that you will

Dear Mr. Hazle:
RE: Notice of Violation Solid Waste Disposal Sites
Concerning the violation notice from your office dated November 16,
1978, please find attached a letter from Mr. Ralph Rohweder, owner
of Weld Landfill , Inc. , which states the measures he is taking to
bring the Windsor and Ft. Lupton sites into compliance.
The Board of Weld County Commissioners is undertaking a study of all
the designated landfill sites in Weld County to determine our ability
to meet and maintain the standards as well as to ensure the economic
viability of these sites . We will also be examining alternate methods
of disposal which might be available to Weld County in an attempt to
meet those objectives.
Please advise the Board as soon as possible should you require
further information on actions being taken in this matter.

Ladies and Gentlemen:
In response to your letter doted November 27 , 1978
regarding non-compliance at two sites, t he necessary steps
to improve the conditions at these sites is underway. We
have sufficient men and machinery at work now.
We request a re-inspection of these sites on December 21 ,
1978 to show that we are making good progress in bringing and
keeping these sites in compliance. Our future plan of operation
is to keep the top and sides of 'the trash covered daily at the
Ft. Lupton site.
We will also keep the trash covered at the Windsor site
adequately. There is not sufficient cover material necessary to
cover the working face daily. If any obnoxious odors or wind-
blown paper becomes a nuisance, we will cover the working face.
The fence is being upgraded at this time and we will continue
until it is in compliance.

(6) Closing of the facility will create a substantial inconvenience to
