WHEREAS, it has been determined by the Board of County Commis-
sioners, Weld County, Colorado, that Fred B. Schaller and Nicholas J.
Schaller, of Denver and Brighton, Colorado, respectively, are the owners
of 40. 510 acres of land, and they are desirous of splitting the property
into parcels of 22 acres and 18. 510 acres; said whole parcel of land to be
more particularly described as follows, to-wit:
The East one-half of the East one-half of the Southwest Quarter
of Section 17, Township 1 North, Range 67 West of the Sixth
Principal Meridian, Weld County, Colorado, more particularly
described as: Beginning at the South Quarter corner said
Section 17; thence South 89°37'05" West on an assumed bearing
along the South line said Section 17 a distance of 668. 13 feet
to the Southwest corner said East one-half East one-half
Southwest Quarter; thence North 00°15'41" West along the West
line said East one-half East one-half Southwest Quarter a
distance of 2650. 08 feet to the Northwest corner said East
one-half East one-half Southwest Quarter; thence North 89°46'53" East
along the East-West centerline said Section 17 a distance of
664. 09 feet to the center said Section 17; thence South 00°20'55"
East along the North-South centerl ine said Section 17 a distance
of 2658. 18 feet to the point of beginning; containing 40. 510 acres,
more or less, and
WHEREAS, Fred B. Schaller and Nicholas J. Schaller are desirous
to split the land into parcels of 22 acres and 18. 510 acres in order that each
parcel may be developed as a home-site for each family, and
WHEREAS, it appears that to accomplish this purpose, Fred B.
Schaller and Nicholas J. Schaller may apply for a recorded exemption
from the subdivision regulations of Weld County, as same is defined in
Section 9-4 of the Weld County Subdivision Regulations, and
WHEREAS, in addition to evidence presented by Nicholas J. Schaller,
son of Fred B. Schaller, the Weld County Planning Commission Staff has
presented evidence, made representations concerning the desirability of
granting said variance, and
WHEREAS, the Board of County Commissioners feels that when all
of the evidence and representations are considered, good cause for granting
a variance from the minimum lot size requirements of the Weld County
Zoning Resolution has been shown.
NOW, THEREFORE, BE IT RESOLVED, that pursuant to the powers
granted to the County under Title 30 CRS 1973 and Section 9-4 A (6), Weld
County Subdivision Regulations as amended; that Fred B. Schaller and
Nicholas J. Schaller are granted an exemption from the lot size requirements
of the Weld County Zoning Resolution.
BE IT FURTHER RESOLVED, that this Exemption is allowed so that
Fred B. Schaller and Nicholas J. Schaller may proceed to apply for a
Recorded Exemption and the lot size variance is conditioned on the Schallers
applying for and doing all necessary to obtain said Recorded Exemption within
one (1) year, and said variance is limited to the Schallers, and will terminate
if they sell or otherwise discontinue their interest in the above mentioned
land prior to obtaining approval for and recording the above mentioned
Recorded Exemption.
