RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 401, AN AMENDMENT TO MINOR SUBDIVISION MS2 - F. L. WHITCOMB WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Com- missioners of Weld County, Colorado, at a public hearing held on the 9th day of July, 1979 in the Chambers of the Board of County Commissioners of Weld County, Colorado, that the division into two parcels of land, as shown on the plat known as Recorded Exemption No. 401, an amendment to Minor Subdivision MS2 , being the property of F. L. Said tract contains 24. 90 acres. does not come within the purview of the definition of the terms , "subdivision" and "subdivided land" , pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and WHEREAS, said request is to amend Minor Subdivision MS2 by reducing the size of Parcel A from 11.15 acres to 5. 90 acres. This will increase the size of Parcel B from 13. 75 acres to 19. 65 acres , and WHEREAS, the Department of Planning Services recommends that this request be approved as the impact would not appear to be significantly different that the original request which has already been approved, and WHEREAS, the Board of County Commissioners of Weld County, Colorado finds that this particular division of land is not within the purposes of the Weld County Subdivision Regulations and the Board desires to exempt this particular division of land from the definitions of "subdivision" and "subdivided land" pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, and Section 2-1A(3) of the Weld County Sub- division Regulations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the hereinabove described parcel of land owned by F. L. Whitcomb for an amendment to Minor Subdivision MS2. The property is described as Pt. NW4 Section 6, T4N, R68W of the 6th p.m. , Weld County, Colorado. This property is located 3 miles west of I-25 on the south side of Colorado highway 60. The request is to amend Minor Subdivision MS2 by reducing the size of Parcel A from 11 . 15 acres to 5 .90 acres. This will increase the size of Parcel B from 13. 75 acres to 19.65 acres. The applicant wishes to eliminate the short crop rows because of the problems of irrigation. A new residence is being proposed for the 19 . 65 acre parcel . The smaller parcel will be sold. Based upon the information submitted and the adopted policies in the County, the Department of Planning Services staff recommends approval since the impact would not appear to be significantly different than the original request which has already been approved. On June 28, 1979, the Weld County Board of Adjustment approved two requests for variances from the 180 foot requirement for minimum lot width in the Agricultural Zone District as set forth in Section 3 . 14 of the Weld County Zoning Resolution and Section 9-4 A. (3) of the Weld County Subdivision Regulations - for the property in question. The Colorado State Department of Highways has, in a letter dated June 19, 1979, requested an additional 25 feet of right-of-way be reserved along the south side of Colorado Highway 60 for future right-of-way needs. The Department of Planning Services is request- ing that the recorded exemption plat be amended to show a 25 foot reservation as requested by the Highway Department. This should be accomplished prior to recording the recorded exemption plat. Board of County Commissioners Page 2 July 9, 1979 The applicant should be aware that the Highway Department will require that access to Parcels A and B be from the existing driveway located on the 60 foot easement as shown on the plat. Whitcomb for a Recorded Exemption, and the following are our recommendations and requirements. 1 . Existing right of way on State Highway 60 is 63 feet along the 157.25-foot frontage of Parcel "A". Projected traffic volumes on this highway indicate the need for a total of 120 feet of right of way, 60 feet each side of the centerline. An additional 25 feet should be protected on the south side of the existing right of way to meet this need. This could be done by setback, reservation, or dedication (preferably the latter) as local zoning laws and regulations permit. 2. Due to the limited amount of property frontage along the highway and the existence of a driveway within the 60-foot easement, we will require that access to Parcels A and B be taken from the existing driveway.
