A Use by Special Review permit for upgrade of a gas plant
The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process.
COMMENTS:
CR 40 is a local gravel road and requires a 60 -foot right-of-way at full build out. There is presently a 60 -
foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the
Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
The ADT on CR40 in 2012 was 255. The application materials indicated there will be 6 employees per
day and 2 additional employees twice per month that access the site. 1 water truck will access the site 8
times per week.
An access permit has been submitted for this project. Please provide the following additional information
for the new access application. Fee of $75, photos left right and into the site. Photos left and into the site
were submitted, however no photo was provided looking right. When feasible, there shall be no net
increase in the number of accesses to a public road (Sec. 24-8-40). The site currently has 1 access. The
request for an additional access will be reviewed by the Traffic Engineer. Please label the approved
access on the plat with approved access permit number once provided.
Show on the plat 60ft radii access adequate for large turning trucks.
An alternative tracking control may be considered for this site. Surface must be a well drained, well
maintained all weather surface such as recycled asphalt, recycled concrete, or gravel to prevent mud and
debris from tracking onto the county roadway. Include a typical detail in the construction drawings.
An Improvements Agreement between the Applicant and the County is required for the construction
phase of this project.
A right of way permit is required for any work within the County right of way. A special transport permit is
required for over size, or weight vehicles. Contact Permitting/Inspection agent, at (970) 304-6496, ext.
3764.
A sketch plan level drainage report was submitted. For USR projects that require stormwater detention
facilities a final drainage report and final construction drawings are required. Please submit a final
drainage design, drainage report and construction drawings. An accepted final drainage report is required
prior to recording the plat. It appears that there are proposed improvements on the eastern existing
portion of the parcel. Please provide a letter from a Professional Engineer licensed in the State of
Colorado indicating that the existing retention facility is adequate and meets County Code with the
additional improvements or alternatively, provide a design that meets County Code requirements. Please
contact Public Works development review engineer with questions at 970-304-6496 x3762. See attached

REQUIREMENTS:
1. Prior to recording the plat:
A. Plat shall be amended to delineate the following:
1. County Road 40 is designated on the Weld County Road Classification Plan as a
local gravel road, which requires 60 feet of right-of-way at full build -out. The
applicant shall delineate on the plat the existing right-of-way. All setbacks shall
be measured from the edge of right-of-way. This road is maintained by Weld
County.
2. Show the approved access(es) on the plat and label with the approved permit
number (will be provided).
B. An accepted Final Drainage Report stamped and signed by a Professional Engineer
registered in the State of Colorado is required.
C. An improvements and road maintenance agreement is required for the site during
construction. Road maintenance including dust control and damage repair will be included.
2. Prior to Construction:
A. If more than 1 acre is to be disturbed, a Weld County grading permit will be required prior to
the start of construction.
B. Right of way permit is required for any work within the public right of way.
C. Special transport permit is required for any over size or over weight vehicles.
Development Standards (notes on the plat):
1. Should noxious weeds exist on the property, or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Chapter 15, Articles I and II, of the Weld County Code.
2. The historical flow patterns and runoff amounts will be maintained on the site.
3. Weld County is not responsible for the maintenance of onsite drainage related features.
4. There shall be no parking or staging of vehicles on County roads. On -site parking shall be utilized.

Environmental Health Services has reviewed this proposal for a Site Specific
Development Plan and Amended Use by Special Review Permit for Mineral Resource
Development Facilities including an Oil and Gas Support and Service Facility
(expansion of an existing Gas Processing Facility originally approved under USR-866)
in the A(Agricultural) Zone District.
The application states the facility will have 6 full time employees. Central Weld Water
District provides water. There is a septic system located on the adjacent facility (SP -
0100156) which is sized for 4 people. The application indicates the system will be
inspected by an engineer to determine if the system is adequate for additional
employees.
The waste handling plan stipulates that refuse will be removed by Waste Management.
The plan includes a list of types and quantities of chemicals to be stored on site.
Procedures for cleanup and disposal of spilled hazardous materials will be included in
AKA Energy Groups Spill Prevention Control and Countermeasure plan (SPCC). The
plan shall be available on site at all times.
On site dust will be controlled by graveling the site.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit evidence of an Air Pollution Emission Notice
(A.P.E.N.) and Emissions Permit application from the Air Pollution Control
Division, Colorado Department of Health and Environment to Environmental
Health Services Division of the Weld County Department of Public Health &
Environment. Alternately, the applicant can provide evidence from the APCD that
they are not subject to these requirements.
2. In the event the applicant intends to utilize the existing septic system the septic
system shall be reviewed by a Colorado Registered Professional Engineer. The
review shall consist of observation of the system and a technical review
describing the systems ability to handle the proposed hydraulic load. The review
shall be submitted to the Environmental Health Services Division of the Weld
County Department of Public Health and Environment. In the event the system is
found to be inadequately sized or constructed the system shall be brought into
compliance with current Regulations.
We recommend that the following requirement be incorporated into the permit as a
condition that must be met one month prior to operation:
1. A signed copy of the Spill Prevention, Control and Countermeasure Plan shall be
provided to Environmental Health Services Division of the Weld County
Department of Public Health & Environment.
We recommend that the following requirements be incorporated into the permit as
development standards.
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, blowing debris, and other potential nuisance conditions. The
applicant shall operate in accordance with the approved "waste handling plan", at
all times.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
5. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of the facility, at all times.
6. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.

7. All potentially hazardous chemicals must be handled in a safe manner in
accordance with product labeling and in a manner that minimizes the release of
hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All
chemicals must be stored secure, on an impervious surface, and in accordance
with manufacturer's recommendations.
8. The Spill Prevention, Control and Countermeasure Plan shall be available on
site, at all times.
9. The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

A building permit will be required for any new construction, alteration, or addition to any
buildings or structures on the property. A building permit application must be completed and
two complete sets of engineered plans including engineered foundation plans bearing the wet
stamp of a Colorado registered architect or engineer must be submitted. A geotechnical
engineering report performed by a registered State of Colorado engineer shall be required or a
open hole inspection.
Buildings, equipment and structures shall conform to the requirements of the various codes
adopted at the time of permit application. Currently the following has been adopted by Weld
County: 2012 International Building Code; 2012 International Mechanical Code; 2012
International Plumbing Code: 2012 International Energy Code; 2006 International Fuel Gas
Code; 2011 National Electrical Code; 2009 ANSI 117.1 Accessibility Code the 2012
International Plumbing Code. and Chapter 29 of the Weld County Code.
A plan review shall be approved and a permit must be issued prior to the start of construction.

Chris, I completed my review of the list request for aka Energy Group, LLC. Aka Energy Group is
currently reporting to the LEPC and they are in good standing. I would request that they provide
updated information when the facility is completed and report any increases in hazardous
material storage.
I would also request that they meet with the fire district representatives and make sure they
have a good understanding of response needs for the updated / new facility.

In December of 2O12, Mr. Szabo informed me that AKA was looking at expanding their current
operation on WCR 40. Once plans for the project are available, I will need a copy and will be
meeting with Mr. Szabo again. Nothing else further at this time is required.
