RE: APPROVE LANDOWNER CONSENT STATEMENT FOR AQUIFER: PIERRE SHALE
SANDS AND AUTHORIZE CHAIR TO SIGN - TOWN OF NEW RAYMER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Landowner Consent Statement for the
Town of New Raymer to withdraw ground water from the Pierre Shale Sands Aquifer for the
purposes of municipal water service, to be signed by the Chair on behalf of the County of Weld,
State of Colorado, by and through the Board of County Commissioners of Weld County, and
WHEREAS, after review, the Board deems it advisable to authorize the signing of said
consent statement, a copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Landowner Consent Statement for the Town of New Raymer to
withdraw ground water from the Pierre Shale Sands Aquifer, on behalf of the County of Weld,
State of Colorado, by and through the Board of County Commissioners of Weld County, be, and
hereby is, approved, and the Chair authorized to sign.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 16th day of December, A.D., 2013.

Landowner Consent Statement Pursuant to C.R.S. 37-90-137(4)(b)(II)
Aquifer: Pierre Shale Sands (Nontributary Ground Water)
WHEREAS, on May 11, 1965, landowners within the Town of New Raymer agreed with the Town of
New Raymer to provide municipal water service; and
WHEREAS, landowners entered into service agreements with the Town dated April 19, 1968 to provide
such water service; and
WHEREAS, on March 10, 1969, the Town Board of New Raymer passed Ordinance Number 23
establishing a water department;
NOW, I (we) hereby ratify, agree and consent to the Town of New Raymer to withdraw water from the
above described aquifer for purposes of municipal water service.

Dear All Landowners in the Town limits of New Raymer, Colorado,
You may or may not know that approximately two years ago the Town
received a letter from the State of Colorado Engineer putting our water
well on an abandonment list. Therefore, we had to hire a water engineer
and a water lawyer. We had to prove to the state that we are non tributary
to the South Platte River. This has been a long and expensive two years.
We are finally seeing a possible end to this process. The water court has
required the Town to get consent from all of the landowners for the
withdrawal of water from the Pierre Shale Formation.
The town well is the only water source for the Town of Raymer. Without
that source the value of everyone's land will diminish greatly. Could you
please sign this form and return it to me in the self addressed and already
stamped envelope? All landowners need to sign the form. We need these
forms back as soon as possible because we have a deadline to meet. If you
