HomeMy WebLinkAbout20130705.tiffRESOLUTION RE: APPROVE TEMPORARY PERMIT FOR A TAVERN LIQUOR LICENSE FOR AMIGOS NIGHT CLUB, LLC, DBA AMIGOS NIGHT CLUB, AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Amigos Night Club, LLC, dba Amigos Night Club, 1490 County Road 27, Brighton, Colorado, 80603, presented to the Board of County Commissioners of Weld County, Colorado, an application for a Transfer of Ownership of a Tavern Liquor License, for the sale of malt, vinous and spirituous liquors for consumption by the drink on the premises only, said License previously held by El Caporal Nightclub Inc., dba El Caporal Nightclub, and WHEREAS, Section 12-47-303, C.R.S., allows for the issuance by the Board of County Commissioners of a temporary permit to the transferee of an existing liquor license to authorize the transferee to conduct business and sell alcoholic beverages at retail in accordance with said license, subject to compliance with certain conditions, and WHEREAS, Amigos Night Club, LLC has complied with all of the conditions set forth in said Section, and WHEREAS, Amigos Night Club, LLC has also submitted the required application fee for said temporary permit of $100.00. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that having examined said application and other qualifications of the applicant for the transfer of the Tavern Liquor License and having considered said request for a temporary permit, does hereby grant to Amigos Night Club, LLC, dba Amigos Night Club, 1490 County Road 27, Brighton, Colorado, 80603, a Temporary Permit to conduct business and sell malt, vinous and spirituous liquors for consumption by the drink on the premises only, at retail at said location in accordance with the license previously held by El Caporal Night Club Inc., dba El Caporal Night Club, subject to all other rules and regulations set forth by the Board of County Commissioners of Weld County, Colorado, for a period of 120 days, or until such time as the application for Transfer of Ownership is approved by the State of Colorado, whichever shall occur first. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said permit. Conway Date of signaturMAR 1 9 2013 2013-0705 LC0028 PLEASE POST NEAR EXISTING LICENSE TO WHOM IT MAY CONCERN: On the 13th day of March, 2013, Michelle Williams, dba, Amigos Night Club, submitted an application for a Transfer of Ownership for a Tavern, with said license previously being held by El Caporal Night Club, Inc., dba El Caporal Night Club, and expiring on May 23, 2013. Until the Transfer of Ownership has been considered by the Board of Commissioners and notification has been received from the State advising whether this Transfer of Ownership request has been approved or disapproved, the Board hereby authorizes the continued sale of malt, vinous, and spirituous liquor at this establishment which is located at 1490 County Road 27, Brighton, Colorado, 80603, under a Temporary Permit which has been approved by the Board on March 13, 2013. This Temporary Permit allows Michelle Williams, dba Amigos Night Club, to conduct business and sell malt, vinous and spirituous liquors for consumption by the drink on the premises only, at retail at said location in accordance with the license previously held by El Caporal Night Club, Inc., dba El Caporal Night Club, subject to all other rules and regulations set forth by the Board of County Commissioners of Weld County, Colorado, for a period of 120 days, or until such time as the application for Transfer of Ownership is approved by the State of Colorado, whichever shall occur first.
