Energy Inc. (Noble).
Noble shall be notified in writing of any change in ownership, decimal interest, or payment address. All such changes shall be
effective the first day of the month following receipt of such notice.
Noble is authorized to withhold payment pending resolution of a title dispute or adverse claim asserted regarding the interest in
production claimed herein by the undersigned. The undersigned agrees to indemnify and reimburse Noble any amount attributable to
an interest to which the undersigned is not entitled.
Noble may accrue proceeds until the total amount equals $25.00, or pay proceeds with a balance of $10.00 or more annually in
September of each year, whichever occurs first, or as required by applicable state statute.
This Division Order does not amend any lease or operating agreement between the undersigned and the lessee or operator or any other
contracts for the purchase of oil or gas.

Division Order Title Opinion ("Opinion") contains an examination of the record title to the

This letter is in response to your inquiry regarding your mineral interest ownership for the
DPG Fl-33CN well. After reviewing the Drilling and Division Order Title Opinion, dated
December 30, 2008, and revised on April 10, 2009, which encompasses the subject well,
covering Township 5 North, Range 65 West, 6th Principal Meridian, Section 1: W2SW and
Section 2: E2SE, Weld County, CO, it was determined that the acreage for Tract 4 of in the
E2SE of Section 2 is 7.11 acres. Attached please find pertinent information relating to your
royalty interest from this Drilling and Division Order Title Opinion.
While the Weld County Oil and Gas Lease (Small Tract), dated September 22, 2008,
recorded in Weld County, CO (Reception No. 3583882) indicates that the acreage amount is
6.106, this information is inconclusive. The legal description in your lease relies on an
Executor's Deed, dated January 15, 1975, recorded in Weld County, CO (Reception No.
1653750) and a metes and bounds measurement of Colorado State Highway #263 and the
north right of way line of the Ogilvy ditch. A possible explanation for the acreage
discrepancy can be attributed to soil erosion along the Ogilvy ditch since the Executor's Deed
was prepared in 1975. Otherwise, Noble Energy's Geographic Information Systems (GIS)
Department indicated that the only definitive way to address your concern for this acreage
discrepancy would be for you to resurvey the subject areas, because a conclusive acreage
amount cannot be determined based on the existing legal description from your lease and
supporting legal instruments. As such, Noble Energy is relying on the Drilling and Division
Order Title Opinion, dated December 30, 2008, and revised on April 10, 2009.
